On-Sale Beer (Type 40) Alcohol License
9544 E. Valley Boulevard, dba Casa Carlos Restaurant
Conditional Use Permit 84-291 (CUP) was initially approved by Rosemead's Planning
Commission on March 19, 1984. This permit authorized issuance of an on-sale, beer only license.
Ms. Noemy Mendez has operated this license in conjunction with a restaurant, dba Casa Carlos,
since 1984. In addition, an on-sale beer (Type 40) license has been active at this location since
1973. CUP 84-291 has been granted seven (7) extensions which are good through December 4,
1998.
On August 27, 1996, the State Department of Alcoholic Beverage Control (ABC) contacted the
Planning Department. They noted that Ms. Mendez neglected to pay her renewal fees which
caused the ABC to revoke her license on January 31, 1996. Ms. Mendez has taken the necessary
steps to reapply, but the ABC law requires that this application be treated as a "new" license.
Section 23958.4 of the Business and Professions Code of California requires this type of on-sale
type license to be reviewed by the local governing body if it is located in an area where there is
an over-concentration of licenses, or if it is in a high crime area. The local body must determine
that public convenience or necessity would be served by the issuance. A letter from ABC dated
October 10, 1996, summarizes this data.
This site is not located in an area of over-concentration. However, it is in a crime reporting
district that is considered to have a high crime rate. The applicant has cleaned up the site and has
not had any reports of criminal activity related to alcohol. Only two incidents were reported at
this address in the past five years, and they were robberies. In addition, staff finds that although
the state license was not renewed, Ms. Mendez still has a valid CUP with the City through 1998,
and this site has been used in this capacity since 1973.

RECOMMENDATION
Staff recommends that the City Council determine that the public convenience or necessity would
be served by the issuance of a Type 40 license at 9544 E. valley Boulevard.
