CC - Item 4G - Approval of Tract Map No. 610050 TO: HONORABLE MAYOR AND MEMBERS ROSEMEAD CITY COUNCIL i FROM: BILL C WE, CITY MANAGER DATE: DECEMBER 21, 2005 • RE: APPROVAL OF TRACT MAP NO. 61005 - 3313-19 DEL MAR AVENUE Tract Map No. 61005 is being submitted for consideration and approval along with an Undertaking Agreement and Faithful Performance and Labor and Material Bonds to guarantee the construction of driveways, curb and gutter, sidewalk, parkway drains, sewer mainline, water line and survey monuments subsequent to the recordation of the tract map. Easement dedications are granted on the map for public sewer purposes. Also attached for your information is a copy of the tract map and Planning Commission's Conditions of Approval. RECOMMENDATION It is recommended that City Council: 1. Approve Tract Map No. 61005; 2. Approve the undertaking agreement; 3. Accept the sewer easement dedication; and 4. CITY OF ROSEMEAD UNDERTAKING AGREEMENT THIS AGREEMENT made and entered this --f - day of psc~w•1~~✓ , 2005, by and between the CITY OF ROSEMEAD, State of California, acting by and through its City Council, hereinafter referred to as "CITY" and 3313 DEL MAR, LLC (NAME) 650 W. HUNTINGTON DR. #201 ARCADIA, CA 91007 (ADDRESS) hereinafter called the "CONTRACTOR." WITNESSETH: FIRST: The CONTRACTOR, for and in consideration of the approval of the final map of that certain land division known as Tract Map 61005 hereby agrees, at the CONTRACTOR'S own cost and expense to furnish all labor, materials, and equipment necessary to perform and complete, and within twenty-four (24) months from the date of filing of said map, to perform and complete in a good and timely manner, the following work, to wit: Construction of driveways, curb and gutter, sidewalk, parkway drain, sewer line, water line and survey monuments. Said work shall be done to the satisfaction of the City Engineer and shall not be deemed complete until approved and accepted as completed by the City Council of the • • CITY. The estimated cost to do all work and furnish all materials necessary to complete the work is $43,200. SECOND: The CITY shall not nor shall any officer or employee thereof, be liable or responsible for any accident, loss, or damage happening or occurring to the work specified in this agreement prior to the completion and approval of same; nor shall the CITY, nor any officer or employee thereof, be liable for any persons or property injured by reason of the nature of said work, or by reason of the acts or omissions of the CONTRACTOR, his agents, or employees, in performances of said work. All of said liabilities shall be assumed by the CONTRACTOR. The CONTRACTOR further agrees to protect and hold harmless the CITY, its officers, and employees, in performance of said work. All of said liabilities shall be assumed by the CONTRACTOR. The CONTRACTOR further agrees to protect and hold harmless the CITY, its officers, and employees, from any and all claims, demands, causes of action, liability, or loss of any sort because of, or arising out of, the acts or omissions of the CONTRACTOR, his agents, and employees, in the performance of this agreement, or arising out of the use of any patent or patented article, in the performance of said agreement. THIRD: The CONTRACTOR hereby grants to the CITY, the Surety upon any Bond, and to the agents, employees, and CONTRACTOR or either of them, the irrevocable permission to enter upon the lands of the subject land division for the purpose of completing the work. This permission shall terminate in the event that the CONTRACTOR or the Surety has completed the work within the time specified or any extension thereof granted by the City Council. FOURTH: It is further agreed that the CONTRACTOR shall have the control of the ground reserved for the installation of said work, and the streets in which they are to be placed, as is necessary to allow him to carry out this agreement. i i FIFTH: Contemporaneously with the execution of this Agreement, CONTRACTOR shall file with the CITY a Time Certificate of Deposit in an amount of Sixty-Four Thousand Eight Hundred Dollars ($64,800) to guarantee faithful performance of all the provisions of this agreement and for the payment of all persons performing labor and furnishings materials in connection with this agreement. If the Time Certificate of Deposit, in the opinion of the CITY, becomes insufficient, CONTRACTOR agrees to renew said Time Certificate of Deposit within ten days of receiving notice that said Time Certificate of Deposit is insufficient. SIXTH: If the CONTRACTOR neglects, refuses, or fails to prosecute the work with such diligence as to ensure its completion within the time specified, or within such extensions of said time as have been granted by the City Council, or if the CONTRACTOR violates or neglects, refuses, or fails to perform satisfactorily any of the provisions of the plans and specifications, he shall be in default of this agreement and notice in writing of such default shall be served upon him and upon any Surety in connection with this contract. The City Council shall have the power, on recommendation of the City Engineer, to terminate all rights of the CONTRACTOR or his Surety then existing or which thereafter occur because of such default. The determination by the City Engineer of the question as to whether any of the terms of the contract or specifications have been violated, or have not been performed satisfactorily, shall be conclusive upon the CONTRACTOR, his Surety, and any and all other parties who may have any interest in the contract or any portion thereof. The foregoing provisions of this section shall be in addition to all other rights and remedies available to the CITY under