BACKGROUND
The owner of the Rosemead Shopping Center, Mr. Bob Nguyen, has filed an appeal of the design
review and zone variance applications that were approved by the Planning Commission at the August
15, 2005 Planning Commission meeting. At the August 15, 2005 meeting the Planning unanimously
approved the proposed building renovations and a variance for parking considerations as they relate
to a legal non-conforming property. During the appeal period, this project was appealed by the
adjacent property owner who owns the shopping center that surrounds the Universal Bank parcel.
Staff has been working with both property owners over the last three years to reach a mutually agreed
upon renovation plan for both properties. An agreement has not been reached and the two separate
property owners have continued to file separate entitlement applications in lieu of a joint application.
The applicant, Mr. Eric Lee has proposed a project that would renovate the existing Universal Bank
structure and the surrounding landscape and hardscape surfaces. In addition, Mr. Lee is requesting to
convert two, existing, vacant office spaces into a sit-down restaurant and a coffee/sandwich shop.
The crux of the disagreement between the two property owners lies with the interpretation of the City
of Rosemead Zoning ordinance as it relates to minimum parking requirements.

Staff supports the Universal Bank renovation project design, with slight modifications to the angled
parking lane design. Due to the lack of coordination between the two property owners, staff will
bring forward, at a later date, a public hearing item on Mr. Nguyen's application as they have plans to
expand the leasable area of the existing shopping center. Attached are two preliminary, conceptual
site plan schemes that were submitted by Mr. Nguyen, today. There are no formal applications
submitted for these conceptual designs and staff has not done an analysis on the proposed layout.
RECOMMENDATION
Staff recommends that the City Council UPHOLD the Planning Commission's decision of
approval of DESIGN REVIEW 03-110/ZONE VARIANCE 05-328.
