Summary
Amstead Residuals, LLC has submitted a design review application for the construction
of a new 13,969 square -foot Fresh and Easy Neighborhood Market, and a conditional
use permit application for a new Off -Sale beer and wine (Type 20) ABC license, located
at 9000 E. Valley Boulevard in the CBD -D (Central Business District with a Design
Overlay) zone.
Environmental Determination: Section 15332(b) of the California Environmental
Quality Act (CEQA) guidelines exempt projects where the proposed development
occurs within city ,limits on a project site of no more than five (5) acres substantially
surrounded by urban areas. Accordingly, Design Review 09 -04 is classified as a Class
32 Categorical Exemption pursuant to Section 15332(b) of CEQA. Section 15309 of the
California Environmental Quality Act (CEQA) guidelines exempt projects that consist of
the inspections to check for the performance of an operation, or quality, health, or safety
of a project. Accordingly, Conditional Use Permit 09 -03 is classified as a Class 9,
Categorical Exemption pursuant to Section 15309 of CEQA.
Municipal Code Requirements:
Section 17.72.030 of the RMC states that design review procedures shall be followed
for all improvements involving visible changes in form, texture, color, exterior fagade or
landscaping.
Section 17.72.030 of the Rosemead Municipal Code (RMC) states that design review
procedures shall be followed for all proposed improvements requiring a building permit
or visible changes in form, texture, color, exterior fagade or landscaping.
Section 17.72.050 of the RMC provides the criteria by which the Planning Commission
may approve, approve with conditions, or deny any application requiring a design
review based on the following:

• The plans indicate proper consideration for the relationship between the
proposed structure and site developments that exist or have been approved for
the general neighborhood; and
• The plan for the proposed structure and site development indicates the manner
in which the proposed development and surrounding properties are protected
against noise, vibrations, and other factors which may have an adverse effect on
the environment, and the manner of screening mechanical equipment, trash,
storage and loading areas; and
• The proposed structure or site development is not, in its exterior design and
appearance, so at a variance with the appearance of other existing buildings or
site developments in the neighborhood as to cause the nature of the local
environment to materially depreciate in appearance and value; and
• The proposed building or structure is in harmony with the proposed
developments on land in the general area, especially those instances where
buildings are within or adjacent to land shown on the General Plan as being part
of the Civic Center or in public or educational use, or are within or immediately
adjacent to land included within any precise plan which indicates building shape,
size or style; and
• The proposed development is in conformity with the standards of this code and
other applicable ordinances in so far as the location and appearance of the
buildings and structures are involved; and
• The site plan and the design of the proposed buildings, parking areas, signs,
landscaping, luminaries and other site features indicates that proper
consideration has been given to both the functional aspects of the site
development, such as automobile and pedestrian circulation, and the visual
effect of the development from the view of public streets.
Section 17.112.030 (9) of the Rosemead Municipal Code (RMC) allows off -sale alcohol
licenses in the C -1, C -3, CBD and M zones upon the granting of a Conditional Use
Permit (CUP) by the Planning Commission. RMC Section 17.112.010 sets the following
criteria that must be met:
• That the Conditional Use Permit applied for is authorized by the provisions of this
title; and
That the granting of such Conditional Use Permit will not adversely affect the
established character of the surrounding neighborhood or be injurious to the

property or improvements in such vicinity and zone in which the property is
located; and
That the establishment, maintenance or conduct of the use for which the
conditional use permit is sought will not, under the particular case, be detrimental
to the health, safety, morals, comfort, convenience or welfare of persons residing
or working in the neighborhood; and
• Not be detrimental or injurious to the property and improvements in the
neighborhood or the general welfare of the city; and
A. Section 17.112.100 of the Rosemead Municipal Code states that in addition to the
general findings required for the issuance of a Conditional Use Permit, the Planning
Commission, or on appeal the City Council, shall find that each of the following facts or
conditions exist, prior to the issuance of a new Conditional Use Permit authorizing the
sale of alcoholic beverages:
• The proposed use complies with all requirements as set forth for the issuance of
a Conditional Use Permit;
• The proposed use will not present problems including, but not limited to, loitering,
obstruction of pedestrian traffic, increased vehicular traffic, increased parking
demand, crime, interference with children on their way to school, interference
with shoppers using streets, defacement and damage to property.
• The proposed use will not lessen the suitability of any nearby commercially
zoned properties for commercial use;
• The use shall not adversely affect the welfare of area residents or result in undue
concentration in the neighborhood of establishments dispensing alcoholic
beverages including beer and wine. Consideration shall be given regarding
whether the proposed use will detrimentally affect nearby residentially zoned
communities, considering distance to residential buildings, churches, schools,
hospitals, public playgrounds, and other establishments dispensing alcoholic
beverages.
B. The burden of proving that the proposed use will not adversely affect the welfare of
nearby residents, result in undue concentration of alcoholic beverage outlets, or
detrimentally affect nearby residentially zoned communities shall be the applicant's.
Staff Recommendation
Staff recommends that the Planning Commission APPROVE Design Review 09 -04 and
Conditional Use Permit 09 -03 for a period of one (1) year and ADOPT Resolution 09 -15
subject to conditions outlined in Exhibit "B" attached hereto.

Property History and Description
The subject property is located at the southeast corner of Rosemead Boulevard and
Valley Boulevard. The site consists of one (1) parcel totaling approximately 78,555
square feet (1.8 acres).
On January 15, 2007, the Planning Commission approved Design Review 06 -138 for
the demolition of an existing 'Bank of the West' building and the construction of two
stand alone buildings; a 4,010 square foot bank building and a 12,000 square foot
retail /restaurant building. According Building and Safety Division records, the site is
currently occupied by a 4,010 square foot bank building located at the southwest corner
of the lot. The 12,000 square foot retail /restaurant building was never constructed.
Therefore, the remaining portion of the site has been vacant since 2007.

Administrative Analysis
Fresh and Easy Neighborhood Market, which is part of "Tesco PLC," is a United
Kingdom based international supermarket chain. It is the largest British retailer, both by
global sales and by domestic market share, and the fourth largest retailer in the world.
Their goal is to bring quality, service, and choice, at a competitive price, to the City of
Rosemead. Fresh and Easy Neighborhood Market is proposing to build a neighborhood
grocery market that provides a large diversity of food. Fresh and Easy Neighborhood
Market will stock a wide range of both fresh and ambient lines including dairy, meat,
fresh fruits and vegetables, baked goods and other grocery items.
The applicant has indicated that the hours of operation will be between 6 a.m. and
midnight, with the option to extend to a 24 -hour operation with the City's approval. The
applicant has also indicated that Fresh and Easy Neighborhood Market plans to employ
six to eight (6 -8) employees during peak hours.
Site Plan
The applicant is proposing to construct a 13,969 square foot Fresh and Easy
Neighborhood Market. The proposed single -story market will front Rosemead
Boulevard with the main entrance facing west towards Rosemead Boulevard. The
structure will be located along the east portion of the lot, and will be setback twenty -one
(21) feet from the east property line and eight (8) feet from the front property line,
adjacent to Valley Boulevard, which allows for landscaping. The applicant is proposing
to incorporate a landscaped feature at the northwest corner of the property with berm
landscaping to create height and interest. This landscaped feature will provide an
aesthetic enhancement for the project, as well as, greatly improve the visual
appearance of the intersection of Rosemead Boulevard and Valley Boulevard. The
landscaped feature will include decomposed granite meandering pathways, and provide
a connection from the sidewalk to the front entrance of the market. Drought tolerant
landscaping has been proposed throughout the site.
The applicant is also proposing to construct a new drive -thru ATM for `Bank of the
West". The drive -thru ATM will be located along the south property line. As a condition

