ADOPTED BY THE MINUTES OF THE REGULAR MEETING ROSEMEAD ROSEMEAD CITY COUNCIL CITY COUNCIL OCTOBER 12, 2004 The regular meeting of the Rosemead City Council was called to order by Mayor Clark at 8:00 p.m. in the Council Chambers of the City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Mayor Clark The Invocation was delivered by Councilman Alarcon ROLL CALL OF OFFICERS: Present: Councilmembers Alarcon, Taylor, Vasquez, Mayor Pro Tern Imperial, and Mayor Clark Absent: None APPROVAL OF MINUTES: September 14, 2004 - REGULAR MEETING MOTION BY COUNCILMAN TAYLOR, SECOND BY COUNCILMAN ALARCON that the Minutes of the Regular Meeting of the Rosemead City Council held on September 14, 2004, be approved as submitted. Vote resulted: Yes: Alarcon, Clark, Imperial, Taylor, Vasquez No: None Absent: None Abstain: None The Mayor declared said motion duly carried and so ordered: PRESENTATIONS: None ORAL COMMUNICATIONS FROM THE AUDIENCE Rainbow Yeung, SCAQMD, Assigned Liaison for area, spoke on the AQMD's regulations and services. She brought information packets for the City. Oscar Cazares, 2433 La Presa wished to know who was in charge of: installing trashcans at bus stops; maintaining the on/off ramps at the freeways and curb house painting on La Presa. Bill Crowe stated that bus stop trashcans were the City's responsibility. He went on to state that the City has been in contact with Caltrans for years to get better maintenance at the on/off ramps of the City and that we have been working with Assemblywoman's Chu and Senator Romero's office. CCMIN:10-12-04 Page # I Ken Rukavina stated that for the current fiscal year the City has AQMD funds to replace bus shelters and trash receptacles and to encourage ridership up for approval the first of the year. As for curb house painting, the City paints the numbers every 5 years and is slated for the 2005-06 budget. He also stated that the City does not allow outside people to paint the curb numbers. Mr. Cazares stated that there needs to be a trashcan at the northwest corner of Walnut Grove Avenue and Garvey Avenue. Juan Nunez, 2702 Del Mar Avenue asked who does the cleaning at the bus stops? Mr. Rukavina stated that Laidlaw Transit cleans the bus stop shelters. But, if there is a real mess, he could call the County and they will come out. Mr. Nunez wanted to know who cleaned the sidewalks? Mr. Rukavina stated that the County Road Department cleaned the sidewalks. Mr. Nunez stated that he reported in June that there were branches on east side of Del Mar Avenue, but was not sure if it is City property or private. He stated that the wood was picked up, but not the branches. He also said that at 2614 Del Mar Avenue there was a cabinet still there, at 2317 Del Mar Avenue a trash can was so filled to overflowing that the trash company would not it pick up, sofa south of Hellman Avenue on Del Mar, and at 25 10 Strathmore there was a TV, and also a TV on the other side of the street. Donald Wagner stated that there were bulky items out there, they will get picked up by Fridays. II. PUBLIC HEARINGS A. URGENCY ORDIANCE NO. 837 - AN ORDIANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD EXTENDING ORDINANCE NO. 830 WHICH IMPOSED A MORATORIUM ON THE ISSUANCE OF ANY PERMITS OR ENTITLEMENTS FOR BUSINESSES OFFERING MASSAGE SERVICES - ADOPT Mr. Crowe read the staff report. Mayor Clark then opened the Public Hearing for those in the audience wishing to speak in favor or opposition of this item. Mr. Nunez, 2702 Del Mar Avenue asked if we were extending the moratorium? Mayor Clark responded yes. CCMIN:10-12-04 Page d2 r • Daniel Deng, stated that he was afraid to live next to a massage parlor. He continued that the City does not have a code in place and that there are a lot of home based massage parlors in the area. Other cities have vice-bureau or undercover cops with bi-lingual officers. He stated that there are 200 parlors/home based massage businesses listed in Chinese newspapers. Councilman Taylor asked how many are in Rosemead? Mr. Deng stated that he cannot tell as they only list phone numbers. Mr. Crowe stated that this item would address massage related businesses in the City, and Mr. Deng is referring to home based services and prostitution. He stated that penal law covers these crimes. He also stated that the City does not allow businesses in a residential zone. He went on to say that the