DATE: MAY 11, 2010 SUBJECT: DESIGN DEVELOPMENT OF AQUATIC FACILITIES AT ROSEMEAD AND GARVEY PARKS SUMMARY At its regular meeting on February 23, the City Council authorized Aquatic Design Group to develop schematic designs for the complete renovation of Garvey and Rosemead Pools. The drawings are the first step toward a detailed and three- dimensional view of the projects which better enable the City to determine a realistic project scope and cost estimate. Schematic designs have been completed as attached. Representatives from Aquatics Design Group, along with staff, will provide City Council with a presentation of the completed drawings. With completion of schematic designs, the project is ready to proceed with the full design and construction specifications phase. Staff Recommendation Staff recommends the following: 1. That the City Council authorize the City Manager to enter into a professional services agreement with Aquatic Design Group in the amount of $522,450 ($350,041.50 from existing 2006A Bond proceeds and $172,408.50 from funds that will be available through the Redevelopment Agency's repayment of a City loan) to complete design development, construction documents and permit drawings, and to perform construction observation for the renovation of aquatics facilities at Rosemead and Garvey Pools; and 2. That the Community Development Commission and City Council adopt Resolutions No. 2010-31 and CDC No. 2010-17 appropriating $350,041.50 from the existing 2006A Bond proceeds. As has been previously reported to City Council, because Garvey Park is located outside of Rosemead's redevelopment project areas, it is not eligible for funding through redevelopment bonds. Thus, an additional resolution will be brought before City Council for authorization of the balance of costs ($172,408.50) associated with design ITEM NO. City Council Meeting May 11, 2010 Page 2 of 3 . development once the RDA repays its debt to the City from the Community Development Commission's proposed 2010 bond proceeds. ANALYSIS Given the significant state of disrepair at both Rosemead and Garvey Pools, City Council authorized staff to complete schematic drawings as a first phase in design development of replacement facilities. Schematic design resulted in a few changes as compared with conceptual design. Changes include the following: Rosemead Aquatic Center • The addition of park restrooms at southeast corner of bath house (will replace existing portable restroom east of existing pool facilities), and • The addition of office restroom to serve staff and sick/injured patrons Garvey Aquatic Center The addition of concession and storage facilities on southern end of proposed bath house, and • The addition of office restroom to serve staff and sick/injured patrons, and • An increased number of shade structures on deck Even with the additions, the estimated cost for Rosemead Aquatic Center has been reduced to $6.52 million, while Garvey Aquatic Center has increased slightly to $3.32 million. With completion of this phase, consideration should now be given to full-scale design, creation of construction documents, and construction oversight. With Council authorization, staff has been working with Aquatics Design Group through the project's earliest stages. Representatives from Willdan Engineering and the City's Engineering division affirm that ADG's proposed design fees, less than 6% of total project cost, are consistent with industry and market standards for a project of this scope. Aquatic Design Group has proposed fees for design development in the amount of $522,450. The portion of these fees (67% of total project) attributable to Rosemead Aquatic Center are eligible for existing and future bond proceeds. Thus, $350,041.50 of design costs can be charged to existing 2006A Bond proceeds. Because the Garvey Aquatic Center falls outside either project area, it is not eligible for RDA bond funding. Therefore, with City Council approval, it will be funded through the RDA loan repayment to the general fund. That funding will include the design development phase of the project at $172,408.50, payable upon receipt of the proposed 2010 bond proceeds. PUBLIC NOTICE PROCESS This item has been noticed through the regular agenda notification process. City Council Meeting May 11, 2010 Page 3 of 3 FISCAL IMPACT: A request to appropriate $350,041.50 from the existing 2006A bond proceeds is included in order to complete design develop of the proposed Rosemead Aquatic Center. It is anticipated that the proposed Garvey Aquatic Center, including design development, will be paid for through an RDA loan repayment to the General Fund in conjunction with the proposed 2010 Tax Allocation Bonds. Thus, an additional appropriations request will be forthcoming. I.1 Rosemead Park Aquatic Center which includes the following elements: demolition of existing pool building, mechanical building, and swimming pool and pool deck; new bathhouse of approximately 3.850 SF; new utility points of connection; new structures and solar system; new 25Y x 45M swimming pool; new pool decks and deck drainage; and associated landscape. 