CC - 1982-21 - Aproving Tract Map 42132 at 3853 Muscatel Ave• L J RESOLUTION NO. 82-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD COnMTTIONALLY APPROVING TENTATIVE TRACT NO. 42132 (3853 MUSCATEL AVENUE1 THE CITY COU"CIL OF TILE CITY OF ROSEMEAT? DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine that an ao_ nlication was duly filed by u?inifred Saunders requesting a one-lot subdivision into seven separate narcels on property located at 3853 Muscatel Avenue; or more specifically known as: Lots 6 and 7, Tract No. 3360, 3M.B. 73-1, except the northerly 50 reet of the easterly 150 feet of Lot 6; and. that a public hearing was scheduled for January 26, 1982, and subsenuently continued to March 23, 1982, at 8:00 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California; and that notice of the time, date, place and purpose of the aforesaid hearing was given according to law; and that a public hearing was duly conducted at the aforementioned time and p].ace. SECTION 2. The City Council further finds that this sub- division is in conformance with the Land Use Element of the General ?Ian; a. The proposed map is consistent with the General Plan of th.e City of Rosemead. There is no specific elan. b. The design of the proposed subdivision and improvements are consistent with the applicable General Plan. There is no specific clan. C. The site is physically suitable for the type of develop- tnent. d.. The desiq_n of the subdivision will not conflict with public easements. e. The design and proposed improvements of the subdivision will have no adverse effect on fish, wildlife or their habitat, or cause anv public health problems. A Negative Declaration has been prepared in compliance with Rosemead Resolution 79-77, CEQA, and the guidelines for the implementation of CEQA. f. Discharge of wastes from the proposed subdivision will not result in violation of existing requirements as prescribed by the California Regional T4ater Board. SECTION 3. Tentative Tract 42132 is hereby approved subject to the conditions listed on Exhibit "A", attached hereto and incorporated herein by this reference. SECTION 4. The Citv Clerk shall certify to the adoption of this resolution. That the applicant shall comply with all the conditions as set forth in the City Engineer's report dated September 4, 1981, and to include the requirements as set forth by the Fire Depart- ment. 2. That the street shall be constructed in accordance with the approved tentative tract , and shall include curb and gutter, within one (1) year from the final tract auoroval. 3. That a covenant shall be prepared by the applicant for review and approval of the City Attorney, assurinq that the drainage easement shall be continually maintained and that cost associated with such maintenance shall be equally shared by all future property owners within the division so effected, and to in- clude the following provision: a. The City shall have the right to cause such repair to be accomplished and to place liens on the involved properties if, in the estimation of the City Engineer, the subject drainage device has reached a state of disrepair which renders it a hazard, unsightly, or a public nusiance. 4. One (1) street light shall be added and. comply with City of Rosemead lighting standards. 5. That a six foot (61) block wall, as measured from adjacent property, shall be constructed around the property peripheral boundaries, except for those portions which abut the public right-of-way where a four foot (4') decorative wall/fence shall be constructed, utilizing steel supports set in concrete. Said improvements shall occur within one (1) year from final tract map approval. 6. The drainage of Lots 1, 2, 3, and 4 shall drain to Muscatel by utilization of a drainage device, (i.e., swale constructed as part of the block wall footing), and shall be required to be installed per the City Engineer's direction and ultimate approval, prior to acceptance of the final tract map. 7. All improvements proposed within the subdivision shall be installed prior to recordation of the final map or estimated improvement cost shall be established by the City Engineer, and such improvements bonded for. If bonds are accepted, such work shall commence within one (1) year from recordation of the final map. Failure to do so shall cause the City to authorize installation of said improvements utilizing the bonds posted by the applicant. Q. The note on the original tract map proposing natural drainage for Lots 1 through 4 shall be erased or permanently removed on the original tract map. The proposed modified cul-de-sac design, Figure "C shall be used for Guess Street, in and adjacent to Lot 5. 10. The developer of Tract No. 42132 be required to prepare the necessary legal documents for the dedication and recordation of the cul-de-sac street to the City, in a form acceptable to the City Attorney and the City Engineer. 11. The developer of Tract No. 42132 be required to prepare improvement plans for the construction of said cul-de-sac, including driveways. 0 0 Exhibit "A" Resolution No. 82-21 Page Two 12. The developer of Tract No. 42132 be required to construct the necessary improvements for said modified cul-de-sac, including driveways. 13. Since sidewalks do not presently exist on Guess Street, the sidewalk improvements for the modified cul-de-sac shall not be installed at this time. 14. Drainage to be approved by the City Engineer.
