CC - 08-27-91' APPROVED CITY OF ROSEMEAD MINUTES OF THE REGULAR MEETING DAT O-9 ROSEMEAD CITY COUNCIL AUGUST 27, 1991 RY The Regular Meeting of the Rosemead City Council was called to order by Mayor Imperial at 8:09 p.m. in the Council Chambers of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag was led by Councilman Bruesch. The Invocation was delivered by Pastor Charles Horton of the Wesleyan Church. ROLL CALL OF OFFICERS: Present: Councilmen Bruesch, Taylor, Mayor Pro Tem Clark, and Mayor Imperial Absent: Councilman McDonald - Excused APPROVAL OF MINUTES: JULY 9, 1991 - REGULAR MEETING MOTION BY COUNCILMAN BRUESCH, SECOND BY MAYOR PRO TEM CLARK that the Minutes of the Regular Meeting of July 9, 1991, be approved as submitted. Vote resulted: Yes: Bruesch, Taylor, Imperial, Clark No: None Absent: McDonald Abstain: None The Mayor declared said motion duly carried and so ordered. PRESENTATIONS: - None I. ORAL COMMUNICATIONS FROM THE AUDIENCE - None II. PUBLIC HEARINGS An explanation of the procedures for the conduct of public hearings was presented by the City Attorney. A. A PUBLIC HEARING TO CONSIDER A CITY-INITIATED REQUEST TO AMEND THE ROSEMEAD MUNICIPAL CODE CONCERNING REGULATIONS TO ESTABLISH A FLOOR AREA TO LOT AREA RATIO TO LIMIT THE SIZE OF RESIDENTIAL STRUCTURES (PC RES. 91-21) - CONTINUED FROM JULY 9, 1991 The Mayor opened the public hearing. Peter Lyons, Director of Planning, presented the staff report with the recommendation to approve the Negative Declaration and introduce ordinance No. 689. There being no one wishing to speak, the public hearing was closed. Councilman Taylor requested additional rear yard setback requirements at ten feet (101) per bedroom up to three with an additional five feet (51) for each bedroom over three. Mayor Pro Tem Clark asked that this item be continued to allow inclusion of a ten foot (101) setback for all dwellings with a second floor and an attachment regarding samples of sizes of homes that could be constructed on different size lots. Mayor Imperial asked that compressed fiber board not be allowed for second floor construction. Councilman Bruesch concurred with this setback requirement as a method to control the size of homes and provide open space so that the ordinance does not appear to promote additional vehicles at home sites. A PUBLIC HEARING TO CONSIDER GENERAL PLAN AMENDMENT 91-1 WHICH PROPOSES ADOPTION OF A NEW HOUSING ELEMENT FOR THE CITY OF ROSEMEAD (CONTINUED FROM AUGUST 13, 1991) Peter Lyons, Director of Planning, presented the staff report with the recommendation to approve the 1991 Housing Element and incorporate it into the City's General Plan. The Mayor opened the public hearing. Karen Warner, Cotton Beland & Associates, Pasadena, explained the City's Housing Element noted that the proposed senior housing is an integral part of the element and stressed that the point of the Housing Element was to allow adequate zoning for housing recycling opportunities and not the actual housing. Councilman Bruesch determined that the City had no density bonus program in effect at this time and was concerned about a emergency shelter permit system. Mr. Bruesch also asked for a written report regarding the mobilehome portion of the Housing Element. There being no one else wishing to speak, the public hearing was closed. MOTION BY COUNCILMAN BRUESCH, SECOND BY MAYOR IMPERIAL that the Council approve the 1991 Housing Element Draft as presented and incorporation thereof into the Rosemead General Plan. Councilman Taylor stated that his "NO" vote was against the Southern California Association of Government (SCAG) involvement with the regional housing element and that he would have liked to have had the background report included in this item. Councilman Bruesch asked that staff be directed to begin working on the procedure for applying for 25% density bonus and the development of emergency shelter permitting in certain zones. III.LEGISLATIVE A. RESOLUTION NO. 91-47 - CLAIMS & DEMANDS The following resolution was presented to the Council for adoption: RESOLUTION NO. 91-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $245,944.54 NUMBERED 37598-37612, 37614-37622 AND 34226 THROUGH 34336 MOTION BY COUNCILMAN BRUESCH, SECOND BY COUNCILMAN TAYLOR that Resolution No. 91-47 be adopted. CC-A AUTHORIZATION.TO REJECT APPLICATION FOR LEAVE TO PRESENT A LATE CLAIM FILED AGAINST THE CITY BY WAWANESA MUTUAL INSURANCE City Attorney Robert Kress stated the City's insurance adjuster had modified its recommendation and was asking that the City accept the filing of a late claim in this matter and reject the claim at this time. MOTION BY COUNCILMAN TAYLOR, SECOND BY COUNCILMAN BRUESCH that the Council approve the amended recommendation. CC-D IMMIGRATION AND NATURALIZATION SERVICE LOCAL PILOT 19 K4IH:7,4 i Mayor Imperial explained the background on this item and asked for Council support. Robert Angles, 9720 Valley Boulevard, was against any type of program that might conceivably aid illegal immigrants and was against Rosemead's participation. Juan Nunez, 2701 Del Mar Avenue, agreed with Mr. Angles adding fears that the program would outgrow available staff. While Councilman Taylor agreed with the concept of assisting people he stated the belief that there were churches and other organizations already in place to aid with the immigration process; did not want the City to get involved in a Federal program; asked this be deferred to the next meeting for more information; and asked that staff contact the San Gabriel Mission, St. Anthony's Church, Ephiphany in South E1 Monte, Nativity in E1 Monte, and St. Luke's in Temple City. Councilman Bruesch was opposed to the use of City staff in implementation of this program and noted that the school districts have programs in place to aid immigrants. MATTERS FOR DISCUSSION & ACTION agencies are available to assist out the necessary forms. Ltem was deferred to the next at 9:40 p.m. and the meeting was - None VI. STATUS REPORTS - None VII. MATTERS FROM OFFICIALS A. SHERIFF'S STATUS REPORT - IN-N-OUT BURGER INCIDENT This item was deferred to the meeting of September 24, 1991. B. COUNCILMAN TAYLOR 1. Noted that he had not yet received the report regarding Mary Redd. C. COUNCILMAN BRUESCH 1. Asked that the meeting be adjourned in memory of those who died in defense of liberty during the recent coup attempt in Russia. 2. Gave a brief summary of the problem with the Zapopan lunch program regarding the fees being charged to those participants not residing in Rosemead. Councilman Taylor noted that the majority of these participants are not from Rosemead. Mayor Imperial requested that all programs provided by Rosemead be screened for the number of Rosemead residents that are participants. Councilman Taylor noted that there is a requirement that at least 50% of the membership of the clubs using Rosemead facilities must be Rosemead residents and asked for a report on this policy. There being no further action to be taken at this time, the meeting was adjourned at 9:59 p.m. in memory of the people who died in the failed coup attempt in Russia.
