CC - Item 5B - Resolution 2004-48 - Consenting to election to be held on march 8, 2005TO: HONORABLE MAYOR AND MEMBERS ROSEMEAD CITY COUNCIL FROM: NANCY VALDERRAMA, CITY CLERK DATE: OCTOBER 22, 2004 RE: RESOLUTION NO. 2004-48 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CONSENTING TO AN ELECTION CONSOLIDATION WITH THE CITY OF LOS ANGELES, INCLUDING THE LOS ANGELES COMMUNITY COLLEGE DISTRICT AND ORDERING THAT THE THREE (3) SEATS ON THE BOARD OF TRUSTEES OF THE LOS ANGELES COMMUNITY COLLEGE DISTRICT APPEAR ON THE BALLOT OF THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, MARCH 8, 2005 The City of Los Angeles is conducting school board elections for the Los Angeles Community College District (LACCD) and Los Angeles Unified School District (LAUSD) on March 8, 2005. Portions of the two school districts are within the jurisdictional boundaries of twenty-one cities holding elections on the same day. A portion of Rosemead lies within the boundaries of LACCD. The City of Los Angeles is requesting the Rosemead City Council consolidate the March 8a' General Municipal Election with the City of Los Angeles for LACCD, based on their assumption that a consolidated election will reduce the potential for voter confusion and inconvenience. The School District's election prior to consolidation in 2003, had a voter turnout of 8.27% in the Rosemead precincts. As you will recall, the LACCD election was consolidated with the Rosemead General Municipal Election in 2003. Once again, the City of Los Angeles is requesting that the Rosemead City Council consolidate the March 8'h General Municipal Election with the LACCD election. In February 2003, a problem was detected with one precinct within the consolidated area. That precinct received their Sample Ballots without the LACCD candidates listed. Also, those that requested an absentee ballot, received a ballot without those candidates listed. The problem was addressed and corrected. This did not impact the Municipal Election or the LACCD Election. Since then, the City's election suppliers, Martin and Chapman, have taken steps to ensure that such a mistake does not occur again. CCAGENDA CONSOLIDATION REQUEST Page # I 1O C T 2 6 2004 ITER'I,N'o- RESOLUTION NO. 2004-48 October 22, 2004 Page #2 If the City of Rosemead consolidates the election with the City of Los Angeles, half or 8 of the 15 precincts, would be involved. Also the polling hours would be extended from 7:00 a.m./7:00 p.m. to 7:00 a.m./8:00 p.m. The actual cost of the last Rosemead election in 2003 was $34,370. The City of Los Angeles proportionate share was $11,690. Benefits of consolidation include the fact that registered voters in the consolidated area will receive one Sample Ballot, one Voter Information Pamphlet, and one Absentee Ballot upon request. On election day, the voter will go to one polling place and vote on one ballot. All ballots will return to one location for tallying. The City of Los Angeles will pay its proportionate share of the costs. Some of the negative aspects of a concurrent election are that the voter in the LACCD District will receive two separate Sample Ballots and Voter Information Pamphlet, and will receive two separate Absentee Ballots. Their voted ballots will be returned to two separate tallying locations. On election day, the voter will cast two separate ballots at two separate tables if their polling location is the same as the Municipal Election. If not, the voter may have to travel to a different polling location. The election costs will not be shared. Consolidation would reduce the potential for voter confusion, inconvenience and reduce the need for additional space at the polls. Attachment A summarizes the differences. Attached for your information is draft Resolution No. 2004-48 consenting to the consolidation, copies of the City of Los Angeles' letter and resolution requesting consolidation, and Attachment A. Representatives from the City of Los Angeles will be present at the meeting to answer questions and provide information. RECOMMENDATION: That the City Council agree to the requested consolidation, and to adopt Resolution No. 2004-48 consenting to the consolidation of the Los Angeles Community College District (LACCD) Board of Trustees election on the Rosemead ballot, and further provides that they will be responsible for their proportionate share of the cost of the election. CCAGENDA CONSOLIDATION REQUEST Page #2 RESOLUTION NO. 2004-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, CONSENTING TO AN ELECTION CONSOLIDATION WITH THE CITY OF LOS ANGELES, INCLUDING THE LOS ANGELES COMMUNITY COLLEGE DISTRICT AND ORDERING THAT THE FOUR (4) SEATS ON THE BOARD OF TRUSTEES OF THE LOS ANGELES COMMUNITY COLLEGE DISTRICT APPEAR ON THE BALLOT OF THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, MARCH 8, 2005 WHEREAS, a General Municipal Election will be held on Tuesday, March 8, 2005, and will be called by Resolution No. 2004-46, adopted by the Rosemead City Council; and, WHEREAS, in accordance with the City of Los Angeles' resolution adopted on September 21, 2004, a copy of which is attached as Exhibit A and incorporated by reference to the resolution, the City Council of the City of Rosemead is hereby requested to consent to a consolidation with the Primary Nominating Election of the City of Los Angeles, including the Los Angeles Community College District, with the City's General Municipal Election scheduled to be held on March 8, 2005; and WHEREAS, the City of Los Angeles agrees to pay its' proportionate share of the costs relating to the conduct of this election. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities, the City Council of the City of Rosemead hereby consents to consolidate the Primary Nominating Election of the City of Los Angeles, including the Los Angeles Community College District for the purpose of electing three (3) Members of the Board of Trustees for the Los Angeles Community College Districts 2, 4 and 6 with the General Municipal Election of the City of Rosemead. SECTION 2. In the event that the General Municipal Election to be held in the City of Rosemead should be cancelled due to insufficient candidates, then the City of Los Angeles will be responsible for the conduct of their election within the boundaries of the City of Rosemead. SECTION 3. That Resolution No. 2000-49, previously adopted by the City Council of the City of Rosemead on September 26, 2000, set the polls to close at 7:00 p.m.; and pursuant to Election Code Sections 10400 - 10418, and the acceptance of this requested consolidation, it is necessary to change the time that the polls will close, to 8:00 p.m., so that all precincts voting on such offices will have the same voting hours, and close at the same times. SECTION 4. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. Resolution No. 2004-48 Page 2. That notice of time and place of holding of the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. SECTION 6. That the City Clerk shall forward without delay, a copy of said resolution to the Los Angeles County Board of Supervisors, the Los Angeles County Registrar- Recorder/County Clerk, and to the City Clerk of the City of Los Angeles. SECTION 7. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions. RESOLUTION A RESOLUTION OF THE LOS ANGELES CITY COUNCIL REQUESTING THAT THE TWENTY-ONE CITIES IDENTIFIED IN EXHIBIT I HEREIN AGREE TO CONSOLIDATE A PORTION OF THE PRIMARY NOMINATING ELECTION, TO BE HELD ON TUESDAY, MARCH 8, 2005, WITH THE MUNICIPAL ELECTIONS OF THOSE CITIES TO BE HELD ON THE SAME DATE. . WHEREAS, on March 8, 2005, Municipal Elections will be held in the cities identified in Exhibit I herein; and WHEREAS, the City of Los Angeles will also conduct a Primary Nominating Election on March 8, 2005, to elect the Mayor, City Attorney, City Controller, Members of the Los Angeles City Council, Members of the Board of Education of the Los Angeles Unified School District and Members of the Board of Trustees of the Los Angeles Community College District; and WHEREAS, a portion of the Los Angeles Unified School District and the Los Angeles Community College District elections overlaps the boundaries of the Exhibit I cities; and WHEREAS, to improve voter participation, it is desirable to consolidate the Primary Nominating Election and the Municipal Elections of the Exhibit I cities, with respect to that portion of the Los Angeles Unified School District and/or the Los Angeles Community College District which overlaps their boundaries; and WHEREAS, to enhance voter convenience and improve the administration of the consolidated elections, it is desirable that the precincts, polling places, election officers, voting hours, and vote by mail procedures of the elections be the same; and for the City Clerks of the Exhibit I cities to canvass the returns of the election for that portion of Los Angeles Unified School District and/or the Los Angeles Community College District which is within their boundaries; and that the consolidated elections be held in all respects as if there were only one election; and WHEREAS, cost savings will result from the consolidation and sharing of costs of these elections. NOW, THEREFORE, the Los Angeles City Council does hereby resolve, determine and order as follows: Section 1. Pursuant to the requirements of California Elections Code Sections 10400 through 10418 and Los Angeles City Election Code Sections 4, 4.2 and 4A, the City Councils of the Exhibit I cities are requested to consent and agree to consolidate the Primary Nominating Election, with respect to that portion of the Los Angeles Unified School District and/or the Los Angeles Community College District elections which is within their boundaries, with their Municipal Elections to be held on March 8, 2005; and that the elections shall be held in those cities in all respects as if there were only one election. The precincts, polling places, officers of election, ballots and canvassing procedures and all other conditions for this portion of the Primary Nominating Election shall be the same as those provided by those cities for their Municipal Elections. Section 2. The City Clerks of the Exhibit I cities are authorized to canvass the returns of that portion of the Primary Nominating Election which is requested to be consolidated with the Municipal Elections of their respective cities. Section 3. The City Councils of the Exhibit I cities are requested to issue instructions to their respective City Clerks to take any and all steps necessary to hold the consolidated election. Section 4. The City of Los Angeles agrees to reimburse the Exhibit I cities the proportionate share of the costs for conducting the consolidated election. This agreement does not affect the obligation of the Los Angeles Unified School District and the Los Angeles Community College District to reimburse the City of Los Angeles for the overall conduct of the Primary Nominating Election. Section 5. The Los Angeles City Clerk shall certify to the adoption of this Resolution and file a certified copy thereof with the City Councils of the Exhibit I cities and with the Los Angeles County Registrar-Recorder.