law. SEVENTH: In case suit is brought upon this contract, the CONTRACTOR hereby agrees to pay to the CITY a reasonable attorney's fee to be fixed by the Court. EIGHTH: It is further agreed by and between the parties hereto, including the Surety or Sureties on any Bond attached to this contract, that in the event it is deemed necessary to • 0 extend the time of completion of the work contemplated to be done under this contract, said extension may be granted by the City Council, either at its own option, or upon request of the CONTRACTOR, and shall in no way affect the validity of this contract or release the Surety of Sureties on any Bond attached hereto. WHEREAS, on February 16, 2004, Hank Jong filed an application for a Tentative Tract Map, proposing to subdivide two (2) existing parcels into fifteen (15) condominium units; and on February 23, 2004, Michael Sun filed an application for a Conditional Use Permit for the development of a residential project in a general plarmed "Mixed Use" district. WHEREAS, this property on 3313 - 3319 Del Mar Avenue is located in the C-3; Medium Commercial zone; and NNIIiEREAS, The General Plan states that Planning Commission may approval residential development with the approval of a Conditional Use Permit in the mixed-use overlay district. Section 17.112.030.026 allows the granting of the Conditional Use Permit where such uses are deemed essential or desirable to the public convenience or welfare, and are in harmony with the various elements or objectives of the comprehensive general plan, and are not detrimental to surrounding property. WHEREAS, Sections 65800 & 65900 of the California Government Code and Section 17.112.010 of the Rosemead Municipal Code authorize the Planning Commission to approve, conditionally approve or deny conditional use permits; and WHEREAS, Sections 17.1 12.010 of the Rosemead Municipal Code specifies the criteria by which a conditional use permit may be granted; and WHEREAS, Sections 66473.5 and 66474 of the California Government Code (Map Act) and 16.08.130 of the Rosemead Municipal Code specify the criteria by which a subdivision map may be granted: • The map will not be materially detrimental to the public welfare nor injurious to the property; • The proposed subdivision will not be contrary to any official plan; • Each proposed parcel conforms in area and dimension to tine City codes; • All streets, alleys, and driveways proposed to serve the property have been dedicated and that such streets, alleys and driveways are of sufficient design to provide adequate access and circulation for vehicular and pedestrian traffic; • Easements and covenants required for the tentative map have been executed and recorded; and WHEREAS, Sections 66451 et seq. of the California Government Code (Map Act) and Section 1 6.08.130 of the Rosemead Municipal Code authorize the Planning Commission to approve, conditionally approve or deny tentative subdivision maps; and WHEREAS, On September 9, 2004, 65 Written notices were marled to property owners within 300 feet of the subject site; in addition to notices posted in 10 public locations, specifying the availability of the application, plus the date, time and location of the public hearing for Tentative Tract Map 61005 and Conditional Use Permit 04-950 and WHEREAS, on September 20 2004, the Planning Commission held a duly noticed and advertised public hearing to receive oral and written testimony relative to Tentative Tract Map 61005 and Conditional Use Permit 04-950; and NNIHERE AS, the Rosemead Platning Conurnission has sufficiently considered all testimony • • presented to them in order to make the following determination. NOW, T'IIEREFORE, BE IT RESOLVED by the Planning Commission of the City of Rosemead as follows: SEC'T'ION 1. The Planning Commission HEREBY DETERMINES that Tentative Tract Map 61005 and Conditional Use Permit 04-950 are Categorically Exempt under Section 15332(b) of the California Environmental Quality Act (CEQA) and local environmental guidelines where projects occur within city limits on a project site of no more than five acres substantially surrounded by urban uses. Accordingly, Tentative Tract Map 61005 and Conditional Use Permit 04-950 are classified as a Class 32 Categorical Exemption pursuant to Section 15332(b) of CEQA). SECTION 2. The Plamming Commission HEREBY FINDS AND DETERMINES that facts do exist to justify approving Tentative Tract Map 61005; according to the criteria of Section 16.08.130 of the Rosemead Municipal Code as follows: A. The proposed division will not be materially detrimental to the public welfare nor injurious to the property or improvements in the immediate vicinity; FINDING: The project has been designed to be sensitive to adjacent land uses and provide decent, affordable home ownership opportunities in the City. B. The proposed division will not be contrary to any official plan adopted by the City Council of The City of Rosemead; or to any official policies or standards adopted by the City Council and on file in the office of the City Clerk at or prior to the time of filing of the application hereunder. FINDING: The site is designated for the proper land use designations to permit such a development. The General Plan designation of Mixed Use; Residential/Commercial allows for residential uses. The development was granted a density bonus and concession on the required parking because of the low/moderate income units that will be made available by the Developer. C. Each proposed parcel conforms in area and dimension to the provisions of zoning and subdivision requirements of The City of Rosemead. FINDING: Lot dimensions meet the minimum requirements for a condominium subdivision. All new development