This item was continued from the November 12 City Council meeting. The applicant's
representative was given direction for some changes to bring back before the Council. A
revised plan was submitted on November 20.
The living area has been reduced from 3,370 square feet to 2,950 square feet. They were able
to reduce the area by eliminating a large game room from the second floor. This reduces the
floor area ratio from 35.6% down to 31.7% (including the existing 1,250 square foot unit). In
addition, the house now provides a 2-car garage rather than a 3-car garage. This removes
another 200 square feet of building area and allows for a larger yard/play area between the two
homes.
The north side of the house has been pushed back to a full ten (10) feet except for an area of
the family room. In addition, the plans show the location and orientation of the neighboring
houses. Both neighboring lots have been developed with driveways that separate their lot and
the subject lot. This provides significant buffer (at least 20-feet) between the structures. Staff
finds that allowing the family room to project to the 5-foot side set back will reduce the mass of
the side elevation and provide some architectural relief.
A balcony that was located on the rear of the second floor (off the master bedroom) has been
eliminated in order to reduce the privacy impact to the neighboring property. Two windows along
the north wall of the master bedroom have also been removed. The remaining windows are
mostly taller windows in the bathrooms and at the staircase.

There is one regular window in the bedroom located on the north side of the building. This
window is required under. the Building-Codes for an emergency exit. If privacy is still an issue,
a condition can be added to require the lower half of the window to use opaque glass. Condition
#16 includes language that would allow the Director of Planing to determine the location(s) where
windows should be modified..
Another area where there was a technical change is the rear yard set back. The original plans
showed the existing house to have an 18-foot rear yard. The draftsman measured the set back for
accuracy and found the rear yard to be 19-feet from the garage and 23-feet from the living area.
The code requires a 15 feet for an attached garage, and 25-foot rear yard setback for living area,
in the R-1 zone.
Staff finds that although the subject home has been reduced in size, the owners can still expand
the rear house up to 2,500 square feet. Therefore, staff recommends adding a condition that will
require a modification of Conditional Use Permit 96-668 if any additional living area is added to
either the front or rear house. Such a modification would require additional review and a public
hearing by the Planning Commission. Condition N1 includes language to address this issue.
RECOMMENDATION
Should the City Council choose to grant the applicant's appeal, it would be appropriate to
approve Conditional use Permit 96-668, subject to the conditions listed in Exhibit "A".
