JULY 26, 1994
The Regular Meeting of the Rosemead City Council was called to
order by Mayor Bruesch at 8:05 p.m. in the Council Chambers of City
Hall, 8838 E. Valley Boulevard, Rosemead, California.
The Pledge to the Flag was led by Councilmember Vasquez.
The Invocation was delivered by Pastor Dennis Alexander
ROLL CALL OF OFFICERS:

APPROVAL OF MINUTES: JULY 12, 1994 - REGULAR MEETING
PRESENTATIONS: - NONE
I. ORAL COMMUNICATIONS FROM THE AUDIENCE
A. Juan Nunez, 2702 Del Mar, Rosemead, asked for a definition
of "vagrancy" and "loitering." He noticed that there seems to be a
problem at Beach's Market and at Pine and Garvey, and near the donut
shop. /

City Attorney Kress responded that an ordinance approved by the
Los Angeles County Board of Supervisors will be considered by the
City Council in the future and will deal with those issues. He
stated further that vagrancy or homelessness is a "status," not a
crime, and that a person cannot be guilty of a "status." The Courts
have held ordinances and enforcement programs to be Constitutionally
invalid.
Mr. Nunez also inquired if the City has an ordinance prohibiting
posting of signs on utility posts and fences and how long City flags
remain flying after a holiday.
City Manager Frank Tripepi responded that staff will investigate
the matter.

Mayor Pro Tem Taylor questioned Page 2, Department of Animal
Control fee of $5083.14 for June 1994 Housing Service.
City Manager Frank Tripepi responded that staff will prepare a
memo with a breakdown of costs.

that Resolution No. 94-35 be adopted with the deferral of the
Department Animal Control fee $5083.24 Housing Service. Vote

C. ORDINANCE NO. 744 - ADOPTING HOTEL AND MOTEL REGULATIONS -
INTRODUCE
The following ordinance was presented to the Council for
adoption:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD
ADOPTING HOTEL AND MOTEL REGULATIONS
Mayor Bruesch inquired if the ordinance could. be incorporated
into the same section of the City Municipal Code. He stated that it
is repetitive and confusing to have this item in different sections.
City Attorney Kress responded that the ordinance deals with the
business regulations aspect and not zoning or land use.
Mayor Bruesch deferred this item to the next meeting.
Councilmember Imperial inquired whether Page 2. Section 6092
allows outside agencies to check the books of hotels and motels. He
stated that such a situation could hinder the coordination of
different agencies.

Councilmember Imperial also inquired about the definition of a
"lodging house" Section 6904..
City Attorney Kress responded that a lodging house is usually
like a fraternity house.
Councilmember Imperial asked that "other than a residence" be
added in place of "lodging house".
Councilmember Clark inquired about the necessity of having the
verbiage of Section 6902 state that every peace officer will have
access to checking the hotel and motel log books.
City Attorney Kress responded that Steve Willkomm, License
Investigator, requested the inclusion of language clarifying his
authority. Mr. Kress indicated also that this Section could be
changed.
Mayor Bruesch stated this item be deferred and rewritten to be
part of the Zoning Code.
D. ORDINANCE NO. 745 - A POLICY TO EXEMPT BUILDING PERMIT
APPLICATIONS FROM PUBLIC WORKS IMPROVEMENT REQUIREMENTS IF
THE CONSTRUCTION IS A RESULT OF FIRE DAMAGE OR ACTS OF GOD -
ADOPT
The following ordinance was presented to the Council for
adoption:

V. MATTERS FOR DISCUSSION & ACTION
A. GARVEY AVENUE PEAR HOUR PARKING RESTRICTION STUDY
Mayor Pro Tem Taylor stated that he cannot support this program.
Employees will be forced to park their vehicles on residential
streets with no time limitations.
Mayor Bruesch stated that he is in favor of stop light
synchronization.
Councilmember Imperial stated that he opposes this item because
businesses will be destroyed along Garvey Avenue.
Councilmember Clark stated that she is in agreement with the
Council, but is concerned with off-street parking in residential
areas. She indicated that this situation would be unfair for those
residents.
Mayor Pro Tem Taylor expressed his concern about the wording in
the Resolution regarding syncronization and performing "appurtenant
work as may be necessary." He indicated that such work may result in
removing parking spaces along Garvey and putting them onto.
residential streets.
City Engineer Al Rodriguez responded that the hardware installed
in the traffic signals will coordinate the signals and result in a
reasonable flow of traffic through Rosemead. The "appurtenant work"
may deal with loops.or minor signing and not with peak hour parking
restrictions.
MOTION BY COUNCILMEMBER IMPERIAL, SECOND BY COUNCILMEMBER VASQUEZ
that Council direct staff to write a memorandum from the Council to
the L. A. County Department of Public Works in support of traffic
light synchronization, but is opposed to peak hour parking
restrictions on Garvey Avenue. Vote resulted:

Mayor Bruesch directed staff to have this item on the Consent
Calendar with the necessary corrections at the next Council Meeting.
B. REQUEST FOR PAYMENT FOR ANNUAL DUES FOR SAN GABRIEL VALLEY
COUNCIL OF GOVERNMENTS
Mayor Pro Tem Taylor asked about the membership fees for the
League of California Cities and California Contract Cities
Association and expressed his concern that the SGVCOG dues for the
first quarter are over $8700.

Mayor Bruesch responded that two portions of the dues are not
considered dues. SGVCOG will be hiring a firm to do an assessment of
air quality and transportation problems. If the study is not done in
consortium with other cities, then Rosemead will have to do a study
singly which would be more costly. It is vital that Rosemead be a
part of SGVCOG as a cost saving measure because those studies are now
a requirement.

Councilmember Clark commented that it is important for the City
to be involved in SGVCOG because the organization has already proven
to be effective in changing the focus of the air quality management
plan and will be involved in the implementation mechanism. Secondly,
SGVCOG has developed a strategy for changing or stopping the Western
Riverside Council of Governments Balanced Development from taking
money from job rich areas such as the San Gabriel Valley, to housing
rich areas such as theirs.
MOTION BY COUNCILMEMBER CLARK, SECOND BY COUNCILMEMBER VASQUEZ
that the City Council authorize the necessary expenditures from the
General Fund, Prop A, and Air Quality Program fees. Vote resulted:

VII.MATTERS FROM OFFICIALS
A. COUNCILMEMBER IMPERIAL

1. Asked what the City's policy is on independent
contractors painting curbs. City Manager Frank Tripepi responded
that telephone calls from residents inquiring about the painter's
flyers are given to the Sheriff's Department and that the Deputies go
to the site to explain that the City provides this service on a
periodic basis. Mr. Tripepi stated also that contractors were
notified whenever possible.
C. MAYOR BRUESCH
1. Directed staff to include a warning in the next City
newsletter.
VIII. ORAL COMMUNICATIONS FROM THE AUDIENCE
A. Juan Nunez, 2702 Del Mar Avenue, spoke about parking on
Garvey Avenue during peak hours and stated that the installation of
the parking medians were detrimental.