2.1.2 Garvey Park Aquatic Center which includes the following elements: demolition of existing pool building, mechanical enclosure, swimming pool and pool deck; new bathhouse building of approximately 2,480 SF; new utility points of connection; new shade structures; new wet play area; new teaching pool; new water slides; new pool deck and deck drainage; and associated landscape. 3.0 SCOPE OF SERVICES 3.1 Schematic Design Phase: 3.1.1 CONSULTANT shall review the program furnished by CLIENT to ascertain the requirements of the project and shall arrive at a mutual understanding of such requirements with CLIENT. Schematic Design Phase deliverables shall include the following: . I Swimming pool plan views. .2 Swimming pool longitudinal sections. .3 Swimming pool finish details. .4 Swimming pool decks and drainage details. .5 Site and building plan views. .6 Building longitudinal sections. .7 Building finish details. .8 Landscaping and hardscape details. 3.1.3 CONSULTANT shall submit to CLIENT an estimate of probable construction cost based upon current area, volume, or other unit costs. 3.2 Design Development Phase: 3.2.1 Based upon the approved Schematic Design Documents and any adjustments authorized by CLIENT in the program, schedule or construction budget, CONSULTANT shall prepare, for approval by CLIENT, Design Development Documents consisting of drawings and other documents to fix and describe the size and character of the Project as to architectural, structural, mechanical and electrical systems, materials and such other elements as may be appropriate. Design Development Phase deliverables shall include the following .I Swimming pool plan views. .2 Swimming pool longitudinal and cross-sections. .3 Swimming pool finish details. .4 Swimming pool rail goods / competitive equipment details. .5 Site and building plan views. .6 Building longitudinal sections. .7 Building finish details. .8 Landscaping and hardscape details. Proposal for Consultant Services Rosemead and Garvey Park Aquatic Centers- Rosemead, California Page 3 of I I 9 Outline specification in CSI format 10 Swimming pool decks and drainage details. 3.2.2 CONSULTANT shall provide CLIENT with building and infrastructure requirements, including design criteria, as needed to service the swimming pool and building equipment, including. .I Swimming pool equipment room dimensions. .2 Building mechanical room dimensions. .3 Sanitary/storm sewer requirements and points of connection. .4 Domestic water requirements and points of connection. .5 Natural gas requirements and points of connection. .6 HVAC requirements for swimming pool and building equipment. .7 Electrical requirements and points of connection for swimming pool and building equipment. .8 Swimming pool decks and drainage details .9 Landscaping and hardscape details. 3.2.3 CONSULTANT shall advise CLIENT of any adjustments to the estimate of probable construction cost. 3.3 Construction Documents / Permit Drawings Phase: 3.3.1 Based upon the approved Design Development Documents and any further adjustments in the scope or quality of the Project or in the construction budget authorized by CLIENT, CONSULTANT shall prepare, for approval by CLIENT, Construction Documents consisting of Drawings and Specifications setting forth in detail the requirements for construction of the swimming pools. Proposal for Consultant Services Rosemead and Garvey Park Aquatic Centers- Rosemead, California Page 5 of I I • Final form swimming pool technical specifications in CSI format • Swimming pool decks and appurtenances details 3.3.2 CONSULTANT shall advise CLIENT of any adjustments to previous estimates of probable construction cost indicated by changes in requirements or general market conditions. 3.3.3 CONSULTANT shall assist CLIENT in the preparation of the necessary bidding information, bidding forms, the Conditions of the Contract, and the form of Agreement between the Owner and the Contractor, as it relates to the design program elements. 3.3.4 CONSULTANT shall assist CLIENT in connection with CLIENT's responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the Project. 