CC - 1976-79 - Approving Tract Map 31238n L CITY OF ROSEMEAD RESOLUTION NO. 76-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD CONDITIONALLY APPROVING TENTATIVE'TRACT 31238 AND MAKING FINDINGS THEREON. THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS FOLLOWS: WHEREAS; the City Council of the City of Rosemead has conducted public.hearings on tentative tract No. 31238, and WHEREAS, the planning staff, engineering staff,.and representatives of the applicant and public have had an.oppor- tunity to provide input and recommendations on the proposed tract, and . WHEREAS; solutions to all of the problems which concern the applicant, the City, and the community at large have been resolved, NOW, THEREFORE, BE IT RESOLVED THAT: Section ti.. The mattet of tentative tract No. 31238,was.duly noticed for consideration by the Rosemead Planning Commission on June 7, 1976 at 7:30 P.M., in the Council Chambers of the Rosemead City Hall"at,8838.Valley'Boulevard, Rosemead, California, and was thereafter continued to June 21, 1976 and again to July 6, 1976. Comments were received from the public, the applicant, and other interested parties. Section 2. The matter of tentative tract map No. 31238 was duly noticed for hearing before the City Council of the City of Rosemead on August 10; 1976,'at 8:00 P.M. in the Council Chambers of the Rosemead City Hall at 8838 Valley Boulevard, Rosemead, California.. The matter was thereafter continued to the meetings of September 28, 1976 and October 26, 1976, and testimony was taken from members of the public, the applicant, and other interested parties.. The.date, time, place and purpose of each meeting was,duly noticed and all proceedings were regu- larly conducted. At all times, the applicant was represented by counsel. Section 3. The City Council of the City of Rosemead makes the following findings with respect to tentative tract No. 31238: (a) that the proposed map and the proposed design or improvement are consistent with the applicable general and specific plans for the City.of Rosemead, (b) that the site is physically suitable-for the type of development.proposed, (c) that the site is physically suitable for the proposed density of development, . (d) that the design of the'subdivision.or the pro- posed improvements will not cause substantial environ- mental damage or-injury to wildlife or their habitat, 5 i l~ r y, (e) that the design.of, the subdivision and its improvements will not. cause'serious public health problems; (f) that the design of the subdivision and its proposed improvements will not conflict with easements. or other rights of access; 4 (g) that the proposed subdivision will not result in waste discharge into the'community sewer system which will result in.a violation of-existing sewer requirements as described by the.Regional Water Quality Control Board Section 4. The City Council of the City of Rosemead-further finds that an EIR has'been prepared for this project and is in. compliance with.the California Environmental Quality'Act, the guidelines for the implementation of said act, and Rosemead Resolution 75-28. Said environmental impact report is expressly approved: Section 5.. The City Counci'i of the City of Rosemead further finds that the size', shape, and topography of.the"subject parcel, together with its proximity to an area of surrounding development makes necessary the creation of.two cul-de-sacs in excess of 700 feet in length.. Strict application of -CountySubdivision Ordinanc'e.No. 4478, Section `47.1(b) would work an'unnecessary hardship upon the applicant and upon the surrounding residential community. Section 6: The City Council of the City of Rosemead approves tentative map No. 31238 subject to the~thirty_ conditions set forth in the report of the Los Angeles County Subdivision Committee and the report of the Planning Staff of the.City-of Rosemead. This approval expires 18 months from the date of the approval of this tract by the City Council of the City of Rosemead. PLANNING 2. This division of land must be found in conformance with the City of Rosemead's General Plan. 3. We also recommend that your legal counsel be consulted regarding compliance with the Supreme Court Decision relative to Section 21151 of the Environmental Quality Act which required an Environmental Impact Statement before giving approval to private application for "project" construction. 4. Provide sufficient area for all lots to conform with the requirements of the R-1-6,000 zone._ 5. Prior to recordation, file a letter with the City agreeing to provide 15 feet of pavement within the single access strip serving Parcel 10 and at least 20 feet of pavement within the multiple access strips serving Parcels 9 and 10. The maximum allowable grade for these driveways is 20%. In the case of single access strips, the physical access from street to building site shall be within the fee ownership of the lot served. Reciprocal easements shall be provided over multiple access strips for the benefit of the lots served. These access strips shall not be used to compute the net required area 6. Provide full improvements including street lights and sidewalks throughout the tract (except sidewalks along Arroyo Drive abutting the Freeway), in accordance with the requirements of the Subdivision Ordinance. - i- 7. Provide at least 40 feet of frontage at the property line and approxi- mately radial lot lines for all lots fronting on the knuckles and cul-de-sacs except those lots shown as being served by access strips 8. Provide a standard minimum 44 foot radius cul-de-sac bulb to satisfaction of the Road Department. 9. It is recommended that permission be granted to adjust the right of wa line for Arroyo Drive southerly into the freeway right of way, provide permission is obtained from_Cal Trans. 10. Remove and reconstruct the off-site cul-de-sac bulb on Silver Ridge. 11. It is recommended that the required 46 foot width for Arroyo Drive abutting the freeway be modified to permit a width of 44 feet. Provide a 3 foot parkway adjacent to the freeway. 12. Set aside the one foot strip owned by the City shown as Lot No. 8[f by resolution for street and highway purposes concurrent with or prior to approval of the final tract map. 13. Provide 36 feet between curbs. 