CC - 1983-10 - Street Superintendents Report0 16 RESOLUTION NO. 83-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAJ~, CALIFORNIA, CONFIRMING THE STREET SUPERINTENDENT'S REPORT AND ASSESSMENTS THEREIN WHEREAS, the City Council has reviewed the Streets and Highways Code, 1911 Improvement Act, Chapter 27, Section 5895 and, WHEREAS, the City Council at its regular meeting of July b, 1980, adopted the following policy statement for payment of assessments in annual installments, to wit; "All assessments shall be due and payable within the fiscal year in which the assessment is levied. Installment payment, not to exceed five annual installments, may be arranged for those owners of property who request installment payment of an individual assess- ment and who demonstrate that substantial financial hardship will re- sult from the imposition of a one year assessment. For purposes of this policy, substantial economic hardship shall be defined as a material reduction in the standard of living for the owner of the property and his family, if any." WHEREAS, the assessments are hereby confirmed for properties listed in Exhibit "A" , and WHEREAS, the assessment is hereby confirmed for the property listed in Exhibit "B" , establishing an installment payment plan. SECTION 1. In accordance with Section 5883 of the Streets and Highways Code, the report of the Street Superintendent with respect to the Construction of Improvements and the proposed assessments set forth therein are hereby confirmed. SECTION 2. In the event that said assessments are not paid within five (5) days from the date hereof, the Street Superintendent is directed to record a Notice of Lien in the office of the County Recorder and turn over a notice of lien to the Tax Collector for delivery to the County Auditor for entry on the County Assessment books opposite descriptions of the parcels concerned. PASSED, APPROVED AND ADOPTED, this 22nd day of March, 1983.
