Ordinance No. 869 - Speed LimitsORDINANCE NO. 869 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, SETTING SPEED LIMITS IN ACCORDANCE WITH THE CALIFORNIA VEHICLE CODE WHEREAS, California Vehicle Code sections 22357 and 22358 authorize local agencies to change speed limits on local streets by ordinance, which ordinance need not be made a part of the Municipal Code but which must be based on findings made in an engineering and traffic survey; and • WHEREAS, in 2006, the City's traffic engineering consultant completed a citywide engineering and traffic survey on various streets throughout the City, which survey was adopted by the City Council on March 20, 2006; and WHEREAS, on September 29, 2008, the City received from Willdan Engineering an engineering and traffic survey on Rosemead Boulevard within the City limits; and WHEREAS, the City Council desires to adopt the speed limits suggested by the two engineering and traffic surveys and, where applicable, to revise current speed limits to conform to the engineering and traffic surveys so as to regulate traffic in a safe and efficient manner. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD • DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Modified Speed Limit for Rosemead Boulevard. Based on the engineering and traffic survey completed by Willdan Engineering for Rosemead Boulevard (State Route 19) in 2007 and transmitted to the City on September 29, 2008, the speed limits for those portions of Rosemead Boulevard are hereby set to conform to the recommendations made in the Willdan survey, a copy of which is attached hereto as Attachment "A." SECTION 2. Modified Speed Limit for Other Streets. Based on the engineering and traffic survey completed by the City in 2006 and adopted by the City Council on March 20, 2006, the speed limits for various streets and highways in the City are hereby set to conform to the recommendations made in the City survey, a copy of which is attached hereto as Attachment "B." SECTION 3. Unmodified Speed Limits. With respect to any speed limit for any street or highway in the City not modified by Section 1 or Section 2, the speed limit in effect prior to the adoption of this ordinance shall remain in effect. SECTION 4. Severability. The City Council hereby declares that the 1 LA #4818-9534-5922 v3 provisions of this Ordinance are severable and if for 'any reason a court of competent jurisdiction shall hold any sentence, paragraph, or Section of this Ordinance to be invalid, such decision shall not affect the validity of the remaining parts of this Ordinance. 0 • SECTION 5. Certification. The City Clerk shall certify to the adoption of this ordinance and shall cause the same to be posted as required by law. SECTION 6. Notice. This Ordinance shall be in full force and effect thirty (30) days after its passage. Within fifteen (15) days after adoption of this Ordinance, this Ordinance shall be published at least once in a newspaper of general circulation published and circulated in the City of Rosemead.