of approval, staff will require that the drive -thru ATM match the existing " "Bank of the
West."' building in colors and materials.
Adequate trash facilities have been proposed for the site. The applicant is proposing a
trash enclosure with a decorative trellis top along the west property line, adjacent from
the 'Bank of the West' building. The trash enclosure will incorporate a stone veneer
exterior finish to match the " "Bank of the West."' building. A second trash enclosure,
which will be used by the Fresh and Easy Neighborhood Market, will be fully enclosed
with a solid roof and provide ample area for recycling bins. Fresh and Easy
Neighborhood Market does not generate a lot of trash, as most of the merchandise sold
at the store is prepared off site. Most of the trash that will be generated are boxes and
pallets. There is a baler in the store for boxes and space allocated inside the storage
room for return pallets. Both boxes and pallets are pickup up every time a Fresh and
Easy truck makes a delivery to the store.
The applicant is proposing to install two cart storage facilities, which will be located
within the parking lot area. The one cart storage facility will be integrated into the Fresh
and Easy Neighborhood Market building, and the cart storage will be screened by a T-
0" high wall that will have a stone veneer finish. Staff has added a condition of approval
requiring that the applicant install electronic shopping cart wheel locks to contain all
carts within the property line.
The applicant is proposing a loading dock at the rear of the building, on the east
elevation. The loading dock is located approximately forty (40) feet away from the
residential property to the southeast. Staff has worked closely with the designers and
architects of the project to ensure that the loading areas are screened from public view
to avoid negative noise and visual impacts. The applicant is proposing to install a stone
veneer wall with a railing along the loading dock area. There is an existing block wall
along the east property line, which will be stuccoed to match the building. The applicant
is proposing deliveries from 6:00 a.m. to 11:00 p.m. daily.
Floor Plan
The proposed one -story Fresh and Easy Neighborhood market will total 13,969 square
feet. The floor plan consists of a check stand, tasting station, sales area, and 3,678
square feet of warehousing. The main entrance to the Fresh and Easy Neighborhood
Market will be located along the west side of the building, facing Rosemead Boulevard.
Elevations
The applicant has worked with the Planning Division in designing an aesthetically
pleasing project. Various elements have been added to provide architectural interest to
the design. These elements include the use of contrasting exterior finishes, pre -cast
concrete and molding, vertical and horizontal reveals, accent tiles and stone veneer.

The front fagade has been designed to create visual interest at the street level. The
main entrance of the building is highlighted through the use of a distinct corner element
at the northwest corner of the building. Additional design elements include a metal
awning above the main entry doors, as well as, fagade pop -outs that add articulation.
To ensure that design treatments are continued around the building, the applicant
proposes to use stone veneer and reveal lines on all elevations.
The applicant proposes to apply various types of materials to the exterior walls of the
structure'to further break -up the building's profile. As shown on the colored elevation
drawings, the exterior finish will incorporate both an E.I.F.S. finish in a cream color
(Benjamin Moore — "Philadelphia Cream ") and a cement plaster finish in a green color
(Benjamin Moore — "Herb Garden "). The building cornice will be painted green
(Benjamin Moore — "Herb Garden "). A brownish -gray colored stone veneer (El Dorado
Stone — "Rustic Ledge Sequoia ") with a precast concrete molding cap is being proposed
on at the base of the pop -outs. The applicant is also proposing Solar Control Low -E
glass windows that combine the appearance of transparent, color - neutral glass with an
unprecedented combination of solar control and visible light transmittance.
The proposed building is in compliance with the City's variable height requirement, and
lies approximately sixty (60) feet from the existing single - family residence located
directly to the southeast of the project site.
Parking and Circulation
Access to the site would be via three driveways, one right -in /right -out driveway on
Valley Boulevard and two full access driveways on Steele Street. The proposed
driveway along Valley Boulevard will be 27' -0" wide. The existing driveway at the
southeast corner of the lot, along Steele Street is 26' -0" wide and the driveway at the
southwest corner of the lot, along Steele Street is 25' -0" wide.
A surface parking lot will be shared between the " "Bank of the West "" Building and the
proposed Fresh and Easy Neighborhood Market. Parking will be provided south and
west of the proposed Fresh and Easy Neighborhood Market and south and east of the
"Bank of the West" building. A total of seventy -two (72) parking spaces will be provided
on site; fifty four (54) standard spaces, eighteen (18) compact spaces, five (5)
handicapped parking spaces, three (3) adults with children parking spaces and two (2)
hybrid parking spaces. Although the site plan indicates that five (5) parking spaces are
reserved for "Adults with Children and Hybrid Vehicles," the applicant has indicated that
these parking spaces are readily available to all vehicles.
The parking ratio for retail use is one (1) parking space for every two hundred fifty (250)
square feet of retail floor area. Based on this ratio, seventy -two (72) parking spaces will
be required for the proposed Fresh and Easy Neighborhood Market and the existing
"Bank of the West" building.

Traffic Impacts
The original project, which consisted of a new bank and retail /restaurant development,
was analyzed in a Traffic Impact Analysis, prepared by Kimley -Horn and Associates in
December 2006. Staff required the applicant to submit a revised Traffic Impact Analysis
for the review of this project. Therefore, a revised trip generation assessment was
prepared by Kimley -Horn and Associates in May 2009. A copy of this study has been
attached as Exhibit "E."
The revised study, which was reviewed by the City's Traffic Engineer, analyzed the
traffic impacts at the ten (10) intersections (Rosemead Boulevard and Valley Boulevard,
Rosemead Boulevard and Mission Drive, Rosemead Boulevard and Lower Azusa Road,
Rosemead Boulevard and Marshall Street, Valley Boulevard and Hart Avenue, Valley
Boulevard and Mission Drive, Valley Boulevard and Rio Hondo Avenue, Valley
Boulevard and Ivar Avenue, Valley Boulevard and Muscatel Avenue, and Steele Street
and Hart Avenue). The study concluded that the modified project is not anticipated to
create significant traffic- related impacts at these intersections. Therefore, no additional
traffic mitigation will be necessary at this site beyond what was required with the original
approval of Design Review 06 -138.

The applicant is proposing 16,078 square feet of landscaping for the entire site, which
equals to 20.47% of the total site area. The minimum landscaping requirements in the
Central Business District is 3 %. The applicant's landscaping proposal far exceeds
these requirements. The landscape plan indicates the use of a wide variety of plant
materials, which include: Octopus Agave, Japanese Boxwood, Feathery Cassia,
California Lilac, French Lavender, Red Yucca, Cougainvillea, Yellow Lantana, New
Zealand Flax, Dwarf Mock Orange, Indian Hawthorn, Roses, Carolina Laurel Cherry,
Salmon Beauty Yarrow, Lily of the Nile, Deer Grass, Society Garlic, Creeping Fig,
Gazania, Aaron's Beard and Senecio. These landscaping materials are very commonly
used throughout the Southern California region.
A focal point of the development is a landscape feature located at the northwest corner
of the lot; near the Rosemead Boulevard and Valley Boulevard intersection. This
landscape feature will incorporate a decomposed granite meandering pathway and
berm landscaping with drought resistant shrubs and groundcover. The landscaped
feature will be visible to pedestrians and motorist traveling on Rosemead Boulevard and

The landscaping along Valley Boulevard includes a planter area along the northwest
corner of the lot, between the sidewalk and the parking lot area, which will incorporate
screening shrubs and low flowering perennials at the driveway entrance. The northeast
corner of the lot will incorporate low accent trees with flowering perennials, which
include Australian Willows, Japanese Boxwood, New Zealand Flax, Queen Palms, Lily
of the Nile and Gazanias. A twenty -one (21) foot wide landscaped planter will be
provided along the east property line. This will provide a buffer between the Fresh and
Easy Neighborhood Market and the adjacent properties to the east. A five (5) foot wide
landscape planter will continue along the east property line, between the parking lot
area and the residential property to the southeast. The applicant is proposing several
landscaped planters throughout the parking lot area, which will incorporate summer
shade trees, screening hedges, and groundcover. Staff has added a condition of
approval, requiring the applicant to provide a final landscape and irrigation plan to the
Planning Division for review and approval prior to the issuance of building permits. The
final landscape and irrigation plan must include a sprinkler system with automatic timers
and moisture sensors.
Fencing
Low parking lot screen walls are proposed along the north property line. These walls
will measure T -0" in height and match the existing walls along the west and south
property lines. The existing wall along the east property line will also be stuccoed to
match the existing in color and texture.
Lightina
As indicated on the photometric plan, which has been attached as Exhibit "C ", all
exterior lighting is of low intensity and fully shielded. All new fixtures will be fully
shielded and match the existing light standards onsite. The applicant is proposing
eleven (11) new wall mounted light fixtures along the north, south and east building
walls of the proposed Fresh and Easy Neighborhood Market, as well as the east
building wall of the `Bank of the West' building. The applicant also proposes to install
low intensity bollard lighting in the landscape feature at the northwest corner of the
property.
Staff is concerned that light from an existing light standard located along the southeast
property line, may impact the adjacent residential property. To resolve this issue, the
applicant has indicated that a new 18" deep shield will be installed to prevent the light
from spilling across the property. Staff has added a condition of approval that if the
proposed shielding is not sufficient, staff will require that the light standard be relocated.
Soils Report
The California Department of Conservation, California Geological Survey has identified
the project site as a subject liquefaction. Liquefaction is the sudden failure and
fracturing of saturated ground resulting from an earthquake, which can cause structural
failure of buildings, roadways, bridges, etc. Structures presently on the site, as well as

