Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Councilman Taylor. The Invocation was delivered by City Treasurer Foutz. ROLL CALL OF OFFICERS: Present: Councilmen McDonald, Taylor, Vasquez, Mayor Pro Tem Bruesch, and Mayor Clark Absent: None APPROVAL OF MINUTES: FEBRUARY 23, 1993 - REGULAR MEETING MOTION BY MAYOR PRO TEM BRUESCH, SECOND BY COUNCILMAN TAYLOR that the Minutes of the Regular Meeting of February 23, 1993, be approved as submitted. ORAL COMMUNICATIONS FROM THE AUDIENCE A. Jim Weidner, 10028 Newville, Downey, representing the Garvey Education Association, spoke about the increased gang activity around the schools and offered his assistance where needed to try to alleviate these problems. B. Juan Nunez, 2702 Del Mar Avenue, Rosemead, spoke against giving money to the Gas Company when it is one of the litigants of the operating Industries lawsuit. VERBATIM DIALOGUE FOLLOWS: JUAN NUNEZ: I want to speak on the Animal Control. What is the contract call for on Animal Control? FRANK G. TRIPEPI, CITY MANAGER: In what respect, Juan? NUNEZ: Is this a 24-hour service or what? TRIPEPI: If you'd like to come and visit me, we can pull the contract out and we'll go through it page by page. I don't have the contract with me, Juan. NUNEZ: I would like to talk about it, now. I caught an animal Saturday morning. I called them at about 11:50 in the morning. I called a 800 number which was given to me, 800-253-3555 and I understand that's a place where they'll report to some other station to go and pick up the animals. It wasn't picked up. I called Temple City Station at 3:40 as you mentioned if I have any problem to call them and tell them I want to talk to you or for them to talk to you. They said they couldn't do that and I told them to report it. I called them again at 6:30 p.m. and nothing happened. I finally called Judy Meraz at 813-1400 and the phone rang and clicked like it was shut off or picked up. I couldn't tell. I called again, same thing happened. Then, I called again and someone answered and said that they wouldn't pick up the dog until Monday, that they were short-handed or for me to bring it in. I called again on Sunday, the 28th, and got the same response and the dog wasn't picked up until 5:15 (on Monday) after I called you at 4:15 (on Monday) cause I... CC 3-9-93 Page #1 i TRIPEPI: If that's the same animal that you called me about, Mr. Nunez, that was, you reported that to me, we have a log entry from the Animal Control showing that someone showed up at that location on Saturday to pick up the live animal. They have the person that they contacted. We asked you about that. You said you don't know that person. They don't have a last name on the person, just the first name. But after not being able to contact you and get the dog, t7iey left the location. NUNEZ: Saturday? TRIPEPI: Yes, sir. NUNEZ: I know it was there in front of my truck. It was there all day when I picked it up. TRIPEPI: Were you at home on Saturday waiting for the Animal Control? Cause they said they went to the house to find you but... NUNEZ: Somebody was home all the time. TRIPEPI: Okay. All I can tell you is we have a log entry and I know Mr. Stewart went out, explained that to you. I know that Judy Meris called you and explained the same thing to you, that someone showed up on Saturday. NUNEZ: I didn't get the call, my wife did. TRIPEPI: Okay. But for whatever reason, that wasn't mentioned this evening when you were giving your times. But there's a log entry that was shown where someone did show up on Saturday. NUNEZ: Well, I don't know. It so happens that I was in New Mexico the 19th I believe, they called at my house that they were supposed to pick up a cat. I wasn't even home to have called or that was the 19th of January and when Don called me that somebody had answered the call or somebody had responded I couldn't remember whoever it was but then finally I remembered that two blocks down over at Fern there's a man named Ector, so I went over there and asked him, he said we were around here all day Saturday, nobody came up. So, whatever the mix up was I'm just letting you know that this is the problem that we're having. TRIPEPI: Appreciate it. TAYLOR: Madam Mayor. I'd like to interject a little bit more on this. Mr. Nunez called me at 6:30 Saturday evening too and said that he had called the Animal Control and he had called the Sheriff's Department and I think your opening question was legitimate. What is our contract? I think what we need to do is narrow it down. What is the response time of the Animal Control supposed to be when a