3.4 Construction Observation Phase: 3.4.1 CONSULTANT shall be a representative of and shall advise and consult with CLIENT: 1) during construction until final payment to the Contractor is due; and 2) as an Additional Service at CLIENT's direction from time to time during the correction period described in the Contract for Construction. CONSULTANT shall have authority to act on behalf of CLIENT only to the extent provided in this proposal unless otherwise modified. CONSULTANT shall provide the following construction support services: I Provide clarification, as required, of construction documents and respond to contractor requests for information. .2 Review and approval of swimming pool-related sample and material submittals specified in Contract Documents. .3 Assistance with the issuance and negotiation of change orders. .4 Review of contractor-submitted Record Drawings for contract conformance and completeness based upon field observations. 3.4.2 CONSULTANT shall visit the site at intervals appropriate to the stage of construction or otherwise agreed by CLIENT and CONSULTANT in Proposal for Consultant Services Rosemead and Garvey Park Aquatic Centers- Rosemead. California Page 6 of I I writing to become generally familiar with the progress and quality of the Work completed and to determine in general if the Work is being performed in a manner indicating that the Work when completed will be in accordance with the Contract Documents. However, CONSULTANT shall not be required to make exhaustive or continuous on-site inspections to check the quality or quantity of the Work. On the basis of on-site observations, CONSULTANT shall keep CLIENT informed of the progress and quality of the Work, and shall endeavor to guard CLIENT against defects and deficiencies in the Work. 3.4.3 CONSULTANT shall visit the site at approximately eleven (11) months following the completion of project to conduct a warranty review / site walk with CLIENT and owner. Other than reimbursable expenses which will be billed in accordance with 7.1.3 below, CLIENT will not be billed for this visit 3.5 Visits to the Project Site: 3.5.1 CONSULTANT shall visit the offices of CLIENT and/or the Project Site in conformance with the following schedule: .I Schematic Design Phase .2 Design Development Phase .3 Construction Documents Phase .4 Construction Observation Phase .5 1 1-Month Warranty 4.0 EXCLUSIONS TO SCOPE OF SERVICES Two (2) site visits Two (2) site visits Four (4) site visits Twelve (12) site visits One (I) site visit 4.1 CLIENT shall provide full information regarding requirements for the project, including a program which shall set forth CLIENTs design objectives, constraints and criteria, including space requirements and relationships, flexibility and expandability, special equipment, systems and site requirements. Additional information that may be required by CONSULTANT as prepared by other members of the project team shall include: Proposal for Consultant Services Rosemead and Garvey Park Aquatic Centers- Rosemead, California Page 7 of I I 4.1.1 Soils testing/engineering, including finalized geotechnical investigation report Note: Unusual soil conditions such as expansive soils, fill soils, . soils with low bearing capacity (under 2,000 psf), and high water tables which require additional engineering will be considered an additional service and compensated for in conformance with Article 7.1.2, below. 4.1.2 Destructive testing of existing pool structures to confirm as-built condition. Note: CONSULTANT cannot guarantee structural integrity of existing pool structures without confirming as-built condition of pool wall thickness, concrete reinforcement and compressive strength. Additional engineering for deficient structures will be considered an additional service and compensated for in conformance with Article 7.1.2, below. 4.1.3 Site topography surveys. 4.1.4 Miscellaneous plan check and permit fees as may be required by regulatory agencies. 5.0 INDEMNITY 5.1 The CONSULTANT agrees, to the fullest extent permitted by law, to indemnify and hold the CLIENT harmless from any damage, liability or cost (including reasonable attorney's fees and costs of defense) to the extent caused by the CONSULTANT's negligent acts, errors or omissions in the performance of professional services under this Agreement and those of his or her subconsultants or anyone for whom the CONSULTANT is legally liable. The CLIENT agrees, to the fullest extent permitted by law, to indemnify and hold the CONSULTANT harmless from any damage, liability or cost (including reasonable attorney's fees and costs of defense) to the extent caused by the CLIENT's negligent acts, errors or omissions and those of his or her contractors, subcontractors or consultants or anyone for whom the CLIENT is legally liable, and arising from the project that is the subject of this Agreement The CONSULTANT is not obligated to indemnify the CLIENT in any manner whatsoever for the CLIENT's own negligence. 