14. Provide 40 feet of frontage and approximately radial lot lines for lots on turnarounds. CITY ENGINEER - 14APPING DIVISION 15. Easements shall not be granted or recorded within areas proposed to be granted,, dedicated, or offered for dedication for public streets or highways, access rights, building restriction rights, or other ease- ments until after the final tract map is filed with the County Recorder unless such easements are subordinated to -the proposed grant or dedication. If easements are granted after the date of tentative approval, a subordination must be_ executed by the easement holder prior to the failing of the final ract r.ap. } T• % • 9 AAAfinal tract map prepared by, or under the direction of, a Registered Civil Engineer or Licensed "Land-Surveyor must be processed through. this Department prior to being filed with the County Recorder. Prior to submitting the tract map to the City Engineer for his examina- tion pursuant to Section 66442 of the Government Code, obtain clearances from all affected Departments and Divisions including a clearance from the Subdivision Section of Mapping Division of County Engineer for the following mapping items: mathematical accuracy, survey analysis, and correctness of certificates and signatures. 16, Portions of the property are subject to sheet overflow and high velocity scouring action. Drainage plans. and necessary support documents to comply with the following requirements must be approved prior to filing of a final map: a. Eliminate the sheet overflow or elevate the floors of the buildings with no openings in the foundation walls to at least 12 inches above-the finished pad grade. b. Provide drainage facilities to protect the lots from high velocity scouring action. c. Provide for contributory drainage from adjoining properties. Comments: Drain all lots to a street. CITY ENGINEER - WATERWORKS & UTILITIES DIVISION 17. All lots shall be served by adequately sized water system facilities which shall include fire hydrants of the size and type and location as determined by the Fire Chief. The water mains shall be of sufficient size to accommodate the total domestic and fire flows required for the land division. Domestic flows required are to be determined by the City Engineer. Fire flows required are to be determined by the Fire Chief. At the time the final land division map is submitted for checking, plans and specifications for the water system facilities shall be submitted to the City Engineer for checking and approval, and shall comply with the City Engineer's standards. Approval for filing of this land division is contingent upon approval of plans and specifications mentioned above. If the water system facilitie are not installed prior to the filing of this land division, the subdi- vider must also submit a Labor and Materials Bond in addition to either: a. An Agreement and a Faithful Performance Bond in the amount estimated by the City Engineer guaranteeing the installation of the water system, or b. An Agreement and other evidence satisfactory to the City Engineer, indicating that the subdivider has entered into a contract with the serving water utility to construct -the water system as required, and has deposited with such water utility security guaranteeing payment for the installation of the water system. There shall also be filed with this Division a statement from the grater purveyor indicating that the proposed water mains and any other required facilities will be operated by the purveyor and that under normal oper- ating conditions the system will meet the requirements for the land division. 18. The Fire Chief's office requests that two fire hydrants with a 6"x4"x2-1/2" head, conforming to A;,n,7A standard 6503-75, six inch diameter lateral, six inch gate valve, and six inch diameter riser or bury be installed on the north side of Arroyo Drive; one at the common line of lots 21 and 22, and the other at the common boundary line of lots 2 and 3, or at such other location as may be acceptable to the Fire Chief's office. Prior to filing the finale land must be fulfilled: division map, the following conditions The final map must be approved by the assure that all geologic factors have Engineering Geology Section to been properly evaluated. A grading plan must be approved by the Engineering Geology Section. This grading plan must be based on a detailed engineering geology report and/or soils engineering report and must be specifically approved by the geologist and/or soils engineer and show all recommendations submitted ,by them. It must also agree with the tentative map and conditions as approved by the Planning Commission. All buttresses over 25 feet high must be accompanied by calculations.' CITY ENGINEER - SANITATION DIVISION 21. Approval of this land division is contingent upon the installation and dedication of local main line sewers and separate house laterals to serve each lot of the land division. The subdivider shall consult the Sanitation Division of the Department of City Engineer to determine the sewer design requirements. - Easements are tentatively required,.subject to review by the City Engineer to determine the final locations and requirements. The discharge of sewage from this land division into the public sewer system will not violate the requirements of the California Regional Water Quality Control Board pursuant to Division 7 (Commencing with Sec. 13000) of the Water Code. CITY ENGINEER - BUILDING & SAFETY DIVISION 22. The grading plan must be approved prior to filing of a final map. Prior to issuance of building permits, submit a soil engineer's report on the expansive properties of soils as such soils are defined by Building Code Section 2904(b) on all building sites in the proposed subdivision., FLOOD CONTROL DISTRICT 23. The subdivision is reasonably free of flood hazard from charnels and streams under the Flood Control District's jurisdiction. Refer to the report of the County Engineer, Design Division. Show and label on the final map, Flood Control District's right of way for Project 1225. Information relative to these rights may be obtained from this District's Right of Way Engineering Division. 226-4324. Comments: A District permit is required for all construction and grading effecting District right of way for Project 1225. CITY FIRE CHIEF 24. Provide water mains, fire hydrants, and fire flows as determined by the City Fire Chief for all land shown on the map to be recorded. DEPARTMENT OF PARKS & RECREATION 25. No local park space dedication or payment of an in lieu fee is required by the County for this project because this subdivision is not in an unincorporated portion of the County. Contact Rosemead for any questions about park land obligations in that City. Comments: Please refer this map -to the City of Rosemead. DEPARTMENT OF HEALTH SERVICES 26. All wiring for street lights and domestic service to be under- ground. Street light location to be determined by the Planning Director and Southern California Edison Company. 29. A sound attenuation facility satisfactory to Caltrans and the City Engineer shall be constructed between the freeway and the subdivision, and arrangements for maintenance of the facility shall be finalized before approval of the final map. 30. Within 10 days of the date of the approval of the.Tentative Tract Map 31238, the developer shall file with the Rosemead Planning Department a notarized affidavit of Acceptance of Conditions.