shall meet the minimum development standards for the condominium zoning ordinance. D. All streets, alleys and driveways proposed to serve the property have been dedicated or such dedication is not required for the protection of public safety, health and welfare and that such streets, alleys and driveways arc of sufficient width, design and construction to preserve the public salety and to provide adequate access and circulation for vehicular and pedestrian traffic. FINDING: The City Engineer has reviewed this proposed subdivision relative to tine adjacent right-of-way. Access to the proposed parcels is off of Del Mar Avenue, which is a fully improved secondary arterial. The private common driveway has been reviewed by the Los Angeles County Fire Department. Based on these reviews, it is determined that tine design and construction of this project would preserve tine public safety and provide adequate access and circulation for vehicular and pedestrian traffic. The Los Anngeles County Fire Department also required fire sprinklers for each unit and garage. All necessary public improvements will be made prior to the construction of the proposed project. These improvements will be made within the Del Mar Avenue right of way when developed. E. Alley casements and covenants required for the approval of tine Tentative Map or plot have been duly executed and recorded. FINDING: Prior to recordation of the final tract map, the applicant is required to record a covenant for ingress and egress, utility and drainage easement, fire lane, and the installation of parkway area and CC&Rs as required by the City Engineer and Planning Director. • • SECTION 3. The Planning Commission HER-EBY FINDS AND DETERMINES that facts do exist to justify approving Conditional Use Permit 04-950; according to the criteria of Section 17.1 12.010 of the Rosemead Municipal Code as follows: A. Tile establishment, maintenance or operation of the use under the circumstances of the case be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood thereof. FINDING: The project is situated within a medium commercial zoning district. All development standards for the condominium ordinance have been met with this design, which provide for adequate living space and conunon open areas. B. The establishment, maintenance or operation of the use under the circumstances of the case will not be detrimental or injurious to the property and improvements in the neighborhood. FINDING: The proposed use is located within an established commercial district of the City, and is designated Mixed Use; Residential/Commercial in the General Plan. The proposed use is in conformity with the General Plan, in that the policies of the General Plan encourage complementary uses that will not be in conflict with established neighborhood districts. C. The project will not be detrimental or injurious to the general welfare of the City. FINDING: Conditions have been incorporated to ensure that the establishment, maintenance, and operation of the proposed use so applied for will not, under the circumstances of the particular case, be detrimental or injurious to the general welfare of the City. The proposed residences have been designed with a high level of design standards that incorporate architectural features that provide relief from wall massing by including bay and arched windows, accent columns and other aesthetically pleasing elements. The layout and design of this multi-family project will not create negative impacts to the general welfare of the City. Tlie proposed residences will range from 1,166 - 1,410 square feet of living area. Public Notice On September 9, 2004, sixty-five (65) written notices of this public hearing were mailed to property owners within 300 feet of the subject site. On September 9, 2004, ten (10) notices were posted in designated public places. Environmental Analysis Section 15332(b) of the California Environmental Quality Act (CEQA) and local enviromnental guidelines where projects occur within city limits on a project site of no more than five acres substantially surrounded by urban uses. Accordingly, Tentative Tract Map 61005 and Conditional Use Permit 04-950 are classified as a Class 32 Categorical Exemption pursuant to Section 15332(b) of CEQA. Municipal Code Requirements Tenlative Ti-act A•Iap - Section 66474 el seq of the Subdivision Map Act describes the grounds for approving a subdivision map. In addition, Chapter 16.04 of the Rosemead Municipal Code provides subdivision regulations, which adopt Los Angeles County subdivision regulations by reference. Subject Site & Surrounding Uses The site is designated in the General Plan for "Mixed-use Residential/Commercial" and on the zoning map; it is designated for C-3 (IVledium Commercial) zone. In accordance with California Government Code Section 65913.5 (Density Bonus), the applicant will make twenty (20) percent of the total condominium units in the project (a total of three units) affordable to persons and families of up to moderate income and will ensure the continued affordability of moderate-Income units for thirty (30) years. State law also requires a City to either grant a density bonus ol'25% over the maximum site density, along with one additional regulatory concession, in this case the developer chose to reduced the number of required parking spaces of four (4) spaces per unit to approximately 2.9 spaces pet- unit; for a total of 44 total spaces instead of the required 60 spaces. This project is located within the C-3 (Medium Commercial) zone with a General Plan designation of "Mixed-Use Residential/Commercial". This project is the first attempt to implement the General Plan, which allows for the constriction of residential