any future structures, are subject to this liquefaction. For this reason, a revised soils
report was prepared for this project by Geotechnologies, Inc. The City's independent
geotechnical and engineering geology consultants have reviewed the revised report and
have deemed it acceptable as presented on June 22, 2009.
State Department of Alcoholic Beverage Control (ABC) and Public Safety Report
Fresh and Easy Neighborhood Market proposes to sell beer and wine, which will
require approval of an Off -Sale beer and wine (Type 20) ABC license. Staff has
requested reports from both ABC and the City's Public Safety Center. The subject site
is located within census tract 4329.01. The boundaries of the census tract are
Muscatel Avenue to the west, Rio Hondo to the east, Valley Boulevard to the north and
the 1 -10 freeway to the south. The population of the census tract in which the subject
property is located is 4,347. The number of allowable on -sale beer and wine licenses
for this census tract is three (3). Currently, there are three (3) authorized off -sale
licenses for this census tract. The worksheet from the ABC indicates that the subject
site is located in a census tract that has an undue concentration of alcohol permits.
ABC defines "over- concentration" as greater than one license per 1,620 residents living
within the subject census tract.
The Department of Alcoholic Beverage Control has determined that this location is in a
high crime district. However, the City of Rosemead Public Safety Center found no
unusual situations or concerns at the subject site. The applicant has also submitted a
letter of support, attached in this staff report as Exhibit "F," for the off -sale of beer and
wine. In this letter, Fresh and Easy Neighborhood Market has indicated that alcoholic
beverages are expected to comprise a small percent of the store shelf- space. In this

have a very extensive training program for their employees to help ensure that it is a
responsible retailer of alcoholic beverages. Staff feels that this use is consistent with
the surrounding commercial properties and existing land uses in the general area, with
no foreseeable negative impacts to the adjacent neighborhood or adjoining properties.
Although no criminal incidents have been reported on the premise in the past year,
specific conditions of approval have been incorporated herein to deter regular alcohol
related incidents from occurring as a proactive measure to prevent crime in the City.
These conditions of approval include, but are not limited to, requiring that a 24 -hour
surveillance camera component system be installed within the interior and exterior of
the market.
The closest school to the subject property is Rosemead Adult School, which is located,
0.1 miles from the proposed Fresh and Easy Neighborhood Market, at 4105 Rosemead
Boulevard. The second closest school is Muscatel Middle School, which is located 0.3

miles away, at 4201 Ivar Avenue. The next closest school is Rosemead High School,
which is located 0.4 miles, at 9063 Mission Drive.
Several churches are located within one -half (' /z) mile from the subject site. Rosemead
Christian Church, which is located at 8705 Valley Boulevard, is 0.5 miles from the
subject restaurant, and Rosemead Korean SDA Church, which is located at 4203
Rosemead Boulevard, is 0.2 miles from the subject site.
Although several churches and schools are located in close proximity to the project site,
no complaints have been received by the Planning Division from any churches or
schools related to the proposed on -site sale of alcoholic beverages at the restaurant
location.
Conclusion
The proposed design is in line with contemporary commercial buildings found in the
immediate vicinity. Many of the proposed architectural elements on the building will
also compliment the existing "Bank of the West" building on the southwest corner of the
lot. Overall, the development will improve the appearance from Valley Boulevard and
Rosemead Boulevard.

APPROVING DESIGN REVIEW 09 -04, FOR THE CONSTRUCTION OF
A NEW 13,969 SQUARE FOOT FRESH AND EASY NEIGHBORHOOD
MARKET, AND APPROVING CONDITIONAL USE PERMIT 09 -03, FOR

WHEREAS, on May 27, 2009, Amstead Residuals, LLC filed an application for a
Design Review application for the construction of a 13,969 square foot Fresh and Easy
Neighborhood Market, and a Conditional Use Permit application for a new Off -Sale beer
and wine (Type 20) ABC license;
WHEREAS, this property located at 9000 E. Valley Boulevard is located in the
CBD -D (Central Business District with a Design Overlay) zone; and
WHEREAS, Section 17.72.050 of the Rosemead Municipal Code (RMC)
provides the purpose and criteria for a design review; and
WHEREAS, Sections 65800 & 65900 of the California Government Code and
Section 17.72.050 of the Rosemead Municipal Code authorize the Planning
Commission to approve, conditionally approve or deny design review applications; and
WHEREAS, Section 17.72.030 of the Rosemead Municipal Code (RMC) states
that design review procedures shall be followed for all improvements involving visible
changes in form, texture, color, exterior facade or landscaping.
Section 17.72.050 sets the criteria by which the Planning Commission may
approve, approve with conditions, or deny an application:
The plans indicate proper consideration for the relationship between the
proposed structure and site developments that exist or have been approved for
the general neighborhood;
The plan for the proposed structure and site development indicates the manner
in which the proposed development and surrounding properties are protected
against noise, vibrations, and other factors which may have an adverse effect on
the environment, and the manner of screening mechanical equipment, trash,

storage and loading areas.
• The proposed structure or site development is not, in its exterior design and
appearance, so at variance with the appearance of other existing building or site
developments in the neighborhood as to cause the nature of the local
environment to materially depreciate in appearance and value.
• The proposed building or structure is in harmony with the proposed
developments on land in the general area, especially those instances where
buildings are within or adjacent to land shown on the General Plan as being part
of the Civic Center or in public or educational use, or are within or immediately
adjacent to land included within any precise plan which indicates building shape,
size or style.
• The proposed development is in conformity with the standards of this code and
other applicable ordinances in so far as the location and appearance of the
buildings and structures are involved; and
• The site plan and the design of the buildings, parking areas, signs, landscaping,
luminaries and other site features indicates that proper consideration has been
given to both the functional aspects of the site development, such as automobile
and pedestrian circulation, and the visual effect of the development from the view
of public streets.
Section 17.112.020(9) of the Rosemead Municipal Code (RMC) allows "off -sale
alcohol licenses in the C -1, C -3, CBD and M zones upon the granting of a Conditional
Use Permit (CUP)." Section 17.112.010 sets criteria required for granting such a
permit. These criteria require that the proposed use is deemed:
• The establishment, maintenance and operation of the use will not be
detrimental to the health, safety, peace, morals, comfort or general welfare
of persons residing or working in the neighborhood;
• The establishment, maintenance and operation of the use will not be
detrimental or injurious to the property and improvements in the
neighborhood and;
• The establishment, maintenance and operation of the use will not be detrimental
to the general welfare of the city; and
WHEREAS, on June 25, 2009, fifty -eight (58) notices were sent to property
owners within a 300 -foot radius from the subject property, in addition to notices posted
in six (6) public locations and on -site, specifying the availability of the application, plus

