CC - 12-18-96 - Special MeetingF~ -.o Ai PROVED CITY OF ROS :MEAD MINUTES OF THE SPECIAL MEETING lIATE a 97 ROSEMEAD CITY COUNCIL av DECEMBER 18, 1996 The Special Meeting of the Rosemead City Council was called to order by Mayor Clark at 7:07 p.m. in the Council Chambers of the City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Mayor Pro Tern Imperial The Invocation was delivered by Councilmember Bruesch ROLL CALL OF OFFICERS: Present: Councilmembers Bruesch, Taylor, Vasquez, Mayor Pro Tem Imperial, and Mayor Clark Absent: None 1. LEGISLATIVE A. URGENCY ORDINANCE NO. 778 - AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING A VOLUNTARY EXPENDITURE CEILING FOR ELECTIVE OFFICES IN ROSEWAD - ADOPT Robert Kress, City Attorney, presented the staff report. Mary Redd, 3323 N. Evelyn, Rosemead, stated that campaign contributions should be restricted to Rosemead residents only as there have been incidents in the past involving outside contributors offering large amounts of money. Ms. Redd continued that those contributors may want or expect something in return from the candidates. Mayor Pro Tern Imperial responded that those types of contributors can reside in or out of the City and that it is up to the discretion of the candidate to accept or deny the donation. Councilmember Bruesch stated that according to the new FPPC rulings, all campaign finance reports are public records with mandatory reporting times. Councilmember Taylor added that this Ordinance will probably not influence the Rosemead elections, but will affect the higher offices that involve gathering and spending greater amounts of money. Mr. Taylor cited examples of his last election where $100 donations were contributed to other candidates from "political machines" by people outside of the City, which amounted to 90% of their campaign contributions. Mayor Clark proposed a $.25 per resident limit which would result in a maximum amount of approximately $13,500, which is ample, and would safeguard against the "big" money coming into Rosemead which we all object to. Councilmember Taylor stated that while he agrees with the intent of the measure; he is dubious of the way it has been written. Mr. Taylor stated that personally wealthy candidates will be able to finance their campaigns with their own money. . MOTION BY COUNCILMEMEER BRUESCH, SECOND BY MAYOR PRO TEM IMPERIAL that the Council adopt Ordinance 778 with the amendment that the voluntary spending limits not exceed $.25 per city resident per election. Before vote could result, more discussion ensued. CC 12-18-96 Page #1 A 0 Juan Nunez, 2702 Del Mar, Rosemead, requested clarification of the Section on printing candidates voluntary expenditure statements for free. Mr. Kress explained that the free printing would be a one line statement for State wide candidates designating that the candidate has accepted the voluntary expenditure ceiling. MT. Kress continued that this ruling may not affect this (March, 1997) Municipal Election as the FPPC has not issued regulations governing this election. Councilmember Bruesch called for the question. Vote resulted: Yes: Vasquez, Clark, Bruesch, Imperial No: Taylor Absent: None Abstain: None The Mayor declared said motion duly carried and so ordered. Councilmember Taylor stated for the record that he voted No, and while he believes in the intent of the Ordinance, in reality the FPPC is still trying to clarify what the intent is of this legislation and that he agrees with the $.25 amount per resident; however, he cannot agree with the way the measure is written. B. RESOLUTION NO. 96-60 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING CONDITIONAL USE PERMIT 96-668, ALLOWING DEVELOPMENT OF A 2,950 SQUARE FOOT RESIDENCE AT 3306 BARTLETT AVENUE (APN:528-009-030) The following resolution was presented to the Council for adoption: RESOLUTION NO. 96-60 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING CONDITIONAL USE PERMIT 96-668, ALLOWING DEVELOPMENT OF A 2,950 SQUARE FOOT RESIDENCE AT 3306 BARTLETT AVENUE (APN:528-009-030) Mr. Tripepi presented the staff report. MOTION BY COUNCILMEMBER BRUESCH, SECOND BY MAYOR PRO TEM IMPERIAL that Council adopt Resolution 96-60 with the attached Conditions of Approval of Conditional Use Permit 96-668. Before vote could result, more discussion ensued. Mary Redd, 3323 N. Evelyn, Rosemead, asked about the garage size, as a situation occurred on her street where emergency vehicles had to double park as residents average six cars per household with only two car garages. Ms. Redd explained that the Building Department would not grant her an addition of a bedroom to her house unless she added another car garage. Ms. Redd continued that on occasion that City has not followed through with that policy requiring building another garage if house footage exceeds normal limits or addition costs goes over $10,000. Ms. Redd gave address of those houses to Council. Mayor Clark asked the Planning Director to respond. Peter Lyons, Planning Director, responded the Ordinance states that if a house addition goes over $10,000 based on $82 per square foot evaluation, that would require the building of an additional garage on that property. Mr. Lyons stated that this issue had been discussed previously to change the amount to a percentage to adjust for inflation. CC 12-18-96 Page #2 Mr. Tripepi stated that this requirement depends on the type of improvements done - improvements designed to bring a home up to code versus an addition of a bedroom or den. Councilmember Taylor requested a historical background on this Ordinance and brought back for review by Council in the future. Mr. Taylor explained that building only a 10'x12' square room would already be at the $10,000 limit and most additions would not be that small. Juan Nunez, 2702 Del Mar, Rosemead, stated that this house is "mansionization" of the property and that the developments should conform to the existing properties and he also expressed his concern about future parking problems with houses of more than three bedrooms. Councilmember Vasquez called for the question. Vote resulted: Yes: Vasquez, Taylor, Bruesch, Imperial No: Clark Absent: None Abstain: None The Mayor declared said motion duly carried and so ordered. II. CONSENT CALENDAR A. AUTHORIZATION TO RETURN CLAIM - ARVISO ET AL V.32 INTL., ETC. ET AL - (OPERATING INDUSTRIES LANDFILL LITIGATION) MOTION BY COUNCILMEMBER BRUESCH, SECOND BY MAYOR PRO TEM IMPERIAL that the Council authorize the City Clerk to return the tort claim form filed in relation to Arviso et al v 21 International, et al, pursuant to the reasons outlined in the staff report. Vote resulted: Yes: Vasquez, Taylor, Clark, Bruesch, Imperial No: None Absent: None Abstain: None The Mayor declared said motion duly carried and so ordered. B. AUTHORIZATION TO ATTEND LEAGUE OF CALIFORNIA CITIES CITY MANAGERS DEPARTMENT MEETING, FEBRUARY 5-7,1997, MONTEREY Juan Nunez, 2702 Del Mar, Rosemead, asked why the League took the position of opposing Proposition 218. Councilman Taylor responded that this is a political organization and that you sometimes have to take the good with the bad and that overall, the League is a good organization. MOTION BY COUNCILMEMBER BRUESCH, SECOND BY MAYOR PRO TEM IMPERIAL, that the Council authorize the attendance of the City Manager.
