THE'CITY COUNCIL OF THE CITY OF ROSEMEAD DOES'RESOLVE: WHEREAS','the City:desires'that there be constructed within Rosemead Redevelopment'Project Area No. I and'in the neighborhood of 'which the project is. apart, certain public improvements.' and. facilities. as described on Attachment.A hereof," and.the construction of"which'will 'improve the quality 'of streets, ',traffic flow, pedestrian safety,•.sewer_service,.fire•protection and flood control service for the project area,, as.well as the 'use 'and' aesthetic quality-.9f 'the entire project area and the' immediate=neighborhood 'of`which the project is a-part;' and WHEREAS, the City.Council.'has received'and'reviewed ' RRA Resolution 78-4, the Exhibits A; Band O incorporated 'by reference•herein;.which describe the location, nature-, costs, and benefits•of•each individual improvement.,-,'and', has considered ' the improvements,: costs and benefits at,its meeting of January 10,, .1978; NOW,,THEREFORE, BE .IT.RES.OLVED•THAT, SECTION 1: The City ,,Council hereby finds and deter- mines-, pursuant to Health and-`Safety Code Section 33445, that :the 'improvements, facilities•;'`and structures..described in Attachment A to RRA Resolution'_7f8'-4, all being within the . Rosemead,-Redevelopment Project No': i l;, or the immediate neigh- borhood of which the project is a parts are of benefit to the: Rosemead Redevelopment Project Area No "SECTION,-2 `The,City,Council'hereby finds and deter- mines.that;no•'other,funds.-are'Yeasonably- available for the. . 'improvement and construction of the'facilities,.improvements and structures described in :Attachment A to'RRA Resolution SECTION 3. •The•Findings and Determinations set forth in'Secti6ns71<and-' hereof• arejbased upon the staff report., attached to RRA•Resolut16n•,78'-,4' as.,'Exhibit B, and such other ..'.documents, comments and'information'.as were.received by the City. Council at its meeting' of 'January •10; 1978..`.' All. of said Exhibits, documents; comments and information are incorporated by reference•herein as.if fully.'set-forth. SECTION 4.'. The.City.Council hereby consents to the -:expenditure, of tax increment. funds for=the improvements and purposes'set forth in RRA Resolution 78-4.. ' 'y i s n r T )Al itemized improvements or portions of any improvements as described in Exhibit A to RRA Resolution,' 78-4, are severable one from another; and if any itemized improvement or portion of ari improvement-shall be declared.;void' " or otherwise invalid, such determination shall affect only the individual improvement; and the remaining improvements,~iandz btheroprovisions4of';RRA Resolut•ion-,78-4, _shall.be unaffected thereby. SECTION 6.• The Mayor' is hereby authorized to sign that certain AGREEMENT FOR COOPERATION BETWEEN THE-CITY OF ROSEMEAD AND THE.ROSEMEAD REDEVELOPMENT-AGENCY, which Agreement is attached:to RRA Resolution;No.-78-4 as Exhibit C, and the . Executive Director of the Agency is hereby authorized to take all necessary steps to;bring the enumerated improvements into being. PASSED, APPROVED and ADOPTED this 24 day of January 1978. Y CITY OF ROSEMEAD PLANNED USE OF EXISTING SURPLUS FUNDS AS OF JANUARY 7, 1978 The City needs approximately $750,000 to provide for cash flow needs on an annual basis. The City must make expenditures at a point in time earlier in the year than it.can reasonably expect revenues to be available. Providing for cash flow requirements is a common municipal practice, in fact some cities issue "Tax Anticipation Notes" for this purpose. Utilizing reserves is a less expensive way to provide for this need. The City needs $829,905 to provide for budgeted 1977-1978 expen- ditures.: The City needs an estimated $250,000 to provide for an Insurance Reserve Fund Under a Joint Powers Authority Agreement for liability insurance, effective in early 1978, the City will henceforth be self-insured for an unlimited number of claims up to $10,000. Claims in the amounts between $10,000 and $500,.000, plus a premium for excess coverage over $500,000 per claim will be paid by the Authority, and that cost will subsequently be allocated back to the member cities. Should~the_Authority be required to pay out claims in any one year in excess of accumulated Authority reserves, that excess will also be allocated back to the member cities. Because this is a new program, and because of the recent large increases in the cost of liability suites, a policy of providing a fund for such future costs appears to be prudent. The City plans to utilize any balance remaining after the above allocations, an estimated $300,000, to.provide for future Capital improvements, such as land and buildings. There has been discussion regarding the need for a future Community Center and a Social Services Center. Such projects would exceed $1,000,000 in cost, and therefore, it will be necessary to accumulate these funds over several years. THIRD'-AGREEMENT FOR COOPERATION BETWEEN THE CITY OF ROSEMEAD AND THE ROSEMEAD REDEVELOPMENT AGENCY THIS AGREEMENT is entered into this day of January, 1978, by and between the City of Rosemead, California ("CITY"), and the Rosemead Redevelopment Agency "AGENCY"). WHEREAS, pursuant to Health and Safety Code § 33000 et seq., the City Council of the City of Rosemead established the Rosemead Redevelopment Agency under authority of the California Community Redevelopment Law; and WHEREAS, CITY and AGENCY have a common interest in and wish to facilitate redevelopment within the City and to provide for the cooperation of CITY and AGENCY in carrying out redevelopment activities; and WHEREAS, CITY and AGENCY both desire to construct the public improvements and facilities set forth on Attachment "A" hereof; NOW, THEREFORE, the parties agree: Section 1. Each party shall have access to the services and facilities of the other party and its staff. The City's Planning Commission shall also cooperate with the Agency in providing for redevelopment activities within the City. Section 2. AGENCY shall supply to CITY such information and reports as from time to time the City may require. Section 3. CITY will assist AGENCY in the planning, financing, acquisition, construction, and maintenance or operation of redevelopment activities undertaken by the AGENCY within CITY in accordance with applicable state and federal law. EXHIBIT C • -2- 0 Section 4. CITY and AGENCY shall jointly undertake the planning, acquisition, design and construction of the improvements set forth in Attachment "A" hereto and approved by RRA Resolution No. 78-4 and City Council Resolution 78-2. City shall be the "Lead Agency", as defined in Public Resources Code § 21067 for the planning and development of such improve- ments and facilities. Section 5. AGENCY shall pay to CITY, by way of advance or reimbursement, by direct or indirect payment, the cost of developing all of the improvements described on Attachment "A".hereof, Such payments shall be made pursuant to the findings in RRA Resolution No. 78-4 and Health and Safety Code § 33445. Such payment shall be primarily from tax allocation funds, but is not limited to such source. All payments to CITY or for its benefit pursuant to this Agreement shall not exceed the sum of $8,890;780.00. Section 6. CITY may undertake the project improvements set forth on Attachment "A" hereof without further approval from Agency and shall be paid, upon demand, for each itemized project upon completion, or, at CITY's election, upon commence- ment of design for each itemized project. Section 7. Each of the itemized improvements set forth on Attachment "A" is severable one from another. If any one itemized improvement is declared null, void or otherwise illegal, the remaining improvements shall remain valid and this Agreement shall be modified only to the extent that the voided improvement shall be deleted.