the date, time and location of the public hearing for Design Review 09 -04 and
Conditional Use Permit 09 -03; and
WHEREAS, on July 6, 2009, the Planning Commission held a duly noticed and
advertised public hearing to receive oral and written testimony relative to Design Review
09 -04 and Conditional Use Permit 09 -03; and
WHEREAS, the Rosemead Planning Commission has sufficiently considered all
testimony presented to them in order to make the following determination.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Rosemead as follows:
SECTION 1. The Planning Commission HEREBY DETERMINES that Design
Review 09 -04 is classified as a Class 32 Categorical Exemption pursuant to Section
15332(b) of CEQA guidelines and Conditional Use Permit 09 -03 is classified as a Class
9 Categorical Exemption pursuant to Section 15309 of CEQA guidelines. Section
15332(b) of the California Environmental Quality Act exempts projects where the
proposed development occurs within city limits on a project site of no more than five (5)
acres substantially surrounded by urban. Section 15309-of the California Environmental
Quality Act (CEQA) guidelines exempt projects that consist of the inspections to check
for the performance of an operation, or quality, health, or safety of a project.
SECTION 2. The Planning Commission HEREBY FINDS AND DETERMINES
that facts do exist to justify approving Design Review 09 -04 in accordance with Section
17.72.030 et seq., of the Rosemead Municipal Code as follows:
A. The plans indicate proper consideration for the relationship between the
proposed building and site developments that exist or have been approved for the
general neighborhood;
FINDING: The proposed office building is located within the central business
district of the City, and the property is designated Mixed Use: Residential /Commercial
(31 -45 du /acre) in the Rosemead General Plan. The applicant has provided an
aesthetically pleasing design and the proposed improvements will vastly improve the
partially vacant property. The proposed project is consistent with the goals and policies
of the Land Use Element of the City's General Plan in that it calls for the upgrading of
commercial uses by implementing architectural and design reviews of proposals for new
a project.
B. The plan for the proposed building and site development indicates the
manner in which the proposed development and surrounding properties are protected
against noise, vibrations and other factors which may have an adverse effect on the

environment, and the manner of screening mechanical equipment, trash, storage and
loading areas.
FINDING: Staff has worked closely with the designers and architects of the
project to ensure that the loading areas are screened from public view to avoid negative
noise and visual impacts. A twenty -one (21) foot wide landscaped planter will be
provided along the east property line. This will provide a buffer between the Fresh and
Easy Neighborhood Market and the adjacent properties to the east. A five (5) foot wide
landscape planter will continue along the east property line, between the parking lot
area and the residential property to the southeast. The loading dock is located
approximately forty (40) feet away from the residential property to the southeast. The
applicant is proposing to install a stone veneer wall with a railing along the loading dock
area. All parking lot lighting will be fully shielded to mitigate glare on adjacent
properties. Lastly, conditions of approval have been incorporated to eliminate any
adverse effects on the environment as a result of the proposed project. Conditions of
approval will specifically address factors such as noise, construction hours, screening of
mechanical equipment, landscaping, lighting and the overall maintenance of the
property. This development will not adversely affect surrounding properties.
C. The proposed building or site development is not, in its exterior design and
appearance, so at variance with the appearance of other existing buildings or site
developments in the neighborhood as to cause the nature of the local environment to
materially depreciate in appearance and value;
FINDING: The proposed Fresh and Easy Neighborhood Market will be
harmonious with the exterior designs of the surrounding buildings in the neighborhood.
The proposed Fresh and Easy Neighborhood Market will create a development that is
aesthetically pleasing and enhance land values in the general area.
D. The proposed building or structure is in harmony with the proposed
developments on land in the general area, especially in those instances where buildings
are within or adjacent to land shown on the General Plan as being part of the Civic
Center or in public or educational use, or are within or immediately adjacent to land
included within any precise plan which indicates building shape, size or style.
FINDING: The proposed project is consistent with the goals and policies of the
Land Use Element of the City's General Plan in that it calls for the upgrading of
commercial uses by implementing architectural and design reviews of proposals for new
projects. The proposed Fresh and Easy Neighborhood Market will provide a cohesive
architectural style and color scheme and an aesthetically pleasing design when viewed
from Rosemead Boulevard and Valley Boulevard as well as other surrounding
properties /streets.

E. The proposed development is in conformity with the standards of this code
and other applicable ordinances in so far as the location and appearance of the
buildings and structures are involved.
FINDING: This proposed development meets all of the minimum code
requirements for the CBD -D (Central Business District with a Design Overlay) zone, and
all applicable referenced code sections of the Rosemead Municipal Code.
F. The site plan and the design of the buildings, parking areas, signs,
landscaping, luminaries, and other site feature indicates that proper consideration has
been given to both the functional aspects of the site development, such as automobile
and pedestrian circulation, and the visual effect of the development from the view of
public streets.
FINDING: Staff has worked extensively with the applicant to develop a plan that
improves functional aspects like parking and traffic circulation as well as visual effects of
the development. Access to the site will be via three (3) driveways, one (1) right -
in /right -out driveway on Valley Boulevard and two (2) full access driveways on Steele
Street. The proposed driveway along Valley Boulevard will be 27' -0" wide. The existing
driveway at the southeast corner of the lot, along Steele Street is 26-0" wide and the
driveway at the southwest corner of the lot, along Steele Street is 25' -0" wide. This
development provides the required parking for two retail buildings, which is conveniently
located adjacent to the proposed Fresh and Easy Neighborhood Market and "Bank of
the West" building. All parking lot lighting will be fully shielded to mitigate glare on
adjacent properties. Lastly, 20.47% of the entire site will be devoted to landscaping.
SECTION 3. The Planning Commission HEREBY FINDS AND DETERMINES
that facts do exist to justify approving Conditional Use Permit 09 -03 in accordance with
Section 17.112.010 of the Rosemead Municipal Code as follows:
A. The Conditional Use Permit applied for is authorized by the provisions of this
title and that the granting of such conditional use permits will not adversely affect the
established character of the surrounding neighborhood or be injurious to the property or
improvements in such vicinity and zone in which the property is located.
FINDING: Staff finds this request to be consistent with land uses in the general
area with no foreseeable negative impacts to the adjacent neighborhood. This site will
be operated in accordance with applicable City regulations, and is in conformity with the
development in and around the project site. Regular inspections by City Staff, State
ABC and the Sheriffs Department will ensure that the location is monitored for
compliance with conditions of approval and ensuring that the business of selling alcohol
at this site does not become detrimental to the persons residing or working in the area.

B. The establishment, maintenance or conduct of the use for which the
conditional use permit is sought will not, under the particular case, be detrimental to the
health, safety, morals, comfort, convenience or welfare of persons residing or working in
the neighborhood.
FINDING: The site is designated in the General Plan as Mixed Use:
Residential /Commercial (31 -45 du /acre). The proposed use is located within an
established central business district of the City. The proposed use is in conformance
with the General Plan, in that the policies of the General Plan encourage
complementary uses that will contribute to the economic well being of the commercial
areas of the City. Conditions have been added to protect the adjacent residential
neighborhoods from being affected by this commercial establishment. Therefore, the
project is not anticipated to be detrimental to the health, safety, morals, comfort,
convenience or welfare of persons residing or working in the neighborhood.
C. The establishment, maintenance, and operation of the proposed use so
applied for will not, under the circumstances of the particular case will not be detrimental
or injurious to the general welfare of the City.
FINDING: The proposed use will not be detrimental or injurious to the general
welfare of the City as conditions of approval have been incorporated upon the issuance
of this permit. The City of Rosemead Public Safety Center has found no unusual
situation or concern at the subject site. Staff feels that the proposed Fresh and Easy
Neighborhood Market will not create negative impacts to the general welfare of the City.
D. The proposed use will not present problems including, but not limited to,
loitering, obstruction of pedestrian traffic, vehicular traffic, parking, crime, interference
with children on their way to school, interference with shoppers using streets,
defacement and damage to structures.
FINDING: The serving of off -sale beer and wine will not cause obstructions to
pedestrian traffic, vehicular traffic or parking. The applicant will be required to install an
automated surveillance system which will deter problems such as loitering and damage
of structures. Regular inspections by the City staff, State ABC and the Sheriff's
Department will ensure that the location is regularly monitored such that the serving of
beer and wine will not interfere with shoppers or result in defacement of surrounding
properties.
E. The proposed use will not lessen the suitability of any nearby commercially
zoned properties for commercial use.
FINDING: The proposed use will not endanger or otherwise constitute a menace
to the surrounding commercial properties, as conditions of approval have been
incorporated upon the issuance of this permit to uphold the integrity of the site and the

