CC - 1983-20 - Agreement between Redevelopment Agency and CityRESOLUTION NO. 83-20 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD MAKING CERTAIN FINDINGS AND DETERMINATIONS WITH RESPECT TO CERTAIN CAPITAL IMPROVEMENT PROJECTS FOR THE BENEFIT OF PROJECT AREA NO. 1 AND AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR COOPERATION BETWEEN THE CITY OF ROSEMEAD AND THE ROSEMEAD REDEVELOPMENT AGENCY THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS FOLLOWS: Section 1. The City Council hereby finds, determines and declares: a. The capital improvement projects as set forth in Exhibit "A" attached hereto and incorporated herein by this reference, are of benefit to Project Area No. 1 or the immediate neighborhood of Project Area No. 1 for the reasons stated in said Exhibit. b. That there are no other reasonable means of financing such buildings, facilities, structures, or other improvements available to the community. Although the City has a General Fund surplus, the uncertainty of revenues due to the State of California's fiscal condi- tion, mitigates against the depletion of the existing reserve until such time as municipal revenue sources are more stable and predictable. c. That implementation of each of the capital improvement projects is subject to review and conditions pursuant to the California Environmental Quality Act. d. The City Council hereby consents to the payment by the Rosemead Redevelopment Agency of the costs of installation and construction of the capital improvement projects listed herein. Section 2. The Mayor is hereby authorized to execute the Cooperation Agreement between the City of Rosemead and the Rosemead Redevelopment Agency, and the City Manager is authorized to take all necessary steps to implement the Agreement. 0 0 Section 3. MAYOR ATTEST: CITY CLERK 0 0 PROJECT NO. 1 - Underground Utility District on Carvey Avenue A. Burton/East City Limits B. Pine/West City Limits 1. The Project The project will conclude the undergrounding of all utility services along Garvey Avenue which serves as the central east/west corridor through Project Area No. 1. 2. Benefit to Project Area No. 1 Approximately 42 percent of the total improvements are contained within the Project Area No. 1. Garvey Avenue is the primary east/west highway through the Project Area. The improvements will assure uniformity along Garvey Avenue in removing existing overhead utilities. This project will remove any potential hazards from the public right-of-way. Also, the project will enhance the east/west corridor, promoting its potential for commercial development. $540,750 $733,500 PROJECT NO. 2 - Graves Avenue 1. The Project The project will include the widening and reconstruction of the street, installation of curbs and gutters and the construction of retaining walls where necessary. 2. Benefit to Project Area No. 1 Graves is designated as a truck route which services the commercial/ industrial portions of the Project Area. The street has potentially dangerous conditions given its variations in street width and driving surface. Also, its use as a collector route into the Project Area facilitates the need for a well-defined street including curbs and gutters. Graves Avenue is also used as a commuter route to and from the southerly portion of the Project Area. Its improvement will accommodate increasing traffic volumes providing safer access to the Project Area. This, in turn, will allow for more intensive development to occur. The project will also promote safety for pedestrians utilizing Graves to reach San Gabriel Boulevard, which is a major commercial/industrial area within Project Area No. 1. $1,600,000 EXHIBIT A • • AGREEMENT FOR COOPERATION BETWEEN THE CITY OF ROSEMEAD AND THE ROSEMEAD REDEVELOPMENT AGENCY FOR VARIOUS CAPITAL IMPROVEMENT PROJECTS THIS AGREEMENT is entered into this 10th day of May, 1983, by and between the CITY OF ROSEMEAD-hereinafter "CITY") and the ROSEMEAD REDEVEVLOPMENT AGENCY (hereinafter "AGENCY"). WHEREAS, pursuant to Health and Safety Code §33000 et seq., the City Council of the City of Rosemead established the Rosemead Redevelopment Agency under authority of the California Community Redevelopment Law; and WHEREAS, pursuant to Health and Safety Code §33000 et seq., the City Council of the City of Rosemead, by enactment of Ordinance No. 340, on June 27, 1972, has established the Rosemead Redevelopment Project No. 1; and WHEREAS, CITY and AGENCY have a common interest in and wish to facilitate redevelopment within the City and to provide for the cooperation of CITY and AGENCY in carrying out redevelopment activities; and WHEREAS, CITY and AGENCY both desire to construct the public improvements and facilities described herein. NOW, THEREFORE, the parties agree: Section 1. Each party shall have access to the services and facilities of the other party and its staff. Each party shall also cooperate with the other in providing for redevelopment activities within the City. Section 2. AGENCY shall supply to CITY such informa- tion and reports as from time to time the City may require. Section 3. CITY will assist AGENCY in the planning, financing, acquisition, construction and maintenance or operation of redevelopment activities undertaken by the AGENCY within CITY in accordance with applicable state and federal law. Section 4. CITY and AGENCY shall jointly undertake the planning, acquisition, design and construction of the capital improvements described on Exhibit "A" attached hereto and incorporated herein by this reference. CITY shall be the "Lead Agency", as defined in Public Resources Code §21067 for the environmental review, planning and development of such capital improvement projects. • • Section 5. AGENCY shall pay to CITY, by way of advance or reimbursement, the cost of the capital improvement projects listed on Exhibit "A" that are actually undertaken. Such payments shall be made according to findings made pursuant to Section 33445 of the Health and Safety Code by the Rosemead Redevelopment Agency Board and Rosemead City Council. The total AGENCY obligation to CITY, if all projects are undertaken, shall not exceed %2,874,250 Section 6. CITY may undertake the capital improvement projects sets forth herein without further approval from AGENCY.
