REQUIREMENTS IF THE CONSTRUCTION IS A RESULT OF FIRE
DAMAGE OR ACTS OF GOD
Attached for your consideration is Ordinance No. 745 which exempts building permit
applicants from public works improvement requirements if the building permit is a result of
fire damage or acts of God. Currently, if a building permit improvements have a valuation
of $10,000 or more (excluding swimming pools), public works improvements shall be assessed.
RECOMMENDATION
It is recommended that the Rosemead City Council introduce Ordinance No. 745

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA EXEMPTING BUILDING PERMIT
APPLICATIONS FROM PUBLIC WORKS IMPROVEMENT
REQUIREMENTS IF THE CONSTRUCTION IS A RESULT OF
FIRE DAMAGE OR ACTS OF GOD
THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Section 8110(b) of the Rosemead Municipal Code is hereby amended to
read as follows:
8110. REQUIREMENTS FOR CONSTRUCTION OF SIDEWALKS.CURBS
AND GUTTERS AND PLANTING OF STREET TREES IN
CONJUNCTION WITH BUILDING CONSTRUCTION
(b) Any owner, lessee, occupant or agent constructing or causing the
construction, in any zone, of any building, dwelling, building addition or
repair (whether interior or exterior), garage, carport, or other accessory
building or structure (excluding swimming pools) estimated by the
Building Department on building plans to have a value of $10,000 or
more (except building permits for reconstruction as a result of fire
damage or acts of God such as, earthquake, and storms), shall close all
driveway approaches not in use or which are considered to be unsafe for
ingress or egress; shall construct sidewalks, curbs, gutters and shall
install street trees in accordance with city standards, unless sidewalks,
curbs gutters and street trees already exist, on the street frontage of the
parcel of land on which the building or structure is to be constructed;
and such improvements substantially conform with to city standards and
are in good condition and repair; except that on lots exceeding one-half
acre in size, said sidewalks, cubs, gutters and street trees need be
installed only along that portion of the subject lot.

INTRODUCE
The following ordinance was presented to the Council for adoption:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD
ADOPTING HOTEL AND MOTEL REGULATIONS
Mayor Bruesch expressed his concerns that the City may already
have an ordinance addressing the issue of renting a room more than
once a day and prohibiting monthly rates. Staff was directed to
research this matter and attach the previous ordinance to the current
one for comparison. It was agreed that this item will be deferred to
the next regular meeting.

The following ordinance was presented to the Council for adoption:

Juan Nunez, 2702 Del Mar Avenue, Rosemead, asked if there will be
a record of when this work is being done:
City Manager Tripepi responded that the applicant will need to
apply for a reconstruction permit for the damage done and will be
exempted from having to put in street trees and public improvements as
a result of going over the $10,000 threshold.