nearby properties. The majority of businesses along Rosemead Boulevard and Valley
Boulevard are retail, which will be in harmony with the proposed use.
F. The use shall not adversely affect the welfare of area residents or result in
undue concentration in the neighborhood of establishments" dispensing alcoholic
beverages, including beer and wine. Consideration shall be given regarding whether the
proposed use will detrimentally affect nearby residentially zoned communities,
considering distance to residential buildings, churches, schools, hospitals, public
playgrounds, and other establishments dispensing alcoholic beverages.
FINDING: The proposed use will not endanger, or otherwise constitute a
menace to, the surrounding properties, as specific conditions of approval will be in effect
upon the issuance of this permit. Although the Department of Alcoholic Beverage
Control has found that there is an 'overdue concentration" of off -sale beer and wine
licenses for this census tract, the City of Rosemead currently has no guidelines
specifying the maximum number of ABC licenses allowed in a census tract. Therefore,
all data obtained from Department of Alcoholic Beverage Control and other agencies is
only advisory information. The City of Rosemead Public Safety Center has also found
no unusual situations or concerns at the subject site. The applicant has also submitted
a letter of support, which indicated that alcoholic beverages are expected to comprise a
small percent of the store shelf- space. Furthermore, conditions of approval outlining
acceptable measures to mitigate any potential problems with the addition of alcohol
sales at this property will minimize the impact of undue concentration. Additionally, with
respect to undue concentration, the applicant will have to provide the burden of proof to
the State Department of ABC during their application permitting process.
SECTION 4. The Planning Commission HEREBY APPROVES Design Review
09 -04 for the construction of a 13,969 square -foot Fresh and Easy Neighborhood
Market and Conditional Use Permit 09 -03 for a new off -sale beer and wine (Type 20)
ABC license.
SECTION 5. This resolution is the result of an action taken by the Planning
Commission on July 6, 2009, by the following vote:

July 6, 2009
1. Design Review 09 -04 and Conditional Use Permit 09 -03 is approved for a
the construction of a new 13,969 square foot Fresh and Easy Neighborhood
Market and a new Off -Sale beer and wine (Type 20) ABC license, to be
developed in accordance with the plans marked Exhibit "C ", dated June 22,
2009. Any revisions to the approved plans must be resubmitted for the
review and approval of the Planning Division.
2. The conditions listed on this exhibit shall be copied directly onto any
development plans subsequently submitted to the Planning and Building
divisions for review.
3. Design Review 09 -04 and Conditional Use Permit 09 -03 is approved for one
(1) year from the Planning Commission approval date. The applicant shall
make progress towards initiation of proposed use, or request an extension
from the Planning Division within 30 days prior to expiration date.
Otherwise Design Review 09 -04 and Conditional Use Permit 09 -03 shall
become null and void.
4. The Planning Commission hereby authorizes the Planning Division to make
and /or approve minor modifications.
5. The following conditions must be complied with to the satisfaction of the

7. The applicant shall defend, indemnify, and hold harmless the City of
Rosemead or its agents, officers, and employees from any claim, action, or
proceeding against the City of Rosemead or its agents, officers, or
employees to attack, set side, void, or annul, an approval of the Planning
Commission and /or City Council concerning the project, which action is
brought within the time period provided by law.
8. Approval of Design Review 09 -04 and Conditional Use Permit 09 -03 shall
not take effect for any purpose until the applicant has filed with the City of
Rosemead an affidavit stating that they are aware of and accept all of the
conditions set forth in the letter of approval and this list of conditions.
9. The applicant shall comply with all Federal, State and local laws relative to
the approved use including the requirements of the Planning, Building, Fire,
Sheriff and Health Departments.
10. Building permits will not be issued in connection with any project until such
time as all plan check fees, and all other applicable fees are paid in full.
11. The numbers of the address signs shall be at least 6" tall with a minimum
character width of 1/4", contrasting in color and easily visible at driver's level
from the street. Materials, colors, location and size of such address
numbers shall be approved by the City Planner, or his or her designee, prior
to installation.
12. All requirements of the Building and Safety Division and the Planning
Division shall be complied with prior to the final approval of the proposed
construction.
13. Prior to issuance of building permits, all school fees shall be paid. The
applicant shall provide the City with written verification of compliance from
the School District.
14. The hours of construction shall be limited from 7 a.m. to 8 p.m. Monday to
Saturday. No construction shall take place on Sundays or on any legal
holidays without prior approval by the City.
15. The Planning staff shall have access to the subject property at any time
during construction to monitor progress.
16. The onsite public hearing notice posting shall be removed within 30 days

from the end of the 10 -day appeal period of Design Review 09 -04 and
Conditional Use Permit 09 -03.
17. Applicant shall obtain a public works permit for all work in or adjacent to the
public right -of -way.
18. All utilities shall be placed underground including facilities and wires for the
supply and distribution of electrical energy, telephone, cable television etc.
The underground conversion of these utilities shall consider all future
connections to the satisfaction of the Planning Division.
19. The developer shall comply with the City's storm water ordinance and Los
Angeles County's SUSMP requirements with respect to planning and
development of the site.
20. A "STOP" sign shall be clearly posted at all parking lot exits and it shall be
unlawful for any motorist to fail to stop at such sign before leaving the
parking lot.
21. Decorative paving shall be incorporated into all driveways and shall match
the color of the existing.
22. A detailed elevation drawing shall be submitted to the Planning Department
for review and approval of the trash enclosure prior to submittal of
construction drawings. All trash enclosures shall be of an integral part of
the building design, and incorporate complementary colors and materials,
including stone veneer. All trash enclosure doors shall be opaque, self -
closing and self - latching. Each trash enclosure shall also accommodate
both a trash bin and a recyclable bin.
23. The trash enclosure located along the east property line shall incorporate
building design elements of the "Fresh and Easy Neighborhood Market"
building, and shall be fully enclosed.
24. The trash enclosure located along the west property line shall incorporate
building design elements of the "Bank of the West" building, and shall have
a wood stained decorative trellis top. The exterior finish of the enclosure
shall incorporate stone veneer.
25. Adequate lighting shall be provided in the vehicle parking area. All exterior
lighting shall be fully shielded on all sides, and that are directed away from
adjacent properties. Wall packs shall be prohibited. Final light cut sheets
shall be reviewed and approved by the Planning Division prior to the
issuance of building permits.

26. The proposed monument sign located at the northwest corner of the lot shall
be low profile, and not exceed a height limit of 4' -0."
27. The drive -thru ATM proposed along the south property line shall match the
existing " "Bank of the West "" building in colors and materials.
28. Electronic shopping cart wheel locks shall be installed on all shopping carts
that are utilized on the site to contain all carts within the perimeter property
lines of the commercial development.
29. All parking stalls that abut a shopping cart storage facility shall be 11' -0"
wide.
30. A new 18" deep shield shall be installed on the existing light standard
located along the southeast corner of the lot to prevent light from impacting
the adjacent residential property. If the shielding is not sufficient, the light
standard shall be relocated.
31. Signs shall comply with Chapter 17.104 of the Rosemead Municipal Code
and the Commercial Revitalization Guidelines. Window signs shall not
cover more than 15% of any window. All signage for the Fresh and Easy
Neighborhood Market shall be reviewed and approved prior to the Planning
Division final inspection.
32. All roof top appurtenances and equipment shall adequately be screened
from view to the satisfaction of the Planning Division. There shall be no
mechanical equipment located on the sides of the building. Such equipment
shall not exceed the height of the parapet wall. All ground level
mechanical /utility equipment (including meters, back flow preservation
devices, fire valves, A/C condensers, furnaces, utility cabinets and other
equipment) shall be located away from public view or adequately screened
by landscaping or screening walls so as not to be seen from the public right
of way or other public space within the development. The Planning Division
shall approve said screening prior to installation.
33. The applicant/developer shall keep the electrical and mechanical equipment
and /or emergency exits free of any debris, storage, furniture, etc., and
maintain a minimum required clearance.
34. The site shall be maintained in a graffiti -free state. Any new graffiti shall be
removed within twenty -four (24) hours. A 24 -hour, Graffiti Hotline can be
called at (626) 569 -2345 for assistance.

