3366 SAN GABRIEL BOULEVARD (7-ELEVEN/ CITGO)
Mr. Stephen A. Jamieson, representing Urban Development, has submitted an appeal request, appealing
the Planning Commission decision on an application for a Conditional Use Permit (CUP) for the issuance
of an Off-Sale Beer and Wine (Type 20) ABC license in conjunction with a gasoline station (Citgo)/
convenience market (7-Eleven) to be located at 3366 San Gabriel Boulevard.
In addition to the CUP application for the ABC license, the applicant also filed Tentative Parcel Map
26406 and Conditional Use Permit 01-833 for the consolidation of three parcels for the development of a
gasoline station with a convenience market. The Parcel Map and convenience market/gas station CUP
were approved by the Planning Commission, only the CUP for the ABC license was denied.
A public hearing before the Planning Commission for this development was held on August 6, 2001.
Following discussion and public comment, the Commission unanimously voted to approve Tentative
Parcel Map 26406 and Conditional Use Permit 01-833. Because of the undue concentration of off-sale
beer and wine licenses in the census tract where this project lies and because of the past denials of such
permit requests, the commission voted to deny Conditional Use Permit 01-832.
No appeal was filed as to the Tentative Parcel Map for the consolidation of the three parcels or as to CUP
01-833 for the operation of the convenience market. Thus, both of these approvals stand with the
conditions imposed by the Planning Commission. The only issue on appeal to the Council is the
proposed off-sale alcohol sales (CUP 01-832).
RECOMMENDATION
It is recommended that the City Council DENY the appeal to the Planning Commission decision on
August 6, 2001, denying Conditional Use Permit No. 01-832 for the issuance of an Off-Sale Beer and
Wine (Type 20) ABC license in conjunction with a gasoline station (Citgo)/ convenience market (7-
Eleven).
However, should the City Council choose to APPROVE this appeal, staff would recommend the
following conditions be added to the list of conditions for the project.
