A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD APPROVING CONDITIONAL USE PERMIT
83-268 FOR THE SALE OF BEER AND WINE AT 9423
VALLEY BOULEVARD (FARM FRESH PRODUCE MARKET)
THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS
Section 1. The City Council finds, determines, and
(a) That an application for a conditional use
permit to allow the sale of beer and wine at 9423 Valley
Boulevard was filed by Min Seong Kang; and
(b) That the Planning Commission, after a duly
noticed public hearing, denied the permit for the
grounds set forth in its Resolution No. 83-21; and
(c) That the applicant timely filed an appeal to
the Planning Commission's decision denying the condi-
tional use permit; and
(d) That the City Council conducted a public
hearing on the appeal on September 27, 1983 and October
11, 1983.
Section 2. The City Council hereby upholds the appeal
and grants the conditional use permit subject to the conditions
contained herein.
Section 3. The City Council hereby finds that pursuant
to Section 9180 of the Rosemead Zoning Code the following findings
are present thereby justifying the granting of a conditional use
permit.
1. The project is in harmony with the elements and
objectives of the General Plan.
2. The project will not be detrimental to the surrounding
properties.
3. The project is desirable to the public convenience.
Section 4. On the basis of evaluation, this project has
been determined to be subject to a class 9 categorical exemption
under the provisions of the California Environmental Quality Act.
Section 5. The conditional use permit is granted subject
to the following conditions:
(a) That the sale of beer and wine be limited to
the hours of 8 a.m. through 8 p.m. as the applicant
represented in his application.
(b) That the permit is not transferable to future
owners or occupants.
(c) That the permit is granted for a period of one
(1) year from the date of the delivery of the affidavit
of acceptance of conditions to the Planning Director. A
public hearing will be set before the Planning Commis-
sion to consider renewal of the permit, if requested by
the applicant.
(d) That the property be maintained in accordance
with Section 5405-5415 of the Rosemead Municipal Code
relative to trash, litter and debris, which includes a
trash enclosure with prior approval of the Planning Director.
(e) All signs shall be in accordance with Section
9900-9907 of the Rosemead Municipal Code.
