CC - 1983-11 - Approval of Tract Map 38970 at 4747-4751 IvarRESOLUTION NO. 83-11 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL OF TENTATIVE TRACT #38970. (A SEVEN LOT SUBDIVISION AT 8858 GRAND AVENUE AND 4747-4751 IVAR AVENUE) THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council does hereby find and determine that an application was duly filed by Shawmar Development requesting a seven-lot subdivision on property located at 8858 Grand Avenue and 4747-4751 Ivar Avenue, Rosemead, California; or specifically known as : Lots 1, 6, & 7 inclusive, Tract 17414, in the County of Los Angeles, State of California, as per map recorded in Book 494 Page 48 of maps, in the office of the County Recorder of said County. and that a Public Hearing was duly set for March 22, 1983 at 8:00 p. m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of time, date, place and purpose of the aforesaid hearing was given according to law, and that a public hearing was duly conducted at the afore- mentioned time and place. WHEREAS, the City Council has considered the sub-division request and determines that the following findings exist: 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the proposed subdivision and improvements are consistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type of develop- ment. 4. The site is suited for the proposed density of the devel- opment. 5. The design of the subdivision will not conflict with public easements. 6. The design and proposed improvements of the subdivision will have no adverse environmental effects on fish, wild- life or their habitat, or cause any public health problems. A Negative Declaration has been prepared in compliance with Rosemead Resolution No. 79-77, CEAA, and the Guide- lines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in violation of existing requirements as prescribed by the California Regional Water Board. NOW, THEREFORE, the City Council of the City of Rosemead does hereby conditionally approve the subdivision of that parcel of land described herein subject to those conditions contained within Exhibit "A", attached hereto. The City Clerk shall attest to the adoption of the Resolution and transmit copies to the applicant and City Planning Department. APPROVED AND ADOPTED this 26th day of April , 1983. ATTEST: ayor of the City of Ro emead City /Clerk EXHIBIT "A" • TENTATIVE TRACT NO. 38970 1. That the applicant shall comply with all the conditions as set forth in the City Engineer's Report dated February 8, 1983, (Exhibit "B"), and to include the requirements as set forth by the Fire Department. 2. That the street shall be constructed to the City of RDsemead standard of 6" concrete within one (1) year from the final tract approval. 3. That a covenant shall be prepared by the applicant for review and approval of the City Attorney, assuring that the private street shall be continually main tained and that cost associated with such maintenance shall be equally shared by all future property owners within the division so effected, specifically proposed lots 3, 4, 5, and 6, and to include the following provision: a. The City shall have the right to cause such repair to be accomplished and to place liens on the involved properties, if in the estimation of the City Engineer, the subject private street; has reached a state of disrepair which renders it a hazard, unsightly, or a public nuisance; and that the property owners involved have failed to act within a reasonable period, (thirty days) after notification. 4. one private street lights shall be added to each lot to be served by the private street and such lights shall be reviewed and approved by the Director of Planning prior to the recordation of the map. 5. That a six (6) foot block wall, as measured from adjacent property line, shall be constructed around the property peripheral boundaries, except for those portions which abut the public right-of-way where a four. (4) foot decorative wall/fence shall be constructed, utilizing steel supports set in concrete. Said improvements shall occur within one (1) year from final tract map approval. 6. All improvements proposed within the subdivision shall be installed prior to recordation of the final map or estimated improvement cost- shall be established by the City Engineer and such improvements bonded for. If bonds are accepted such work shall commence within one (1) year from recordation of the final map. Failure to do so shall cause the City to authorize installation of said improve- ments utilizing the bonds posted by the applicant. 7. All the existing houses, excluding the structure on lot no. 7, and detached garages are to be demolished prior to the recordation of the parcel map. 8. That all utilities are to be underground. 9• That the existing trees shall be saved, where possible, and identified for the approval of the Director of Planning prior to recordation of the map. 10. That all work and improvements within the public right-of-way and within the private street shall be reviewed, inspected and subject to approval of the City Engineer. * REVISED AND APPFDVM BY PLANNING COM USSION - FEBRUARY 23, 1983.
