CC - 12-15-92 - Adjourned MeetingAPPROVED CITY OF ROSEMEAD MINUTES OF THE ADJOURNED MEETING DATE L ZZ 22 ROSEMEAD CITY COUNCIL DECEMBER 15, 1992 BY An Adjourned Meeting of the Rosemead City Council was called to order by Mayor Clark at 7:08 p.m. in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Councilman McDonald. . The Invocation was delivered by Mayor Pro Tem Bruesch. ROLL CALL OF OFFICERS: Present: Councilmen McDonald, Taylor, Vasquez, Mayor Pro Tem Bruesch, and Mayor Clark. Absent: None I. A PUBLIC HEARING TO CONSIDER REVENUE RECOVERY ALTERNATIVES Frank G. Tripepi, City Manager, made an opening statement regarding the City's financial situation and explained the purpose of this meeting. The.Mayor opened the public hearing. Speaking from the audience in favor of the various fee increases with the exception of the proposed utility user's tax were Mervin Kennedy, Sr., 9139 Marshall Street; Rudy Ruiz, 3829 Delta Avenue; Glenn Clanton, 3244 Leyburn Drive; Holly Knapp, 8367 E. Whitmore Street; Frank Larson, 8948 E. Cortada Street; Jim Flournoy, 8655 Landis View Lane; Marvin Lowrey, 3534 Rio Hondo Avenue; and Jay Imperial. Bonnie Culbertson, representing the Rosemead Chamber of Commerce, offered to work with the Council and staff in the formation of acomprehensive business license fee or tax. Mr. Tripepi stated that no ordinance for a business license tax would be presented until staff received direction from Council. Speaking from the audience in opposition to the various fee increases were Juan Nunez, 2702 Del Mar Avenue and Robert Angles, 9147 Valley Boulevard. The public hearing was closed and a five-minute recess was called at 9:00 p.m. and the meeting was reconvened accordingly. Councilman Taylor requested that his statement be placed into the record as follows: "There were, the audience that we had, there were twelve residents that were in the audience tonight and there were four current commissioners of the City in the audience and I'm going to say three members of the Chamber, Bonnie's not here now, and then the City staff. And also that for a City of 52,000 residents I'm kind of surprised that the residents of the community were not able to be here and I believe it was Mr. Delia at the City Council meeting last Tuesday, he stood at the podium and asked about what's the utility tax, I guess he was implying was that going to be at that meeting and I'm sorry to say that he probably wasn't aware of this special meeting tonight. So, it's going to be kind of surprising I think once the public does find out about this. It's too bad they weren't aware of it. Our City Clerk stated that it was advertised twice in the Rosemead Progress and it was in the Tribune. I think the Tribune has somewhere around 1,500 circulation I think in the City. But in any case I think it's going to be a shock to quite a few of them." Councilman McDonald made the motion to approve Items B, D, E, F, and G. Mr.'McDonald was not in favor of voting on the utility tax or./ refuse surcharge until they could be heard at a regular meeting of the City Council. This motion died for lack of a second. ADJ CC 12-15-92 Page #1 0 0 Councilman Taylor opposed the approval of those items, stating that some of the fees are exorbitant. Mr. Taylor also suggested that the Sheriff's Department should not be exempt from austerity measures and cited their 8% increase at the last budget. Mayor Pro Tem Bruesch stated that he was not in favor of the utility tax; ask for an in-house graffiti removal cost study; asked that a four-day, forty hour a week work week be considered; requested an energy audit on all City facilities; have the Chamber of Commerce conduct an aggressive campaign to attract businesses to Rosemead that provide the greatest amount of sales tax revenue; suggested raising the TOT to 12%; that a utility tax be charged on cable television customers only and that water abusers be penalized during periods of drought; and suggested that the proposed trash surcharge be doubled and used for the lawsuit expenses. Councilman Vasquez was in favor of all the fees except the utility tax. A. RESOLUTION NO. 92-60 - APPROVING A $.76 MONTHLY SURCHARGE ON RESIDENTIAL REFUSE BILLS AND 7% SURCHARGE ON COMMERCIAL/INDUSTRIAL REFUSE BILLS This item was deferred to a Regular Meeting. B. RESOLUTION NO. 92-61 - ESTABLISHING A SCHEDULE OF FEES FOR PLANNING AND ENGINEERING SERVICES The following resolution was presented to the Council for adoption: RESOLUTION NO. 92-61. