Brown Act
Pursuant to provisions of the Brown Act, no action may be taken on a matter unless it is listed on the agenda, or unless
certain emergency or special circumstances exist. The City Council may direct staff to investigate and/or schedule certain
matters for consideration at a future City Council meeting.
General Conduct/Decorum During Meeting:
While the City Council is in session, all attendees are required to observe the proceedings and adhere to established rules
of decorum. No individual shall engage in behavior that is intended to or likely to incite violent or riotous actions, nor shall
anyone disturb the orderly conduct of the meeting. Remarks must be made exclusively from the podium and directed to
the Council as a whole, rather than to individual members or the audience. Comments and exchanges from the audience
will not be acknowledged, as focus should remain on the speaker or the Council. Attendees are requested to silence their
cellphones during the meeting. Any individual who causes ongoing disruption may be subject to removal from the
proceedings per Government Code 54957.95.

3. PUBLIC HEARING
A. Second Public Hearing Pursuant to Government Code Section 34458 on Proposed
Draft City Charter
On March 10, 2026, the City Council conducted the first public hearing of the draft
charter. After holding the first public hearing and receiving public comments, the
City Council directed staff to proceed with the second public hearing at a non-regular
meeting date, in accordance with Government Code Section 34458. This is the
second public hearing required by state law on the draft charter.
After holding a second hearing on the draft charter on a non-regular meeting date,
the City Council at an upcoming meeting may vote to adopt a motion submitting the
proposed charter to the City’s voters. The City Council must wait 21 days after the
second public hearing before adopting this motion at a regular meeting, which would
be on May 26, 2026. The deadline to submit the charter to the County for inclusion
on the ballot for the November election is August 7, 2026.
Recommendation: That the City Council take the following actions:
1. Conduct the Second Public Hearing and take any public comment;
2. Discuss and provide any direction on the draft City charter; and
3. Vote on whether to schedule a public hearing on May 26, 2026 to consider the
adoption of the draft charter and placing it on the ballot for the November 3, 2026,
election.
B. Public Hearing for Municipal Code Amendment 25-01 - An Introduction and First
Reading of Ordinance No. 1032 and Ordinance No. 1033, Amending Chapter 17.54
(Wireless Telecommunication Facilities) and Adding Chapter 12.54 (Wireless
Telecommunication Facilities in the Public Right-of-Way) and to Consider and
Approve Resolution No. 2026-17 to Amend and Augment the City of Rosemead Fee
Schedule
MCA 25-01 (Ordinance No. 1032) and Ordinance No. 1033 are City initiated
amendments to the Rosemead Municipal Code (RMC) to update Chapter 17.54
(Wireless Telecommunication Facilities) and append Chapter 12.54 (Wireless
Telecommunication Facilities in the Public Right-of-Way) to the RMC in order to
bring the City’s municipal code up to compliance with Federal and State laws. The
proposed amendments conjointly regulate wireless telecommunications facilities on
private property and within the public right-of-way and would allow greater
flexibility and responsiveness to Federal and State laws while still preserving the
City’s traditional land use authority to the maximum extent practicable.
Additionally, the City will consider and approve a resolution to amend and augment
the City of Rosemead Fee Schedule to establish applicable fees associated with the
review, processing, permitting, inspection, and ongoing regulation of wireless

telecommunication facilities, consistent with applicable Federal and State laws and
in alignment with the proposed amendments to the RMC.
Recommendation: That the City Council take the following actions:
1. Conduct a public hearing and receive public testimony;
2. Introduce the first reading, by title only, Ordinance No. 1032, approving
Municipal Code Amendment 25-01, entitled:
