CC - 1981-32 - Joint Resolution of Board of Supervisors with Fire Protection DistrictRESOLUTION NO. 81-32 JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES, THE CITY COUNCIL OF THE CITY OF MONTEBELLO) AND THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUES RESULTING FROM DETACHMENT OF TERRITORY FROM THE CITY OF MONTEBELLO, ANNEXATION OF THE TERRITORY TO THE CITY OF ROSEMEAD, AND ADDITION OF THE TERRITORY TO THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY-- MONTEBELLO HILLS MUNICIPAL REORGANIZATION WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change the governing bodies of all agencies whose service areas or service responsibilities would be altered by such change must determine the amount of property tax revenues to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; but if the affected agency is a special district, the Board of Supervisors must negotiate on behalf of the district; and WHEREAS, the Board of Supervisors of the County of Los Angeles, the City Council of the City of Montebello and the City Council of the City of Rosemead have deter- mined that the amount of property tax revenues to be exchanged between their respective agencies as a result of the detachment of territory from the City of Montebello and the annexation of the territory to the City of Rosemead in connection with the Montebello Hills Reorganization, and the subsequent addition of the territory to the Consolidated Fire Protection District of Los Angeles County in connection therewith, as set forth below. NOW, THEREFORE, BE IT RESOLVED as follows: 1. The negotiated exchange of property tax revenues between the Consolidated Fire Protection District of Los Angeles County, the City of Montebello, and the City of Rosemead resulting from the detachment of territory from the City of Montebello and the annexation of the territory to the City of Rosemead in connection with the Montebello Hills Reorganization, and the addition of the territory to the Consolidated Fire Protection District in connection therewith is approved and accepted. 2. For fiscal years commencing on and after July 1, 1981, all property tax revenue received by the City of Montebello attributable to the territory within the reorganization area, except that revenue accruing to the Community Redevelopment Agency of the City of Montebello pursuant to Health and Safety Code Section 33670, shall be transferred to the Consolidated Fire Protection District of Los Angeles County. 3. This Agreement is subject to the terms and conditions of a separate agreement dated May 26th, 1981 -2- r .d I between the Consolidated Fire Protection District of Los Angeles County and the City of Rosemead. 4. No other transfer of property tax revenues shall be made to or from any other taxing agencies as a result of this reorganization and addition of territory. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the City Council of the City of Montebello and the City Council of the City of Rosemead. MIZE, Executive Officer- Clerk of the Board of Supervisors Deputy -3- 0 9 AGREEMENT FOR PROVISION OF FIRE SERVICES This Agreement, dated May 26th, 19819 is between the Consolidated Fire Protection District of Los Angeles County ("District") and the City of Rosemead ("City") . RECITALS: A. The City Council of the City of Montebello has adopted a resolution making application to the Local Agency Formation Commission of Los Angeles County for detachment of territory from the City of Montebello in annexation of the territory to the City of Rosemead, known as the Montebello Hills Municipal Reorganization. B. Because the City of Rosemead is entirely within the Consolidated Fire Protection District of Los Angeles County, it will be necessary to add the territory in the reorganization to the District. C. The territory within the reorganization is in the Community Redevelopment Agency of the City of Montebello and pursuant to Section 33670 of the Health and Safety Code, any incremental tax growth subsequent to its inclusion therein accrues to the Community Redevelopment Agency of the City of Montebello so long as the agency has indebtedness in carrying out its redevelopment project. r_ D. In light of the Community Redevelopment Agency law it is quite possible that the additioncf the territory to the District could be made without adequate provision for funding the services required. E. City and District desire to make adequate provision for funding of the services required to the District. IT IS THEREFORE AGREED : 1. The Board of Supervisors of the County of Los Angeles as governing board of the District and the City Council of the City of Rosemead as governing board of the City shall take all necessary action to add the territory contained in Montebello Hills Reorganization to the Consolidated Fire Protection District of Los Angeles County. 2. District will provide fire services to the territory to the same level of service as provided within the remainder of the City of Rosemead. 3. To recompense District for any underfunding resulting from the addition of this territory to District, City will pay to District from City funds an amount equal to the difference between the actual property tax revenue received by District attributable to the Montebello Hills Munic- ipal Reorganization territory and the amount of revenue received by both the District and the Community Redevelopment Agency -2- • • to the City of Montebello.attributable to that annexation. 4. Said payment will be made by the City within 30 days after the amount for each fiscal year has been determined by the Auditor-Controller of the County of Los Angeles and transmitted to City.
