TRIPEPI, CITY MANA DATE: OCTOBER 4, 1994 RE: APPROVAL OF ENTERTAINMENT PERMIT FOR CAFE L'AMOUR, 8450 VALLEY BOULEVARD, #106 Pursuant to the;Rosemead Municipal Code, an Administrative Hearing was held on September 21, 1994 regarding the approval of an Entertainment Permit for Cafe L'Amour, 8450 Valley Boulevard, #106. This establishment is a cafe serving non-alcoholic beverages. The owner wishes to allow customers to sing with a "karaoke" machine. The requested hours of operation are Monday through Sunday, 8:00 p.m. to 1:00 a.m. Staff is recommending approval of the Entertainment Permit contingent upon the attached conditions. Attached for your information are the following items: 1. List of Conditions. 2. Copy of the Sheriff's Department License Detail Investigator's report. 3. Copy of the minutes of the Administrative Hearing on September 21, 1994. RECOMMENDATION It is recommended that the Rosemead City Council grant an Entertainment Permit to Cafe L'Amour, 8450 Valley Boulevard, #106. Entire premises is subject to inspection by the Sheriff's Department at any time. Any locked or otherwise secured doors will be opened upon demand. 2. No alcoholic beverages shall be brought on to the premises and/or maintained on the premises and no alcoholic beverages shall be sold, served, given away and/or consumed on the premises. 3. No entertainment that would violate City of Rosemead Ordianance No. 747 [Adult Businesses], or any successor ordinances thereto, shall-be permitted on the premises. 4. The main entrance door to the premises, and any other doors leading to the outside, must be closed when playing or utilizing the karaoke equipment or otherwise playing any music. 5. The floor plan and room use will not change without Sheriff's approval. 6. One uniformed security guard licensed,by the State of California shall be stationed in the parking lot of the premises on Friday and Saturday nights from 9:00 p.m. until one-half hour after closing (9:00 p.m.- 1:30 a.m.). The security guard shall assist the licensee and its management in enforcing these conditions and cooperate fully with the Sheriff's Department. 7. Because loitering tends to promote violence, the licensee and its management shall prevent loitering inside the premises and in the parking lot and will include in the duties of the security guard the requirement that he/she not permit loitering in the parking lot or inside the premises. 8. Any violation of any applicable state law, the Rosemead Municipal Code and/or these conditions will be grounds for suspension and/or revocation of this entertainment permit. Wagner, at 10:11 a.m. The Hearing officer then requested that everyone in attendance to state their name for the record. Andrew Nguyen, owner, Steve Willkomm, Sheriff's Business License Investigator, Peter Lyons, Planning Director and Jan Saavedra, Business License Clerk. The Hearing Officer then asked Mr. Willkomm to report on the Sheriff's investigation. Mr. Willkomm stated that the location is a cafe serving non-alcoholic beverages and provides karoake entertainment for the customers only. The business hours are Monday through Sunday, 8:00 p.m. to 1:00 a.m. Mr. Willkomm stated that the Sheriff's Department is recommending approval of the Entertainment Permit contingent upon the conditions of approval. The Hearing Officer then asked if the Planning Department had anything to say regarding the business. Mr. Lyons stated that there had been some criminal activity adjacent to the center in the parking lot, and that he felt that the presence of the uniform security guard would be a very good idea. Other then this, the Planning Department had no problems with the business. The Hearing was then closed at 10:20 a.m. Respectively Submitted 9r OL~ JAN ~AAVEDRA z The Mayor declared said motion duly carried and so ordered. i CC-F AUTHORIZATION TO SEEKS BIDS FOR THE FORT PLAY AREA AT ROSEMEAD PARK - CONCRETE WALK WAY Mayor Pro Tem Taylor asked if the sidewalk approach could be on the southside of the Fort area as the proposed walk way area would interfere with kids playing on the north east hillside. Mr. Taylor further stated that he is opposed to the project as is. Michael Burbank, Director of Parks and Recreation responded that would create too much distance and the ramp would then be on the west side of the pool. Mayor Pro Tem Taylor suggested switchback walk ways. Mr. Burbank stated that there would not be enough distance for handicapped chair platforms. Mayor Pro Tem Taylor asked that this item be deferred for further investigation by staff. Mayor Bruesch asked if the two items on the Consent Calendar will be done separately or simultaneously. Mr. Burbank stated that they will be bid and constructed separately. The ramp will be constructed first. CC-H APPROVAL OF ENTERTAINMENT PERMIT FOR CAFE L'AMOUR, 8450 VALLEY BOULEVARD, 1106 Councilmember Imperial stated he has observed people sitting on the sidewalk at night. Steve Willkomm, Business License Investigator indicated that the problem has since been handled. Mayor Bruesch asked if there was sufficient parking for that business. Councilmember Imperial responded that their is sufficient parking at present, but when stores are fully occupied, there might be a problem. Mayor Bruesch stated that he agreed with Councilmember Imperial and that a study was needed of karaoke businesses impacting parking. Peter Lyons, Planning Director, stated that the anchor space at that location is vacant with no current proposals for occupancy. Councilmember Clark asked if on the original approval were there any restrictions as to how many restaurants would go into that center? Mr. Lyons responded that the center has a square footage restaurant space allowable and the center is at that point now. No more restaurants will be allowed at that location. Mr. Lyons stated that their department will be very cautious as to what type of usage will be going into the center. Juan Nunez, 2702 Del Mar Avenue, Rosemead, stated that some types of karaoke establishments cause problems and hopes that this one does not. Mayor Bruesch stated that for the record, a lot of businesses offer karaoke without any problems and that in the future, caution over potential parking problems should be considered. CC 10-11-94 Page #3 a1 C ` Mayor Pro Tem Taylor asked about the number of karaoke permits t issued by the City. f ' Don Wagner, Assistant City Manager, responded that there are approximately eight or nine karaoke permits at this time.. Mayor Pro Tem Taylor asked if there were any problems, primarily parking problems. Frank Tripepi, City Manager, responded that there have not been any parking problems. Mayor Bruesch stated that this item will be deferred. B.
