TRIPEPI, CITY MANAGER DATE: MAY 21, 1996 RE: ACCEPTANCE OF STREET EASEMENTS FOR HIGHCLIFF STREET RECONSTRUCTION PROJECT Attached are two (2) easement deeds for street purposes on Highcliff Street east of Jackson Avenue and two Right-of-Way Agreements. Also provided are a listing of the property owners, addresses and agreement contents, and a location map. These documents represent two additional easements necessary for the reconstruction of Highcliff Street, for a total to date of ten (10) of the 14 properties required as shown on the location map. Of the remaining four properties required to construct the project, two property owners have indicated they are not willing to freely dedicate the required right-of-way. Staff has met with the other two property owners and have sent revised right-of-way agreements, per City Council direction, for their signature. ' RECOMMENDATION It is recommended that the City Council accept the attached documents and direct the City Clerk to record the deeds together with the certification of acceptance for each deed and authorize the City Manager to execute the Right-of-Way Agreements on behalf of the City. IN CONSIDERATION of which, and the other considerations hereinafter set forth, it is mutually agreed as follows: 1. The parties have set forth the whole of their agreement. The performance of this agreement constitutes the entire consideration for said document and shall relieve the City of Rosemead of all further obligations or claims on this account or on account of the location, grade or construction of the proposed public improvement. 2. It is agreed that the property conveyed by the above said easement deed is being donated to the City of Rosemead by the undersigned grantor(s), having been informed of the right to compensation for the property donated and hereby waive(s) such right to compensation. 3. The City shall, as part of the construction of the proposed public improvement, remove existing chain link fence and gate with new chain link fence and gate at back of proposed sidewalk, remove existing 27-inch tree and replace with 24-inch box Fern Pine, remove and replace in kind five- feet of existing driveway, relocate irrigation facilities existing within the area of construction to back of proposed sidewalk, and install new water service meter within sidewalk adjacent to property. 4. Permission is hereby granted to the City of Rosemead, or its authorized agent, to enter upon grantor's land, where necessary, for purposes of construction of street improvements, driveway, chain link fence, replacement of private tree, and relocation of irrigation facilities. Grantor understands and agrees that upon completion of the work described in Section 3 of this agreement, said driveway, chain link fence, tree, and irrigation facilities located upon the grantor's land shall be considered as the sole property of the grantor, the responsibility for maintenance and repair of said property to be that of grantor. 5. In consideration for donating the property by the undersigned grantor, the City of Rosemead agrees to pay all improvement/construction costs of this project and no assessment shall be levied upon grantor's land for said costs. 6. All work done under this agreement shall conform to all applicable building, fire, and sanitary laws, ordinances, and regulations relating to such work, and shall be done in a good and workmanlike manner. All structures, improvements, or other facilities, when removed and relocated, or reconstructed by the City of Rosemead, shall be left in as good a condition as found. All of the work is either replacement of existing conditions or as required by the project construction plans. Hua - 7610 Highcliff, APN 5285-026-055 Item no. 3 of the agreement calls for removal and replacement in kind a portion of the existing driveways to match the proposed improvements, construction of a retaining slough wall along a portion of Highcliff street as required to match existing grades, and removal and replacement of the existing three foot wood fence along the easterly property line.