6.0 USE OF DOCUMENTS / ELECTRONIC FILES Proposal for Consultant Services Rosemead and Garvey Park Aquatic Centers- Rosemead, California Page 8 of I I 6.1 CLIENT acknowledges the CONSULTANT's construaion documents as instruments of professional service. Nevertheless, the drawings and specifications shall become the property of CLIENT upon completion of the work and payment in full of all monies due to the CONSULTANT. CLIENT shall not reuse or make any modifications to the drawings and specifications without the prior written consent of CONSULTANT. CLIENT agrees, to the fullest extent permitted by law, to indemnify and hold the CONSULTANT harmless from any claim, liability or cost (including reasonable attorney's fees and defense costs) arising or allegedly arising out of any unauthorized reuse or modification of the construction documents by CLIENT or any person or entity that acquires or obtains the plans and specifications from or through CLIENT without the written authorization of the CONSULTANT. 6.2 Electronic files may be provided by CONSULTANT for review by CLIENT and use by the Design Team in the preparation of construction documents. CONSULTANT assumes no responsibility for determining whether the data or software format are correct, up-to-date, or together represent actual conditions, or liability for the translations or results thereof. Acceptance or use by CLIENT of electronic files shall constitute a total release from liability, and as an indemnification for all costs or expenses from any claims, suits, judgments, or any other actions or liability as a result of such use. Under no circumstances shall delivery of the electronic files be deemed a sale by CONSULTANT, and CONSULTANT makes no warranties, either express or implied, of merchantability and fitness for any particular purpose. In no event shall CONSULTANT be liable for any loss of profit of any consequential damages as a result of re-use of electronic files. Drawing plan views may be delivered in AutoCAD dwg or Adobe.pdf format. Drawing detail sheets will be delivered in Adobe pdf format only. For use outside of the Design Team or for purposes other than the generation of construction documents a handling fee of $250.00 plus $25.00 per drawing sheet shall be remitted to CONSULTANT. 7.0 COMPENSATION 7.1 CLIENT shall compensate CONSULTANT for services rendered as follows: 7.1.1 Basic Services: The Scope of Services described above shall be compensated for by a lump sum, fixed fee equivalent to: FIVE Proposal for Consultant Services Rosemead and Garvey Park Aquatic Centers- Rosemead, California Page 9 of I I HUNDRED EIGHTY THOUSAND FIVE HUNDRED AND 00/100 DOLLARS ($580,500.00) equivalent to 7% of construction valuation. 7.1.2 Additional Services: If requested, additional services will be billed for on an hourly basis, in conformance with the rates outlined in Article 7.3, below. 7.1.3 Reimbursable Expenses: In addition to basic compensation, an allowance of $2,000 shall be provided for reimbursable expenses. Reimbursable expenses will be billed at CONSULTANT's direct cost, and shall include the following: I Plotting and reproduction expense of Drawings, Specifications and other documents. .2 Special delivery and handling of documents and correspondence such as courier and overnight delivery services. .3 Travel and lodging expense associated with travel outside of Southern California in connection with the Project. 7.2 Terms of Payment 7.2.1 Payments for Basic Services shall be made based upon percentage of completion in not less than monthly installments, in conformance with the following schedule of values: I Schematic Design Phase $ 58,050.00 COMPLETED, .2 Design Development Phase $ 145,125.00 .3 Construction Documents Phase $ 290,250.00 .4 Bidding or Negotiation Phase $ 29,025.00 .5 Construction Observation Phase $ 58,050.00 7.3 Hourly Rates: 7.3.1 Compensation for additional services (when requested and authorized in advance by CLIENT) shall be provided in conformance with the following hourly rates: Proposal for Consultant Services Rosemead and Garvey Park Aquatic Centers- Rosemead. RESOLUTION NO. 2010-17 A RESOLUTION OF THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION, ROSEMEAD, CALIFORNIA APPROPRIATING $350,100 FOR ROSEMEAD AQUATIC CENTER DESIGN DEVELOPMENT Whereas, the FY 2009-10 budget was passed and adopted by the Community Development Commission on June 23, 2009; and Whereas, appropriations are the legal authority for redevelopment agencies to spend; and Whereas, as program and project plans change throughout the year, specific appropriations need to be amended to accommodate the changes; and Therefore, $350,100 is appropriated in 4215-4420-P53245 (Special Projects - Architectural Services - Aquatic Renovation - Rosemead) to be funded from 2006A Bond Proceeds for Rosemead Aquatic Center Design Development.