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING A SCHEDULE OF FEES FOR PLANNING AND ENGINEERING SERVICES MOTION BY COUNCILMAN McDONALD, SECOND BY MAYOR PRO TEM BRUESCH that Resolution No. 92-61 be adopted. Vote resulted: Yes: Bruesch, Clark, Vasquez, McDonald No: Taylor Absent: None Abstain: None The Mayor declared said motion duly carried and so ordered. Councilman Taylor stated he would support a 50% increase but these fees are too excessive. C. ORDINANCE NO. 718 - ADOPTING A UTILITY USER'S TAX - INTRODUCE The following ordinance was presented to the Council for introduction: ORDINANCE NO. 718 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ADOPTING A UTILITY USERS TAX Mayor Clark expressed opposition to any form of taxation that would tax necessities such as utilities. MOTION BY MAYOR PRO TEM BRUESCH that a 5% tax be charged to cable Television customers only and this motion died for lack of a second. MOTION BY COUNCILMAN TAYLOR, SECOND BY COUNCILMAN VASQUEZ that no action be taken and this item be tabled. Mayor Pro Tem Bruesch stated that he was not in favor of a utility tax except for cable television. D. ORDINANCE NO. 719 - AMENDING THE ROSEMEAD MUNICIPAL CODE REGARDING PLANNING AND ENGINEERING FEES - INTRODUCE The following ordinance was presented to the Council for introduction: ORDINANCE NO. 719 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD AMENDING THE ROSEMEAD MUNICIPAL CODE REGARDING PLANNING AND ENGINEERING FEES MOTION BY MAYOR PRO TEM BRUESCH, SECOND BY COUNCILMAN McDONALD that Ordinance No. 719 be introduced on its first reading and that reading in full be waived. Vote resulted: Yes: Bruesch, Clark, Vasquez, McDonald No: Taylor Absent: None Abstain: None The Mayor declared said motion duly carried and so ordered. ORDINANCE NO. 720 - INCREASING THE TRANSIENT OCCUPANCY TAX AND ANENDING THE ROSEMEAD MUNICIPAL CODE - INTRODUCE The following ordinance was presented to the Council for introduction: ORDINANCE NO. 720 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD INCREASING THE TRANSIENT OCCUPANCY TAX AND AMENDING THE MUNICIPAL CODE MOTION BY COUNCILMAN MCDONALD, SECOND BY COUNCILMAN TAYLOR, that Ordinance No. 720 be introduced on its first reading and that reading in full be waived. ORDINANCE NO. 722 - ADOPTING BUILDING, GRADING, REHABILITATION, ELECTRICAL, PLUMBING, AND MECHANICAL PERMIT FEES - INTRODUCE The following ordinance was presented to the Council for introduction: ORDINANCE NO. 722 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ADOPTING BUILDING, GRADING, REHABILITATION, ELECTRICAL, PLUMBING, AND MECHANICAL PERMIT FEES AND AMENDING THE ROSEMEAD MUNICIPAL CODE MOTION BY MAYOR PRO TEM BRUESCH, SECOND BY COUNCILMAN VASQUEZ that ordinance No. 722 be introduced on its first reading and that reading in full be waived. Councilman Taylor stated that the fee increases were excessive. Councilman McDonald raised the question of voting for a trash surcharge at a special meeting instead of a regular meeting. City manager Tripepi stated that if Council so desired he would speak with the trash company and have a notice put in the trash bills to notify the residents when this would be heard at a regular meeting. II. MATTERS FROM OFFICIALS A. MAYOR PRO TEM BRUESCH Asked that staff have the following items ready for consideration at the next budget session: 1. A 4-40-hour week to save on utilities. 2. Complete energy audit on all City facilities. 3. An in-house graffiti removal program. 4. Working with the Chamber to develop an,aggressive business development program stressing the need for high sales tax dollar businesses. B. COUNCILMAN McDONALD Thanked staff for this program, adding that it had been made very understandable. C. VASQUEZ Concurred with Mr. McDonald regarding staff's efforts and asked that the City Attorney and staff bring a study and report to the Council regarding a business license ordinance at a future regular meeting. ADJ CC 12-15-92 Page #4 III.ORAL COMMUNICATIONS FROM THE AUDIENCE A. Mervin Kennedy, Sr., 9139 Marshall street, commented on economics in history relating to periodic redistribution of wealth. There being no further action to be taken at this time, the meeting was adjourned at 9:40 p.m. The next regular meeting, scheduled for December 22, 1992, will be cancelled due to lack of a quorum.
