CC - 1982-16 - Agreement between Redevelopment Agency and CityRESOLUTION NO. 82-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD MAKING CERTAIN FINDINGS AND DETERMINATIONS WITH RESPECT TO THE INSTALLATION OF MISCELLANEOUS STREET IMPROVEMENTS FOR FISCAL YEAR 1981-82, FOR THE BENEFIT OF REDEVELOPMENT PROJECT AREA NO. 1, AND AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR COOPERATION BETWEEN THE CITY OF ROSEMEAD AND THE REDEVELOPMENT AGENCY. Pine Street (Garvey/Newmark) Delta Avenue (East Side, Rush to south City Boundary) NOW, THEREFORE, the Rosemead City Council resolves as follows: SECTION 1. The Council hereby finds, determines, and declares as WHEREAS, the City Council and the Redevelopment Agency desire that the certain improvements be installed, consisting of installation of curb, gutter, and pavement for the following streets: follows: (a) The payment by the Rosemead Redevelopment Agency of the costs of the improvements as set forth in the Cooperation Agreement attached hereto and incorporated herein by this reference, is of benefit to Project Area No. 1. (b) Pine Street, and Delta Avenue are streets serving the Commercial/Industrial District. (c) The streets designated for upgrading are heavily travelled by vehicular, as well as pedestrian traffic which serve the commercial/industrial portions of the project area. (d) The subject streets have poor driving surface and/or variation in street width. The reconstruction and repair of the subject streets will provide for safe travel for vehicular traffic. (e) Because each of the subject streets are currently used as commuter routes within the project area, the improvements will provide safer access within the project area. This, in turn, will allow for more intensive development to occur and reduce danger to motorists and pedestrians travelling in the project area. SECTION 2. The City Council hereby determines that there is no other reasonable means of financing said improvements available to the City. 0 0 SECTION 3. The Mayor of the City of Rosemead is hereby authorized to execute the Cooperation Agreement, attached herewith, between the City of Rosemead and the Rosemead Redevelopment Agency, and the City Manager is authorized to take all necessary steps to implement the Agreement. ATTEST: MAYOR, ROSEMEAD CITY COUNCII 17-41,14 n A SECRETARY 0 AGREEMENT FOR COOPERATION BETWEEN THE CITY OF ROSEMEAD AND THE ROSEMEAD REDEVELOPMENT AGENCY MISCELLANEOUS STREET IMPROVEMENTS FOR FISCAL YEAR 1981-82 THIS AGREEMENT is entered into this 20th day of April 1982, by and between the City of Rosemead, California, ("CITY") and the Rosemead Redevelopment Agency ("AGENCY"). WHEREAS, pursuant to Health and Safety Code §33000 et seq., the City Council of the City of Rosemead established the Rosemead Redevelopment Agency under authority of the California Community Redevelopment Law; and WHEREAS, pursuant to Health and Safety Code 833000 et seq., the City Council of the City of Rosemead, by enactment of ordinance No. 340, on June 27, 1972, has established the Rosemead Redevelopment Project No. 1; and WHEREAS, CITY and AGENCY have a common interest in and wish to facilitate redevelopment within the City and to provide for the cooperation of CITY and AGENCY in carrying out redevelopment activities; and WHEREAS, CITY and AGENCY both desire to construct the public improvements and facilities described herein. NOW, THEREFORE, the parties agree: Section 1. Each party shall have access to the services and facilities of the other party and its staff. Each party shall also cooperate with the other in providing for redevelopment activities within the City. Section 2. AGENCY shall supply to CITY such information and reports as from time to time the City may require. Section 3. CITY will assist AGENCY in the planning, financing, acquisition, construction and maintenance or operation of redevelopment activities undertaken by the AGENCY within CITY in accordance with applicable State and Federal law. Section 4. CITY and AGENCY shall jointly undertake the planning, acquisition, design and construction of the improvements described as the installation of miscellaneous street improvements pursuant to Rosemead Redevelopment Agency Resolution No. 82-4, and City Council Resolution No. 82-16. City shall be the "Lead Agency", as defined in Public Resources Code §21067 for the planning and development of such improvements and facilities. Section 5. AGENCY shall pay to CITY, by way of advance or reimbursement, by direct or indirect payment, the cost of developing all of the street improvements described as miscellaneous street improvements for fiscal year 1981-82. Such payments shall be made pursuant to the findings in the RRA Resolution No. 82-4 and Health and Safety Code §33445. Such payment shall be from existing Agency funds. All payment to CITY or for its benefit pursuant to this Agreement shall not exceed the sum of $80,000. • • Section 6. CITY may undertake the project improvements set forth herein without further approval from Agency and shall be paid, upon demand, for each itemized project upon completion, or at such time as may be convenient to CITY.
