A. PUBLIC HEARING: RESOLUTION NO. 2004-31 - CERTIFICATION OF
COMPLIANCE WITH THE LOS ANGELES COUNTY CONGESTION

The, Congestion Management Program (CMP) requires each city to annually
adopt a resolution, following a public hearing, stating its compliance with the
CMP.
Recommendation: Adopt Resolution No. 2004-31.

Ordinance No. 834 was introduced at the regular meeting of August 10, 2004.
Recommendation: Adopt Ordinance No. 834.
CC-B AUTHORIZATION TO APPLY FOR THE "PER CAPITA AND ROBERTI-
Z'BERG HARRIS GRANTS" FOR ROSEMEAD AND GARVEY POOLS AND
APPROVE RESOLUTIONS NO. 2004-33 AND 2004-34
There are two State Grants available to the City. Both Rosemead and Garvey
Pools buildings are old and need to be refurbished. The proposal is to apply for
State grants to rehab both pool bath houses.
Recommendation: Authorize staff to apply for the "Per Capita" and Roberti-
Z'Berg Harris Grants to upgrade and improve the buildings at Rosemead and
arvey Pools; and approve Resolutions No. 2004-33 and 2004-34.
CC-C PROVAL OF ROSEMEAD PARK SNACK BAR AGREEMENT FOR
ROSEMEAD ELITE ALL-STARS AND COMPANY
The Rosemead Elite All-Stars and Company is a youth cheer, drill and hip hop
youth organization that performs at various activities throughout San Gabriel
Valley. They are requesting to use and operate the Snack Bar at Rosemead Park
from August 25, 2004 through January 1, 2005.
Recommendation: Approve the Agreement and authorize its execution by the
Mayor.
AC-D AUTHORIZATION TO REJECT CLAIM AGAINST CITY FROM ERIC
OZUNA
Claimant drove his vehicle into a sinkhole caused by a water main break.
Recommendation: Approve rejection of this claim and authorize that a letter of
rejection be sent to the claimant.
ACCEPTANCE OF WORK FOR PARK ADA AND BALLFIELD LIGHTING
IMPROVEMENTS
The referenced project has been constructed in conformance with the approved
plans and specifications. The original contract amount was $375,950.00. The
total amount to be paid to the contractor including quantity adjustment and the
retention is $395,005.00.
Recommendation: Accept the project; authorize the recordation of the Notice of
Completion by the City Clerk; authorize the release of the 10 percent retention
payment 35 days after the recorded date of the Notice of Completion.
SET PUBLIC HEARING FOR SEPTEMBER 7, 2004 AT 7:00 PM AT
ROSEMEAD HIGH SCHOOL AUDITORIUM TO HEAR APPEAL FROM
ACTIONS TAKEN BY PLANNING COMMISSION ON WAL-MART

Councilman Imperial has appealed the Planning Commission's certification of an
Environmental Impact Report, approval of Tentative Parcel Map No. 26827,
denial of Conditional Use Permit No. 02-883 and approval of Conditional Use
Permits No. 02-882 and No. 03-939. Pursuant to Section 17.124.070 of the
Rosemead Municipal Code, the City Council is to set a time for hearing the
appeal.
Recommendation: Set the public hearing on the appeal for September 7, 2004 at
7:00 pm at the Rosemead High School Auditorium, 9063 E. Mission Street,
Rosemead, to be heard concurrently with the City Council's consideration of the
related General Plan Amendment and Development Agreement.
CC-G ADOPTION OF A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD AUTHORIZING THE SUBMITTAL OF GRANT FUNDING
REQUEST UNDER LOCAL LAW ENFORCEMENT BLOCK GRANT
(LLEBG) PROGRAM
The LLEBG Program provides units of local government with funds to
underwrite projects designed to reduce crime and improve public safety. For FY
2004-05, the City is eligible to receive $27,327 (when matched with $3,036 of
City funds) from the Department of Justice to fund law enforcement activities.
Recommendation: Adopt Resolution No. 2004-35, authorizing application for
funding in the amount of $27,327; and approve matching funds of $3,036 from
unappropriated reserves.