35. The site shall be maintained in a clean, weed and litter free state in
accordance with Sections 8.32.010 - 8.32.040 of the Rosemead Municipal
Code, which pertains to the storage, accumulation, collection, and disposal
of garbage, rubbish, trash, and debris. All trash containers shall be stored
in the appropriate trash enclosure at all times. All trash, rubbish, and
garbage receptacles shall be regularly cleaned, inspected, and maintained
in a clean, safe, and sanitary condition.
36. The parking area, including handicapped spaces, shall be paved and re-
painted periodically to City standards to the satisfaction of the Planning
Division. In accordance with Chapter 17.84 of the Rosemead Municipal
Code, all designated parking stalls shall be double striped. Such striping
shall be maintained in a clear, visible, and orderly manner.
37. The parking space markers shall be re- painted periodically to City standards
to the satisfaction of the Planning Division, including double striping, wheel
stops and handicapped parking /markings.
38. At least two percent of the required parking shall be designated for handicap
space pursuant to California Vehicle Code Section 22511.8. A letter by the
property owner shall be given to the City for authorizing enforcement.
39. The developer /applicant shall provide bicycle racks. Bicycle racks shall be
provided to the satisfaction of the Planning Division.
40. All open area not covered by concrete, asphalt, or structures shall be
landscaped and maintained on a regular basis.
41. All awnings shall be periodically power washed and cleaned to eliminate dirt
and grime. The awnings shall be cleaned at least twice in any calendar
year.
42. A final landscape and irrigation plan shall be submitted to the Planning
Division prior to the issuance of building permits. The landscape and
irrigation plan shall include a sprinkler system with automatic timers and
moisture sensors. The existing landscaping along the west property line
shall be renovated with new landscape materials.
43. A permanent maintenance program of all landscaping shall be provided to
Planning Division insuring regular irrigation, fertilization and weed
abatement. Such maintenance program shall include but not limited to
name of firm to maintain the site and landscaped areas, phone numbers,
address, and contact person for the City to contact 24 hrs, 7 days a week in
case of emergency.

44. The developer shall show all existing utilities and parkway trees within the
public right -of -way prior to final approval of construction plans.
45. Decorative, colored, scored or stamped concrete shall be placed at all drive
entrances and shall match the existing in color and design.
46. The applicant shall comply with Ordinance No. 567, which requires the
posting of a sign prohibiting consumption of alcoholic beverages adjacent to
the premises within the parking lot and public sidewalks. Said signs are
subject to the review and approval of the Planning Division.
47. All requirements and appropriate licenses of the State of California and
California State Department of Alcoholic Beverage Control shall be
complied with and maintained at all times.
48. The hours of operation shall be posted in the front window or door. Hours of
operation shall be limited to 6:00 a.m. to 12:00 a.m., daily.
49. The hours for delivery shall be limited from 6:00 a.m. to 11:00 p.m., daily.
50. Prior to construction commencing, the contractor shall schedule a pre -
development meeting with the Planning Division staff to review the
conditions of approval and construction plans.
51. No exterior vending machines shall be permitted.
52. A 24 -hour electronic surveillance system shall be designed and installed to
the satisfaction of the Sheriff's Department, which shall include surveillance
of arrivals, departures, and parking areas from the store. It is the applicant's
responsibility to keep electronic (tapes) copies of surveillance for a minimum
of thirty (30) days.
53. Any outdoor storage associated with the use is expressly prohibited on the
premises.
54. Violations of the conditions of approval may result in citation and /or initiation
of revocation proceedings.

A COMMERCIAL / MIXED -USE DEVELOPMENT
CITY OF ROSEMEAD
INTRODUCTION
Kimley -Horn and Associates, Inc. has been retained by Grae Ventures, LLC to prepare a traffic impact study
for the proposed commercial/mixed -use development at the southeast comer of Rosemead Boulevard and
Valley Boulevard in the City of Rosemead. The project site is shown in its regional setting on the vicinity map
in Figure 1. A copy of the site plan is provided on Figure 2.
The Traffic Study will be prepared in accordance with the City of Rosemead criteria for preparation of traffic
impact studies. The study will address project - related traffic impacts on the surrounding street system. If
applicable, the report will identify necessary mitigation measures associated with project traffic impacts. The
study will address requirements in the Los Angeles County Congestion Management Program (CMP)
guidelines.
PROJECT DESCRIPTION
The proposed project is located on the southeast corner of Rosemead Boulevard and Valley Boulevard. The
proposed project is a commercial/mixed -use development consisting of a4,010 SF bank with a drive- thruATM
and 13,969 SF Fresh & Easy store. The project proposes to have the bank with drive -thru at the west end ofthe
site and the Fresh & Easy store at the northeast comer of the site. Currently existing on the site is a 4,010 SF
walk -in bank building in operation. Access to the site would be via three driveways, one right - in/right -out
driveway on Valley Boulevard and two full access driveways on Steele Street. The project is planned to open in
2009.
TRAFFIC IMPACT ANALYSIS
The impact of project traffic will be evaluated for typical weekday peak hour operations at ten study
intersections. The evaluation of traffic impacts will be conducted in accordance with the City of Rosemead's
"Transportation Impact Analysis Guidelines ".
The study will evaluate morning and evening peak hour intersection operating conditions for the following
conditions:

Signalized Intersection Analysis Methodology
In accordance with the requirements of the City of Rosemead, peak hour operating conditions at the
signalized intersections were evaluated using the Intersection Capacity Utilization (ICU) methodology. The
ICU methodology provides a comparison of the theoretical hourly vehicular capacity of an intersection to the
number of vehicles actually passing through that intersection during a given hour.
The ICU calculation assumes a per -lane capacity of 1,600 vehicles per hour (vph) for each travel lane
(through or turning lane) through the intersection. Dual turn lanes will be analyzed with a capacity of 2,880
vph total, which occurs at the southbound left -turn movement at Mission DriveNalley Boulevard.
At the westbound approach at Rosemead Boulevard/Lower Azusa Road, there is one exclusive left -turn lane
and one shared left/through/right lane. The ICU calculation for this situation assumes splitting the 1,600 vph
per -lane capacity by applying 800 vph of per -lane capacity to the left -tum movement and the other 800 vph
per -lane capacity to the shared through/right -turn movement. The total capacity for the left -turn movement
becomes 2,400 vph and the shared through/right -turn lane has a capacity of 800 vph. A clearance factor of
0.10 (10 %) of the total intersection capacity is included in the ICU calculation.
The ICU calculation returns a volume -to- capacity (V /C) ratio that translates into a corresponding Level of
Service (LOS) measure, ranging from LOS "A ", representing uncongested, free - flowing conditions, to LOS
7", representing severely congested, over - capacity conditions. A summary description of each Level of
Service and the corresponding V/C ratio is provided in the chart below:

Unsignalized Intersections— Highway Capacity Manual (HCM) Methodology
Unsignalized intersections are analyzed using the Highway Capacity Manual (HCM) methodology for two-
way stop - controlled intersections. This methodology estimates the average total delay (in average seconds
per vehicle) for each of the movements to or from the minor street, and determines the level of service for
each movement.
Just as with the ICU methodology, the HCM delay forecast translates to a Level of Service designation,
ranging from LOS "A" to LOS "F". The descriptions of operating conditions for each Level of Service are
very similar to the LOS descriptions for signalized intersections. A summary description of each Level of
Service for unsignalized intersections, and the corresponding delay, expressed in seconds per vehicle, is
provided on the following chart:

The intersection of Hart Avenue and Steele Street will be analyzed using this methodology.
TRAFFIC L%IPACT CRITERIA
The purpose of a traffic impact study is to identify the impacts of proposed development, and to determine
whether or not those impacts are significant. For a City intersection, a transportation impact for a project is
considered significant if the Project increases traffic demand by 2% of capacity (V /C? 0.02), causing LOS
"F" (V /C> 1.00). If the facility is already at LOS "F ", a significant impact occurs when the Project increases
traffic demand by 2% of capacity (V /C? 0.02). If determined to be significant, the Project would be required
to mitigate the project's traffic - related impacts.
EXISTING CONDITIONS
Existing Roadway System
Regional access to the project site is provided by the San Bernardino Freeway (I -10), which is oriented in the
east -west direction through the project vicinity and serves the project site via the interchange with Rosemead
Boulevard. Rosemead Boulevard (SR -19) is oriented in a north -south direction through the project area and
provides access to neighboring cities.
Local access to the project is provided by several local roads:
Rosemead Boulevard is a four -lane, north -south roadway, running adjacent to the west boundary of the
project site. In the project vicinity, Rosemead Boulevard provides two travel lanes in each direction, with
raised medians. No parking is allowed on either side of the street. The posted speed limit on Rosemead
Boulevard is 40 miles per hour. Metro bus lines 176 and 266 run along Rosemead Boulevard.

