DISCUSSIO
Conditional Use Permit 96-668, requesting a permit to develop a second residence with 3,371
square feet of floor area was reviewed by the Planning Commission on September 16, 1996.
The Commission was split in their decision to approve the project with a vote of 2-2-1.
Therefore, no action was taken on this project. The staff report(s) and minutes are attached
for your review.
There were a number of issues involved with this CUP application. The Commission had
some concerns with the fact that this application had been continued five (5) times. It was
continued in order to reduce the size and create more architectural relief so that building did
not appear so massive. In addition, the applicant failed to attend the September 16, 1996
hearing on the item to discuss the Commission's concerns. Rather than continue the item one
more time, the Commission brought the issue to a vote. The resulting 2-2-1 vote, in effect,
defeated the CUP application.
The Commissioners expressed a concern with the number of existing cars on the site and that
this number could potentially increase if this house were built. On the other hand, the
Commissioners in favor of the project supported the effort and the changes that were made.

One Commissioner abstained because he was not present for the initial hearings when the
project was continued. No public comments were received relative to this item.

On September 20, 1996, the City Clerk received a written appeal of the decision from Mr. Lian
Li, who is the applicant of the project. A copy of the appeal letter is attached for the City Council
to review. The applicant is appealing to the City Council for a decision on this project. Should
the Council choose to approve this CUP, there are two findings that must be made. The Council
must find that the proposed project:
Will not affect the character nor be injurious to property or improvements of the
surrounding neighborhood, and
Has architecture that is compatible with the surrounding neighborhood.
The staff report submitted to the Planning Commission on September 16, 1996 provides an
analysis of this project. This report shows how this project could meet the required findings.
RECOMMENDATIO
Should the City Council choose to grant the applicant's appeal, it would be appropriate to
approve Conditional use Permit 96-668, subject to the conditions listed in Exhibit "A".