citizen or resident calls? That's a question, Mr. Tripepi, if you have the answer for that one. TRIPEPI: Right now, I don't have. I'll be happy to dig out the contract and go through it, if you want to call a recess. NUNEZ: If they're short-handed, does the City get a break on the charge also cause they're short-handed and they cannot fulfill the contract? TRIPEPI: Juan, we get charged for field hours that are billed and if they don't show up, they,don't bill you for two hours if they don't show up. NUNEZ: Oh, they don't bill you, it's only on a call basis? Okay, well like I say on that other, on January the 19th, I didn't call because I wasn't in town. So... CC 3-9-93 Page #2 TAYLOR: Mr. Nunez, I'd to interject something else that when you had called me did you call anyone else? NUNEZ: I called Bob Bruesch. TAYLOR: Mr. Bruesch? What time did you call him? NUNEZ: I called Bob Bruesch, let me see if I can find it here. BRUESCH: That was Sunday evening. NUNEZ: Yeah, I called him on Sunday at 12:45 p.m. TAYLOR: At noontime? NUNEZ: In the afternoon, yes. BRUESCH: And that's when I got in touch with City staff and they said by Monday they had gotten the log saying that the Animal Control s person had stopped by. I don't know where the truth lies because' that's what their log says, that they had stopped by on Saturday and nobody was there. , NUNEZ: But I even had to go to Chino on Saturday, I don't know, 6:30 probably and I told my wife to stay.home in case somebody comes. I left my wife at home and that was already around 6:30 in the evening. So, what time did they come? I don't know. TRIPEPI: I'll get you a copy of the log entry just like Mr. Stewart offered to give you that day. NUNEZ: Okay. TAYLOR: Madam Mayor. I'd like this in the Minutes verbatim. NUNEZ: I asked for a receipt from the Animal Control when he picked up the dog so there wouldn't be any mistake of when it was picked up. TAYLOR: But you called at 11 something Saturday morning? NUNEZ: At 11:50 on Saturday. TAYLOR: And they didn't pick it up until... NUNEZ: Monday, 5:15 after I called Frank. TAYLOR: So, you had the dog over two days, then. NUNEZ: Yes and I'm going to charge for that time probably. I fed him. I took care of him. I took him for a walk. END VERBATIM DIALOGUE C. Irene Vigil, 8703 DeAdalena Street, spoke about a recurring problem with the City's Parking Control Officers, that she and her family were being cited for parking further than 18" from the curb on a regular basis, that they live on a cul-de-sac and park the best they can, and that two such officers were in the car. Ms.' Vigil expressed the opinion that this was a waste of money. Councilman Taylor requested copies of all the tickets that Ms. Vigil had referred to. Councilman McDonald asked that staff be directed to investigate and report back to the Council. Mayor Pro Tem Bruesch asked the Traffic Engineer to provide a report on how large vehicles may legally park on a cul-de-sac street. CC 3-9-93 Page #3 0 0 Mayor Clark asked about the policy of having two Parking Control officers in the same car and staff was directed to respond. D. William Baquet, 4312 Rio Hondo Avenue, appeared to protest the fee being charged for a new driveway apron and noted that it had been revised to a lower amount on the new fee schedule that would be on the Agenda later in the evening. Mr.,Baquet stated that a survey of the surrounding cities showed much lower amounts being charged and Councilman Taylor asked for a copy of that survey. Alfonso Rodriguez, City Engineer, explained the revised fee schedule would reflect the lower rate for work such as Mr. Baquet's. Councilman Taylor ascertained that Mr. Baquet had paid the higher fee amount and asked if a refund would be issued. The subject of a refund being a matter of Council policy, it was MOVED BY COUNCILMAN McDONALD, SECOND BY COUNCILMAN TAYLOR that if Item III-D passes this evening, to implement that retroactive to the point in time at which the new Engineering Fees were made effective and that anyone who has paid a fee that is affected by tonight's action would get a refund. RESOLUTION NO. 93-13 - CLAIMS & DEMANDS The following resolution was presented to the Council for adoption: RESOLUTION NO. 93=13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $518,969.67 NUMBERED 5285 THROUGH 5423 MOTION BY MAYOR PRO TEM BRUESCH, SECOND BY COUNCILMAN VASQUEZ that Resolution No. 93-13 be adopted, Vote resulted: Yes: Bruesch, Taylor, Clark, Vasquez, McDonald No: None Absent: None Abstain: None The Mayor declared said motion duly carried and so ordered. B. RESOLUTION NO. 93-14 - APPROVING THE APPLICATION FOR PEDESTRIAN FUNDS UNDER SB 821 AND APPROVING TBE ADOPTION OF ITS PEDESTRIAN PLAN The following resolution was presented to the Council for adoption; RESOLUTION NO. 93-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD APPROVING THE APPLICATION FOR PEDESTRIAN FUNDS UNDER SB 821 AND APPROVING THE ADOPTION OF ITS PEDESTRIAN PLAN CC 3-9-93 Page #4 Juan Nunez, 2702 Del Mar Avenue, spoke on the need for crosswalks at intersections without traffic signals. Mr. Nunez also expressed the opinion that the plastic striping that was being used on some streets did not last as long as paint and Councilman Taylor asked for a report back on this problem. RESOLUTION NO. 93-15 - OPPOSING ESTABLISE94ENT OF A CARD CLUB IN MONTEREY PARR The following resolution was withdrawn from consideration because the developer had withdrawn his plan to build such a card club. D. RESOLUTION NO. 93-16 - AMENDING ENGINEERING DEPARTMENT FEES The following resolution was presented to the Council for adoption: RESOLUTION NO. 93-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD AMENDING THE SCHEDULE OF FEES FOR ENGINEERING SERVICES Juan Nunez, 2702 Del Mar Avenue, asked about the fee for monument review and the policy for replacement when street improvement projects are completed. Councilman Taylor stated that he was in favor of the fees that were being reduced but believed the other fees were excessive. E. ORDINANCE NO. 727 - AMENDMENT TO THE PERS CONTRACT TO INCLUDE PURCHASE OF PRIOR SERVICE CREDIT - ADOPT The following ordinance was presented to the Council for adoption: ORDINANCE NO. 727 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF ROSEMEAD AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM MOTION BY COUNCILMAN McDONALD, SECOND BY MAYOR PRO TEM BRUESCH that Ordinance No. 727 be adopted. CC-B TURNING MOVEMENTS ON GARVEY AVENUE EAST AND WEST OF SAN GABRIEL BOULEVARD Juan Nunez, 2702 Del Mar Avenue, reported a problem at the Beach's Market location at the loading dock area when trucks are parked there. MOTION BY COUNCILMAN MCDONALD, SECOND BY COUNCILMAN TAYLOR that the City Council approve a "Right Turn only" sign at the exits for the three locations. MATTERS FOR DISCUSSION & ACTION A. LICENSE SUSPENSION HEARING AND RECOMMENDATION FOR CHARMING KTV, 7940 GARVEY AVENUE, 1106 Steve Hoffman, 150 N. Santa Anita Avenue, Arcadia, stated that he was the new attorney of record and stated that unintentional infractions had occurred but that the owners had substantially complied with all conditions. Mr. Hoffman stressed the financial condition of this business if it were forced to close for any period of time and that a suspension would not serve any purpose. Mr. Hoffman added that the alcohol in question had been brought in by the patrons and that the owner had reprimanded such behavior and asked the alcohol to be removed. After some further discussion, this item was deferred to the next regular meeting on March 23, 1993 at 8:00 p.m. Councilman Taylor suggested that information be provided showing how the owner would prevent alcohol from being brought into the business. B. ORDINANCE PROHIBITING VIDEOTAPING AT POLLING PLACES Staff was directed to revise the wording and return it for introduction at the next meeting and, that after adoption it be sent to the State Attorney General for determination of its legality. VI. STATUS REPORTS - None VII. MATTERS FROM OFFICIALS „ A. COUNCILMAN VASQUEZ 1. Asked that the name of Jess Gonzalez be submitted as candidate for older Americans Recognition Day. B. COUNCILMAN TAYLOR 1. Reported that shrubs in the median near Rosemead Boulevard and Guess Street need to be trimmed to reduce a visibility problem. C. MAYOR PRO TEN BRUESCH 1. Noted that the Council had received an Honorary Service Award from the Rosemead Council PTA and congratulated City staff members for their service to the community. , 2. Stated that he had received complaints about trash trucks starting before 7:00 a.m., that the auto carriers at the Auto Auction are unloading before 5 a.m., and a suggestion that the car alarms in vehicles at the Auto Auction be disconnected while awaiting sale, thus solving the problem of having the alarms going off in the middle of the night. D. FRANK G. TRIPEPI, CITY MANAGER 1. Reported on the contents of the Animal Control agreement regarding pick up response time. Councilman Taylor requested that the agreement be placed for discussion on the next agenda. VIII. ORAL COMMUNICATIONS FROM THE AUDIENCE A. Lino Nardini, spoke on the increases being proposed by the Metropolitan Water District.