City's Code Enforcement Department have brought newspaper articles on massage to the attention of the City in the past and that the Sheriffs Department have bi-lingual officers. Mayor Imperial stated that Mr. Deng should report these addresses to the Sheriffs Department. Mr. Deng stated that Monterey Park and Alhambra prohibits home based businesses and that the City can and should do something. Councilman Taylor stated that Mr. Deng mentioned Monterey Park and Alhambra. If her has seen their codes, he should leave a copy with staff. Mayor Clark stated that Mr. Deng said Monterey Park, Alhambra, and San Gabriel have their own vice squad. She stated that the City contracts with the Sheriffs Department and that they have a vice squad. Lt. Wallace stated that the Sheriff s Department just made an arrest from a citizen who reported reading the service in the Chinese newspaper. He also stated that this was a transitory crime and it moves around. Councilman Taylor asked if there are any other incidents of prostitution going on in Rosemead? Mr. Deng stated that law enforcement needs to read the Chinese newspapers. Mayor Clark closed the Public Hearing. MOTION BY COUNCILMAN ALARCON, SEC that the Council adopt Ordinance No. 837. RESOLUTION NO. 2004-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND EMANDS IN THE SUM OF $326,795.48 NUMBERED 46794 THROUGH 46913 MOTION BY MAYOR PRO TEM IMPERIAL, SECONDED BY COUNCILMAN ALARCON that the Council adopt Resolution No. 2004-43. CONSENT CALENDAR (Item CC-A was pulled for discussion purposes) CC-B APPROVAL OF PLANS AND SPECIFICATIONS FOR THE ROSEMEAD PUBLIC SAFETY CENTER AT ZAPOPAN PARK CC-C APPROVAL OF UNDERTAKING AGREEMENT FOR TRACT MAP 60712-3442 IVAR AVENUE CC-D ASSIGNMENT OF SIGNAL MAINTENANCE INC., CONTRACT TO REPUBLIC ELECTRIC MOTION BY COUNCILMAN TAYLOR, SECONDED BY MAYOR PRO TEM IMPERIAL that the Council approve the aforementioned items on the Consent Calendar. CCMIN:10-12-04 Page #4 0 L.J CC-A RESOLUTION NO. 2004-44 - SUPPORTING PROPOSITION 1A CALIFORNIANS TO PROTECT LOCAL TAXPAYERS AND PUBLIC SAFETY Councilman Taylor stated that over the weekend he was going over 165 pages of the voter information and there was no information on Proposition 65 and that he did not receive any information on Proposition IA until this afternoon in his mail. Therefore, he did not want to vote on this matter at this time and that he was abstaining. MOTION BY COUNCILMAN ALARCON, SECONDED BY COUNCILMAN VASQUEZ that the Council adopt Resolution No. 2004-44. Vote resulted: Yes: Alarcon, Clark, Imperial, Vasquez No: None Absent: None Abstain: Taylor The Mayor declared said motion duly carried and so ordered. V. MATTERS FOR DISCUSSION AND ACTION - None VI. STATUS REPORTS - None VII. MATTERS FROM OFFICALS Councilman Taylor addressed the water well projects in the City and asked if maps could be provided of where the work is being done in this area. Mr. Rukavina stated that he would meet with San Gabriel Valley Water Conservation District to get more information. VIII. ORAL COMMUNICATION FROM THE AUDIENCE Linda Jeng, Arcadia, stated that on October 4, 2004, the House of Representatives passed Resolution 304, to cease oppression of Falun Gong in the USA and China. Falum Gong is an Asian mind body practice and cannot be practiced in China. Councilman Taylor referred to incidents in San Francisco and New York and asked if she had documentation to give to staff. Mayor Clark stated that the she wrote a proclamation about 8 years ago in favor of Falun Gong and that she received a letter from China telling her she should not have done that. CCMIN:10-12-04 Page #5 0 Mr. Cazares stated that the cause of the water pollution was JPL/Aero jet, and the wells are EPA, with Martelli being the contractor. He also stated that that was the newsletters should be multi-lingual regarding laws, bulky items, prostitution. He also thanked Council and the Mayor for graffiti removal on Garvey Avenue and their quick response time. Mr. Cazares also thanked Sheriff s Department for their presence on Garvey Avenue. Mr. Crowe stated that the City had a graffiti sting operation last night. Anthony Wu, BOA Architects, thanked the Council for approving their project. IX. ADJOURNMENT There being no further action to be taken at this time, the meeting was adjourned. The next regular meeting will be held on Tuesday, October 26, 2004.