Valley Boulevard is a four -lane roadway with a two-way left -turn. Valley Boulevard runs in the east -west
direction and is located adjacent to the north boundary of the site. Valley Boulevard provides local and
regional access to the project and continues through El Monte to the east and San Gabriel and Alhambra to
the west. Two -hour parking is allowed on both sides of the street in the vicinity of the project. The posted
speed limit on Valley Boulevard is 35 miles per hour. Metro bus lines 76 and 376 run along Valley
Boulevard.
Steele Street is a two-lane, east -west local residential roadway, located adjacent to the south boundary of the
project site. Steele Street provides access to Rosemead Boulevard to the neighborhood to the south and east
of the project. Parking is allowed on both sides of the street and the speed limit is 25 miles per hour.
Existing Intersection Conditions
Existing lane configurations at the study intersections are shown on Figure 3. Morning and evening peak
hour turning movement traffic counts were conducted at the study intersections in May, 2009, and are
depicted on Figure 4. Copies of the traffic count data sheets are provided in Appendix A.
Existing morning and evening peak hour operating conditions were evaluated using the ICU methodology
for signalized intersections, as previously described. The results of the existing conditions analysis are
summarized on Table 1. Copies of intersection analysis worksheets are provided in Appendix B. Review of
Table 1 shows that the following intersections currently operate at unacceptable levels of service:

Project Trip Generation
Trip generation estimates for the proposed Commercial/Mixed -Use Development were derived from the
Institute of Transportation Engineers aTE) publication Trip Generation, 7th Edition. ITE Category 850,
Supermarket and Category 912, Bank with Drive -thru.
As mentioned previously, the project site is currently occupied by an existing bank without a drive -thru
ATM. The trips associated with the existing use can be taken as trip credit. ITE Category 911, Walk -in Bank
was used for the existing use trip credit.
The ITE Trip Generation Handbook, June 2004 edition was consulted to determine the pass -by factors for
the bank with drive -thru and the Fresh & Easy neighborhood market. The bank with drive -thru land use has a
pass -by rate of 471/6 and the supermarket land use has a pass -by rate of 36 %. Both percentages are applied to
the PM peak hour only. The ITE Trip Generation Handbook does not apply a pass -by reduction percentage
in the AM peak hour.
Trip generation rates and resulting trip generation for the project are summarized on Table 2. The resulting
net trips are the trips generated by proposed lane uses minus the trips due to pass -by and minus the trips
generated by the existing land use. Table 2 indicates that the Commercial/Mixed -Use Development will
generate a net of about 1,789 trips per day, with 46 inbound trips and 32 outbound trips in the morning peak
hour. The net trips in the afternoon peak hour, after subtraction of trips from the existing walk -in bank,
resulted in 30 inbound and 28 outbound trips. The resulting net trips are the added traffic to the roadway
network.
Project Trip Distribution and Assignment
Project trip distribution assumptions for the project site were based on proximity to regional arterials, local
arterials, residential areas, and discussions with City of Rosemead staff. Trip distribution assumptions are
shown on Figure 5. The resulting project trips to be added to the study area street system are shown on
Figure 6.

Existing Plus Project Conditions
Project traffic volumes were added to Existing traffic, and the resulting traffic volumes are shown on Figure
S. The study intersections were re- analyzed with these traffic volumes to determine the project's impact on
peak hour intersection operation.
The results of the Existing Plus Project analysis are summarized on Table 3. With the addition of project
traffic, the following intersections would operate at unacceptable levels of service:
• Rosemead Boulevard and Valley Boulevard (LOS E — PM Peak, project impact = 0.009)
• Rosemead Boulevard and Mission Drive (LOS E — AM, project impact = 0.004 and
LOS E - PM Peak, project impact = 0.005)
• Rosemead Boulevard and Lower Azusa Road (LOS E — PM Peak, project impact = 0.001)
• Rosemead Boulevard and Marshall Street (LOS E — PM Peak, project impact= 0.000)
The project impacts at the study intersections that are LOS E or worse is less than 2 %, and are therefore not
considered significant. Copies of intersection analysis worksheet are provided in Appendix B.
Project traffic from the east and southeast is anticipated to utilize Steele Street to access the two southern
driveways to the site. The additional project traffic along Steele Street is not considered to be significant.
The analysis of the Hart Avenue and Steele Street intersection results in LOS "A" and no significant impacts
with the addition of project traffic are anticipated.
CONGESTION MANAGEMENT PROGRAM COMPLIANCE
The Los Angeles County Congestion Management Program (CMP) was developed in response to California
Proposition 111, approved June 1990, and is intended to address regional congestion by linking land use,
transportation, and air quality decisions.
Among the elements of the CMP is a land use analysis program which "requires local jurisdictions to analyze
the impacts of land use decisions on the regional transportation system, for projects preparing and
Environmental Impact Report (EIR)."
The CMP document identifies the County's CMP Highway System, and requires that Level of Service E or
better be maintained on this network. The SR -60 Freeway is the nearest CMP facility in the study area.

Analysis of project impact on a freeway segment would be required of any project that would add 150 trips
or more in either direction during the AM or PM weekday peak hours. The project will not generate this
level of traffic in either peak hour, and is not expected to draw traffic from the freeway, since the bank and
Fresh & Easy neighborhood store are local uses. Therefore, further analysis of CMP facilities is not required
for CMP purposes.
An analysis of CMP monitored intersections is required if a project contributes 50 or more peak hour trips to
the CMP monitored intersections. The intersection of Rosemead Boulevard and Valley Boulevard is a CMP
intersection, adjacent to the project site. The project will contribute 50 or more peak hour trips to this
intersection, and therefore, it is evaluated in this study. The project would not contribute 50 or more peak
hour trips to any other CMP intersection.
A copy of the CMP Highway and Roadway System map is included in Appendix C.
SUMMARY OF FINDINGS AND CONCLUSIONS
• The proposed project is a commercial/mixed -use development consisting of a 4,010 SF bank with a
drive -thru ATM and 13,969 SF Fresh & Easy store. Currently existing on the site is a 4,010 SF walk -in
bank building in operation.
The analysis evaluated ten study intersections during the morning and afternoon peak hours in the
Existing Condition. The intersections of Rosemead Boulevard at Valley Boulevard, Rosemead
Boulevard at Lower Azusa Road, and Rosemead Boulevard at Marshall Street all operate atLOS "E" in
the afternoon peak hour. The intersection of Rosemead Boulevard at Mission Drive currently operates at
LOS "E" in both the morning and afternoon peak hour.
• A pass -by reduction of 47% was applied to the bank with drive -thru and 36% to the Fresh & Easy
neighborhood store. The pass -by reduction is only applied in the PM peak hour.
The proposed project would generate a net of 1,789 trips on a daily basis, with 46 inbound trips and 32
outbound trips in the morning peak hour. The net trips in the afternoon peak hour, after subtraction of
trips from the existing walk -in bank and applying the pass -by reduction, resulted in 30 inbound and 28
outbound trips. The net trips are the trips generated by proposed lane uses minus the trips due to pass -by
and minus the trips generated by the existing land use. The resulting net trips are the added traffic to the
roadway network.
• The study re- evaluated the ten intersections for the Existing plus Project condition during the peak
hours. With the addition of project traffic, the intersections of Rosemead Boulevard at Valley Boulevard,
Rosemead Boulevard at Lower Azusa Road, and Rosemead Boulevard at Marshall Street all would

operate at LOS "E" in the afternoon peak hour. The intersection of Rosemead Boulevard at Mission
Drive would continue to operate at LOS "E" in both the morning and afternoon peak hour. The project
impacts at those intersections will be less than 2% in both peak hours and are therefore not considered
significant.
The additional project traffic along Steele Street is not considered to be significant. The analysis of the
Hart Avenue and Steele Street intersection results in LOS "A" and no significant impacts with the
addition of project traffic are anticipated.

