Attached is a letter from Commissioner Herrera requesting reappointment to the Planning Commission.

I am submitting this letter in order to request that you consider my reappointment as a member of the
Rosemead Planning Commission.
As you know, I have served on the Commission for a number of years, dealing with various issues
relating to housing, density, and commercial developments. Additionally, being a resident, I am
concerned with the future of Rosemead. All decisions that I make have been based upon what I feel
would be best for our City.
With these thoughts in mind, I respectfully request that I be reappointed a member of the Rosemead
Planning Commission.

I MOVE THAT THE CITY COUNCIL ADJOURN THIS
EVENING'S MEETING IN THE MEMORY OF:
Sheriff's Deputy Michael Arruda, a 13-year veteran of the
department, who died on June 15'', after another deputy
accidentally shot him during a gunfight with a man firing a pellet
gun at them at a Hacienda Heights motel. Deputy Arruda was
remembered as a confidant, a reliable partner and someone with a
rare and undefinable decency. He is survived by his fiancee Lidia
Silvia; his parents, Joyce Ann and Ricardo Arruda; his sister Lisa
Dumont; and his 11-year old son, Michael Arruda, Jr.
TOHN MORALES
Mr. John Morales has been a volunteer for the City of Rosemead, Parks and Recreation
Department, for the past nine (9) years. During this time, he has contributed greatly to
the Senior Lunch Program. He arrives daily by 9:00 a.m. and leaves at 1:00 p.m., during
this time he manages the entire functions of the kitchen, which include: ordering the
necessary lunches, monitoring the arrival of the food, taking food reservations, selling
the lunches, inventory of all supplies, balancing the lunch revenue, selling the surplus
food and greeting the guests. In addition to the lunch program, he also donates his time
and experience to all senior special events at the Garvey Center and is the liaison to the
local church, where he takes an active interest in the promotion of all our senior
activities.
It is not uncommon to see John passing out City flyers to the public, visiting the ill at
the hospital or checking on the absentee seniors. Mr. Morales often takes work home to
do in his "Spare Time", which entails rolling utensils, cutting out decorations, folding
programs, etc. Due to his commitment to the seniors, his dedication, involvement and
initiative, he has proven to be one of the City of Rosemead's most valuable and
enriching resources.

RE: CITY MANAGER EMPLOYMENT AGREEMENT
DATE: JUNE 22, 2004
At the annual budget study session the Council directed the City Attorney to prepare an
amendment to the City Manager's employment contract that would provide for incremental salary
adjustments over the term of the employment agreement.
The proposed amendment, presented for Council consideration:
1. Extends the employment of Mr. Crowe through May 31, 2008.
2. Provides for a series of specified incremental salary adjustments that will allow Mr.
Crowe's salary to be brought in line with the former City Manager's salary and the. salaries of his
peers. The annual salary adjustments would be in lieu of any cost of living increases granted to .
City employees.
3. Adds an attorney's fee clause. This is an addition that I am suggesting. The provision
has become standard in manager contracts. It simply says if either party is required to go to court
to enforce the terms and conditions of the agreement, then the prevailing party is entitled to an
award of attorney's fees and costs against the losing party.
RECOMMENDATION:
1 recommend that the City Council approve the First Amendment to Employment Agreement with
Bill Crowe.

FIRST AMENDMENT TO EMPLOYMENT AGREEMENT
This First Amendment to Employment Agreement is made and entered into this 22nd day
of June, 2004 by and between the City of Rosemead, a municipal corporation hereinafter called
"City" and Bill Crowe, hereinafter called "Employee".
WHEREAS, the parties entered into an agreement for Employee to serve as City Manager
of City in 2002; and
WHEREAS, City wishes to extend the Agreement with Employee;
NOW THEREFORE, in consideration of. the mutual covenants herein contained, the
parties amend their Agreement, attached hereto as Exhibit "A", as follows:
1. Section 2 C - Term is hereby amended to read as follows:
C. Employee shall remain in the exclusive employ of City until May 31, 2008. Employee
agrees not to seek, to accept, nor to become employed by any other employer until said
termination date, unless said termination date is effected as hereinafter provided.
2. Section 4 - Salary is hereby amended to read as follows:
City agrees to pay Employee for his services rendered pursuant hereto an annual base
salary, as set forth below. Said salary to be payable in installments at the same time as other
employees of the City are paid.
Effective July 1, 2004 Employee shall be paid an annual salary of $ 145,000.00.
Effective July 1, 2005 Employee shall be paid an annual salary of $ 155,000.00.
Effective July 1, 2006 Employee shall be paid an annual salary of $ 165,000.00.
Effective July 1, 2007 Employee shall be paid an annual salary of $ 175,000.00:
Said salary adjustments shall be in lieu of any cost of living adjustments granted to City
employees.
3. The Agreement between the parties is hereby amended to include a new paragraph 14 -
Attorneys fees as follows:
SECTION 14. ATTORNEYS FEES
In the event that any legal action is commenced to enforce or interpret the terms or
conditions of this Agreement, the prevailing party shall, in addition to any other relief and costs,
be entitled to reasonable attorney's fees. . .
4. Except as provided in this First Amendment to Employment Agreement, the
Agreement between the parties shall remain in full force and effect.
IN WITNESS WHEREOF, the City of Rosemead has caused this First Amendment to
Agreement to be signed and executed on its behalf by its Mayor, and duly attested by its City
Clerk, and Employee has signed and executed this First Amendment to Agreement, both in
duplicate the day and year first above written.
