RESOLUTION NO. 78-45
A RESOLUTION OF THE CITY OF ROSEMEAD, CALIFORNIA
CALLING A SPECIAL ELECTION TO BE HELD ON THE 7TH
DAY OF NOVEMBER, 1978 PERTAINING TO THE ANNEXATION
OF TERRITORY KNOWN AS "ANNEXATION AREA NO. 46" OF
CITY OF ROSEMEAD .
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That the City Council finds and determines:
A. By Resolution No. 78-'39 the City Council of the City
of Rosemead declared its intention to call a special
election to be held on the 7th day of November, 1978,
in certain inhabited territory contiguous to said
City proposed to be annexed to the City, for the pur-
pose of submitting to the qualified electors residing
in said territory the question whether or not the
territory shall be annexed to the City; and
B. A copy of said Resolution was published as required
by law; and
C. A hearing was held pursuant to Section 35117 of the
Government Code for receipt and consideration of
written requests for exlusion of property from the
proposed annexation filed prior to the time of said
hearing and for hearing any and all interested per-
sons appearing at said hearing; and
D. 'All proceedings have been had in accordance with said
Resolution and the Annexation Act of 1913, reference
thereto hereby being made for further particulars;
and
E. The territory proposed to be annexed is described
in Exhibit "A" attached hereto and incorporated
herein by this reference as though set forth in
full. hereat.
SECTION 2. A special election is hereby called to be held
on the 7th day of November, 1978, in the terri-
tory hereinafter described and proposed to be
annexed to the City of Rosemead, for the purpose
of submitting to the qualified electors residing
in said territory the question whether or not
such territory shall be annexed to, incorporated
in, made a part of the City of Rosemead, and
whether or not the property in said territory
shall, after such annexation, be subject to tax-
ation, equally with the property within the City
of Rosemead.

3. For the purpose of holding said election there shall
be one (1) voting precinct comprising all of said
territory. Whereas there are no more than 300 per-
..sons registered to vote in said precinct, pursuant to
sections 1005 and 22032 of the Election Code of the
State of California, there shall be no polling place
in the precinct for said election. The City Clerk
shall mail an absent voter ballot to each registered
voter, together with a statement that there will be no
polling place in the precinct for the election, and
if the voter desires to vote at the election, he shall
vote and return his absent voter ballot by the close
of polls on election day or vote at the office of the
City Clerk on election day.
The City Clerk's Office is located in.the Rosemead City
Hall, 8838 E. Valley Boulevard, Rosemead, California,
and shall open between the hours of 7:00 a. m. and 4:00
p. m., for any voter who has not voted on an absent
voter ballot.
4. Upon the ballots to be used at said election there shall
be printed the words:
SHALL THE TERRITORY DESCRIBED AS "ANNEXATION NO, 46 OF
THE CITY OF ROSEMEAD, AND THE PROPERTY IN.SUCH TERRITORY
BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY
WITH THE PROPERTY''WITHIN THE CITY OF ROSEMEAD?
Opposite these words there shall be printed the words
"YES'.' and "NO", and to the right of each of these last
two words there shall be a voting square. If an elec-
tor shall stamp a cross (X) in the voting square after
the printed word "YES", the vote of such elector shall
be counted in favor of the annexation of said territory
to the City of Rosemead; and if an elector shall stamp
a cross (X) in the voting square after the printed word
"NO", the vote of such elector shall be counted against
such annexation.
On all particulars not herein recited said"'election
shall be held in conformity, as near as may be, with
the laws of the State of California concerning general
elections and with said Annexation Act'of 1913.
5. The City Clerk of the City of Rosemead, California
shall publish a Notice of said special election as
required by the Annexation Act of 1913, at least
.,once a week for the four (4) weeks prior to the date
of the election on November 7, 1978, in the Sun Inde-
pendent a newspaper of general circulation, printed
and published outside of the City of Rosemead.
6. This Resolution shall take effect upon its publication.
7. The City Clerk of the City of Rosemead California,
shall certify to the adoption of this Resolution and
cause the same to be published once in the San Gabriel
Tribune.
PASSED AND ADOPTED this 22nd day of August, 1978.