In support of its application for an Off Sale General license at the above referenced location, Fresh & Easy
Neighborhood Market Inc. submits the following information regarding how its store will not interfere with
its neighbors' quiet enjoyment of their property.
Tesco PLC is a United Kingdom based international supermarket chain. It is the largest British retailer, both
by global sales and by domestic market share, and the fourth largest retailer in the world. Currently, Tesco
operates over 2,700 stores world wide'and gross sale of over $71 Billion. As of now, Tesco operates
grocery stores in The United Kingdom, Ireland, China, Czech Republic, France, Hungry, Japan, Malaysia,
Poland, Slovakia, South Korea, Thailand, and Turkey.
Fresh & Easy will be a responsible retailer of alcoholic beverages. We've put considerable investment into
our systems and training to make sure alcohol is only sold to people of an appropriate age. Our selection of
alcohol is designed to compliment our range of products — for example, shoppers can pick up a bottle of
chardonnay and chicken lasagna on their way home from work. We also do not sell tobacco products in
out stores. Moreover, the sale of alcoholic beverages is not our primary purpose. In accordance with our
marketing standards and state law, Fresh & Easy will adhere to the following retail operating standards:
BASIS FOR SUPPORTING OFF -SITE ALCOHOLIC BEVERAGE SALES AS AN
INTERGAL PART OF THE PROPOSED PROJECT
1. The convenience of Fresh & Easv's Neighborhood Market Concept
Fresh & Easy's success is largely a result of building local businesses with local people. Fresh &
Easy Plans to hire all employees locally offering competitive pay and great benefits for all
employees working over 20 hours per week and will employ 6 — 8 people during peak hours. The
stores reflect the markets and communities they serve and therefore we would like to operate from
6 am to midnight with the option to extend to 24 hour operation with City approval. Everywhere
the goal is the same, to bring quality, service, and choice, at a competitive price, to the heart of local
neighborhoods.
Fresh & Easy proposes to build a neighborhood grocery market that provides a large diversity of
food. A Fresh & Easy Neighborhood Market is intended to provide a broad array of products for
the consumer's convenience. Fresh & Easy plans to offer an extensive inventory with the aim of
fulfilling their customers' everyday grocery needs. They will stock a wide range of both fresh and
ambient lines including dairy, meat, fresh fruit and vegetables, baked goods and other grocery
items. Fresh & Easy will invest in modernizing the store and improving the overall image of the

Although alcoholic beverages are expected to comprise a small percent of the store shelf- space, it is
nevertheless necessary in order to provide Fresh & Easy customers with a complete range of
products. Thus, alcoholic beverages are a key element of the Fresh & Easy Neighborhood Market
store. By providing a whole host of products, including alcoholic beverages, readily available to the
consumer at this Fresh & Easy store, the public convenience of the area will certainly be served.
Without it, a customer may be obliged to travel to a range of retail outlets in order to complete his
weekly shopping.
2. Security and Control
Fresh & Easy is committed to taking all feasible steps to address law enforcement concerns about
the site. In addition, Fresh & Easy has an extensive employee- training program and is a responsible
retailer of alcoholic beverages. Moreover, the sale of alcoholic beverages is not our primary
purpose.
Fresh & Easy facilities are designed to provide a safe environment for patrons and employees. To
that end, the following design elements are incorporated into our security plan. Security measures
include: adequate lighting levels both on the interior and exterior of the store, employee supervision
of the facility, and closed circuit video monitoring system -with cameras located strategically
throughout the property.
Fresh & Easy understands the importance of maintaining the appearance of a facility to both
expanding out customer base and preventing criminal activity. Fresh & Easy's store and property
maintenance program includes timely graffiti and litter removal, repairs to structures and
replacement of dead or diseased plant material, signs and curb painting to encourage parking in
designated parking spaces and strategic trash receptacle placement.
Fresh & Easy is committed to a neighborhood grocery market that allows for safe family oriented
shopping. This is achieved by placing large windows along the front of the building so that passing
motorists and police have a direct view into the facility. Fresh & Easy will:
1. Mount a video camera inside the premises in such'a position as to be visible to patrons yet
not accessible by teach.
2. Post in English and the predominant language of the facility's clientele a notice that
California state law prohibits the sale of alcoholic beverages to persons who are under the
age of twenty-one (21) years and no such sales will be made.
3. Ensure that no more than 33 percent of the square footage of the windows and clear doors
bear advertising or signs of any sort, and all advertising and signage shall be placed and
maintained in a manner that ensures that law enforcement personnel have a dear and
unobstructed view of the interior of the premises, including the area in which the cash
registers are maintained, from the exterior public sidewalk or entrance.
4. Post and maintain a professional quality sign stating "No loitering is allowed on or in front
of these premises."
5. Post and maintain a professional quality sign stating `No open alcoholic beverage
containers are allowed on these premises."
6. Equip the parking lot of the premises with lighting of sufficient power to illuminate and

make easily discernible the appearance and conduct of all persons on or about the parking
lot. Additionally, the position of such lighting shall not disturb the normal privacy and use
of any neighboring residences.
7. Any graffiti painted or marked upon the premises shall be removed or painted over within
120 hours of discovery thereof.
8. Litter shall be removed daily from the premises, including adjacent public sidewalks and all
parking areas under the control of the licensee.
9. All areas under control of the licensee shall be swept or cleaned, either mechanically or
manually, on a weekly basis to control debris.
10. If location becomes a high gathering spot, the management shall comply with any request
by the Police Department that the Department feels necessary, in order to keep the peace.
11. All store employees are trained with the TIPS (Training for Intervention Procedures) liquor
awareness training program.
12. All beer is sold in quantities of six packs or larger.
Fresh & Easy recognizes the seriousness of loitering, delinquency, crime and underage drinking.
Therefore, Fresh & Easy markets have developed stringent operational standards and training
programs to teach techniques for the lawful selling of alcoholic beverages. Also, Fresh & Easy
requires all employees selling alcoholic beverages to execute an ABC "Clerk's Affidavit" (ABC -299)
which contains a review -of ABC laws.
3. The site will not result in an adverse impact on public health, safety, or welfare
Presently, the site does not negatively impact public health, safety, or welfare. In fact, by providing
new safe and convenient location to make grocery purchases, public health, safety, and welfare have
been advanced by this site. The addition of selling alcoholic beverages will not change this, But
beyond this, it should be noted that Fresh & Easy has a very extensive training program for its
employees to help ensure that it is a responsible retailer of alcoholic beverages. There are both oral
and written aspects to Fresh & Easy's training program to ensure that employees understand and
implement the procedures imposed by Fresh & Easy to comply with ABC laws and regulations.
In short, Fresh & Easy is committed to protecting the public health, safety, and welfare of the
community, and will take appropriate steps to do so.
CONCLUSION
Fresh & Easy will not interfere with the residents' quiet enjoyment of their property because the premises
will be improved as necessary for the conduct of this type of business, and will agree to conditions that will
ensure that the store is operated in a manner that prevents an adverse impact on the neighborhood.
Permitting the sale of alcoholic beverages at this site will `round -out' Fresh & Easy's neighborhood market
concept, providing customers the added convenience to make purchases of alcoholic beverages along with
their weekly grocery needs. Fresh & Easy, by reason of its location, character, manner and method of
operation, merchandise, and potential clientele, will serve the community of Rosemead. Based on the
foregoing, Fresh & Easy Neighborhood Market, Inc. respectfully requests that the City of Rosemead grant a
finding of Public Need and Convenience for the Fresh & Easy alcoholic beverage license.
