CC - 1980-70 - Conditional Approval for Tract Map No. 41087 at 3300-3316 muscatelRESOLUTION NO., 80-7,0' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD GRANTING CONDITIONAL APPROVAL TO TENTATIVE TRACT NO. 41087. (A SIN-LOT SUB- DIVISION). (3300-3316 MUSCATEL AVENUE) THE CITY COUNCIL OF THE CITY OF.ROSEMEAD.DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the-City Council does hereby find and determine that an application was-duly filed by J.H. Hedrick and Company requesting a six-unit subdivision of property located at 3300-3316 Muscatel Avenue, Rosemead, California; or more specifically known as: Lot 117, Tract No. 3706, in the City of Rosemead, as per map recorded in Book 40, Page 39 of Maps, in the Office of the Recorder of Los Angeles County. and that a Public Hearing'.was`duly set for November 10, 1980, at 8:00 p.m., in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California,and that notice of the time, date, place, and purpose of'the aforesaid'hear.ing was given according to law;' and that,.a`public heari:ng'wasdul.y conducted at the afore- mentioned time and place; and,. WHEREAS, the City Council further'finds that this subdivision request is in conformance with~the Land Use Element of the General Plan, and; 1. The proposed map is consistent with the applicable General Plan of the City of Rosemead. There is no specific plan. 2. The design of the proposed subdivision and improvements are consistent with the applicable General Plan. There is no specific plan. 3: The site is physically suited for the proposed density of the development. 4. The site is suited for the proposed density of the develop- ment. 5. The design of the subdivision will not conflict with pub- lic easements. 6. The design and proposed improvements of the subdivision will have,no adverse environmental effects on fish, wildlife or their habitat, or cause any public health problems. A Negative Declaration has been prepared in compliance with Rosemead Resolution 75-28, CEQA', and the guidelines for the implementation of CEQA. 7. Discharge of wastes from.the proposed subdivision will not result,in violation of existing requirements as prescribed by the California Regional Water Board. NOW, THEREFORE, the City Council of the City of Rosemead does hereby conditionally approve the subdivision of that parcel of land described herein subject to the following conditions: 1. That the applicant shall comply with all the conditions as set forth in the County Engineer's Report (dated July 29, 1980) and to include the requirements as set forth by the Fire Department. Resolution 80-. Page Two 2. That the private street-shall.be.constructed to Los Angeles County':Road Department standards and shall include curb and gutter. .3. That, a.. cov,enent 'shall' `.be prepared by .the applicant for review and apprbva-I of the City Attorney, assuring that-the private street shall be continually maintained and that cost associated with such maintenance shall be equally shared by all future property owners within the division, and.to include the fol- lowing provisions: .a. The City shall have the right to cause such repair to be accomplished, and to place liens on the involved properties if in the estimation .of the City Engineer, the subject street-has reached a state of disrepair which renders it.'' a hazard,•unsightly, or a public nuisance; and that the property owners involved have failed to act within a, reasonable period, (thirty days), after notification., 4. All utilities shall be placed underground as per Rosemead City Standards'. The City Clerk shall attest to the adoption of the Resolution and -transmit copies to the applicant and City Planning Department. ADOPTED this 10th day of November 1980.
