CC - 1981-14 - Appriving Pracel map 13844RESOLUTION NO. 81-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING PARCEL MAP 13844 SUBJECT TO SPECI- FIED CONDITIONS FOLLOWS: THE CITY COUNCIL OF THE CITY OF ROSEMEAD RESOLVES AS SECTION 1. The City Council finds, determines and declares as follows: A. The Planning Commission of the City of Rosemead conducted a duly noticed public hearing on Parcel Map 13844. B. After public hearing, the Commission approved Parcel Map 13844 subject to conditions. C. On December 23, 1980, the City Council deter- mined to appeal the decision of the Planning Commission and set the matter for hearing on January 13, 1981. D. On February 24, 1981, the public hearing was concluded and the City Council directed the preparation of a resolution approving the parcel map. E. That the City Council concurs in the finding by the Commission that a Negative Declaration was duly prepared in accordance with C.E.Q.A. and further finds that the project will not have a significant adverse effect on the environment. SECTION 2. Parcel Map 13844 is hereby approved, sub- ject to the following conditions: 1. That the 28 conditions contained within CUP 77-121 be incorporated into the C.C. & R.'s. 2. That dated Decembe C.C. & R.'s. 3. That to the C.C. & approval: the "Policy" statement of use (Stamped 9, 1980) be included within the the following language shall be added R.'s as conditions of the Parcel Map III-D -1- (a) That the self-storage facility shall be limited in use to the expressed request of the property owner and conditions of approval as contained within the City of Rosemead file Conditional Use Permit 77-121 or to such use that may be approved in the future by the City of Rosemead under provisions of authority at that time. 4. That two complete copies of the completed C.C. & R.'s and Association By-Laws be provided to the City Attorney and Planning Director for review and approval (prior to recordation); and, that if the docu- ments do not reflect the intent and spirit of the Planning Commission's approval the matter shall be reopened and reviewed by the Planning Commission. (a) The documents shall clearly establish the perameters and authority of an individual who shall be accountable for enforcement of the by-laws and rules of the Association. (b) The documents shall clearly define the scope and the mechanics of the management structure. 5. That a qualified landscape Architect (State licensed) prepare a design scheme to soften the front building elevation. The plan should not limit the design scope to merely landscaping, but building color, texture and treatment. The Plan shall be reviewed and approved by the Planning Department. 6. That the final recordation of the Parcel Map shall not be certified to Los Angeles County by the Planning Director until such time as he receives either a letter of exemption or compliance regarding this project from the Department of Corporations. 7. Any changes of substance to the C.C. & R's, By-Laws or to the Parcel Map, as applied for, shall be subject to the approval of the City Council prior to recordation. SECTION 3. With respect to Parcel Map 13844, the City Council aces the following findings: -2- LJ 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the proposed subdivision and improvements are consistent with the applicable General Plan. There is no specific plan. 3. The site is physically suitable for the type of development. 4. The site is suited for the proposed density of the development. 5. The design of the subdivision will not conflict with public easements. 6. The design and proposed improvements of the subdivision will have no adverse environmental effects on fish, wildlife or their habitat, or cause any public health problems. A Negative Declaration has been prepared in compliance with Rosemead Regulations, CEQA, and Guidelines for the implementation of CEQA. 7. Discharge of wastes from the proposed subdivision will not result in violation of existing requirements as prescribed by the California Regional Water Board. SECTION 4. The City Clerk shall certify to the adop- tion of this Resolution. 1981. PASSED, APPROVED and ADOPTED this 10th day of March, MAYOR ATTEST: CITY CLERK -3-