uses on commercially zone property. The total lot area is 29,460.73, which equates to one unit per each 1,964 square feet of lot area or 22 units per acre. The current density for the R-3 (Medium Multiple Residential) zone is 1,500 square feet per dwelling unit and the current density for the R-4 (Heavy Multiple Residential) zone is one thousand square feet per dwelling unit. Using a density 1,500 square feet per dwelling unit, the lot would be suitable for the development of 19.6 units. The 25`i0 density bonus would result in an additional 4.9 units for a total of 24.5 units. Tentative Tract Map Review - The map was distributed to various agencies for their review on May 20, 2004. Responding agencies have made their comments, which are on file. The City Engineer has checked the parcel for its accuracy. The City Engineer's conditions of approval have been added to the attached as Exhibit A. By subdividing the land, the opportunity for property ownership becomes a possibility thus creating a higher standard of property maintenance. Lastly, the General Plan Land Use element specifies the density for High Density Residential properties as 0 - 30 units per acre. There will not be any environmental impacts to the subject area as a result of the Tentative Tract Map and Conditional Use Permit. The proposed residential land use is consistent with the surrounding mix of commercial and residential land uses. Zoning Setbacks: This area is currently zoned for C-3 (Medium Commercial) however the setbacks are governed by the R-3 (Medium Multi-Family) Zone. Architecture - There are two (2) different residential designs for the proposed project. The applicant has taken the character of the surrounding neighborhood into consideration in the design of the proposed homes. The proposed exteriors are light earthtone and brown colors that will soften the "looming" presence that a larger development has the potential to create. Also, architectural elements have been added to eliminate impacts of two-story homes that the proposed project may have on surrounding properties. The applicant has proposed earthtone exterior color combinations for each unit. Each building will have the same color scheme and materials. Buildings 1, 3 and 5 directly face Del Mar Avenue and are the primary elevations. Buildings 1 and 5 have the same elevation with a combination of hipped and gabled roofs, while Building 3 is slightly narrower with a predominate gable roof facing the street. The interior facing buildings have elevations, which are very similar- in design and incorporate the same architectural elements as those facing Del Mar Avenue. Each building has a combination of wooden trim around each window, wooden shutters, concrete roof tiles, cement • E plaster exteriors, lentil eave trines as well as garden windows for the kitchens. The colored renderings of thc elevations will be available to view at the Planning Commission Meeting. Landscaping and Fencing - A 6-foot high decorative concrete block wall will surround the entire perimeter of the proposed subdivision. Areas within the front yard setbacks will be reduced to a 4- foot high decorative concrete block wall. All existing fencing will be removed and replaced with the proposed block wall to provide a consistent look throughout the development. A landscape plan will be submitted to the Planning Department for review final to the issuance of any Building Permits. There are paved decks and open landscaped areas, which provide recreational areas in addition to creating a pedestrian path to connect the buildings. Neighborhood Character - In comparison to surrounding residences, development on the subject site would be greater. The developer has redesigned the project to bring the front entryways closer to the street. This will reduced the impact of any possible privacy issues. The maxinnun height of the front entry is 2'-0" above grade, similar to single-family residences with elevated entries. The design does not rely on heavy ornamentation or complicated architectural style, which would not complement the neighboring structures. It is sensitive to the surrounding uses and has a traditional style, but also has elements such as pedestrian bridges and common areas, which are often characteristic of commercial uses. Staff has worked with the developer in designing a project that will create new single-family housing in the City without detracting from the character of the existing surrounding neighborhood. In addition, adverse impacts to the character of the surrounding neighborhood will be mitigated and architectural interest is added to the project by varying roof ridgelines, tile roofing, wooden shutters, dormers and other aesthetically pleasing elements. Overall, staff feels that the addition of this residential development will increase property values and the general aesthetics of the neighborhood. RECONINIENDATION Staff recomimends that the Planning Commission recommend APPROVAL of Tentative Tract Map 61005 and Conditional Use Permit 04-950 subject to the conditions outlined in Exhibit "A". The water mains shall be of sufficient size to accommodate the total domestic and fire flow required for the land division. Domestic flows required are to be determined by the City Engineer. Fire flows required are to be determined by the Fire Chief. 27. Plans and specifications for the water system facilities shall be submitted for approval to the water company serving this land division. The subdivider shall submit an agreement and other evidence, satisfactory to the City Engineer, indicating that the subdivider has entered into a contract with the servicing water purveyor guaranteeing payment and installation of the water improvements. 28.
