CALL TO ORDER-.The regular meeting of the Planning Commission was called to order by Chairman DeTora at 7:35 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. Pledge of Allegiance was led by Commissioner Tury Invocation was delivered by Commissioner Ritchie 2. ROLL CALL: - Present: Tury, Ritchie, DeTora, Cleveland, Lowrey Ex officio: Dickey, Dilkes, Sullivan, Burns 3. APPROVAL OF MINUTES: Regular Meeting December 19, 1977 It was moved by Com1hissioner Tury, second by Commissioner Lowrey to approve the Minutes of December 19, 1977, as corrected. ROLL CALL VOTE: AYES: Tury, Ritchie, DeTora, Cleveland, Lowrey 4. ORAL COMMUNICATIONS FROM THE AUDIENCE- On items not on the Agenda- None 5. CONDITIONAL USE PERMIT 77-121- Continuation of consideration of modified plot plan.. Mr. Sullivan presented the Resolution with conditions as directed by the Planning Commission at their meeting on December 19, 1977. .Discussion by the'Commission Discussion ensued regarding the changing and addition of some of the conditions. Commissioner Cleveland made a motion to approve or disapprove Conditional Use Permit 77-121...IIe withdrew his motion... It was moved by Commissioner Cleveland, second by Commissioner Lowrey to deny CUP 77-121. The foregoing motion was withdrawn by the second. City Attorney Dilkes informed the Commission that without the approval-of a Negative Declaration or an EIR, the Commission could not vote on the Conditional-Use Permit. It was moved by Commissioner Tury, second by Commissioner Ritchie to approve the Negative Declaration. ROLL CALL VOTE: AYES: Tury, Ritchie NOES: DeTora, Cleveland, Lowrey Further discussion by the Commission involved requesting the applicant to prepare an Environmental Impact Report. Mr. Theodore Bentley, Manager/Partner, 525 Wilcox Avenue, Los Angeles, California, asked the Commission if he could be'heard at the end of the meeting. (under Item ##9). RECESS called at 8:00 p.m.- Reconvened at 8:07 p.m. 6. ZONE CHANGE FOR TENTATIVE TRACT 34148- Continuation from December 19, 1977 meeting. P.C. Meeting January 3, 1978 Page 3 7. PARCEL MAP 10219- A request by James Laing to subdivide a 13,026 sq. ft. lot into two parcels, located at 3041 North Walnut Grove Avenue. Mr. Sullivan presented the Staff Report Discussion by the Commission It was moved by Commissioner Ritchie, second by Commissioner Tury to approve Parcel Map 10219 and the Negative Declaration subject to the Findings listed in the Staff Report,' conditions of the City Engineer and Staff and following conditions. CONDITIONS: 1. 'The applicant shall comply with all the conditions set forth by the City Engineer except for #2 under "Mapping", the 15 ft. required drive will be modified to 14 ft. 2. Standards for residential driveways shall be of 2" of AC pavement over 3" base crushed rock. 3. All existing structures be brought up to minimum code or be replaced. 4. Block wall-to be constructed on rear.and southern property lines on Lot 2. ROLL CALL VOTE: AYES: Tury, Ritchie, DeTora, Cleveland, Lowrey 8. ZONE CHANGE 77-95- Tabled at the Planning Commission meeting held on November 7, 1977. Mr. Sullivan gave a summary of the Zone Change Addressing the Commission: Mr. & Mrs. Anthony Cappuccio Mr. Elia"s Rodriguez . Mr. Warren Johnson The above people all felt that the property would be worth more to the property owners if it were all zoned R-3 Discussion by the Commission It was moved by Commissioner Tury, second by Commissioner Ritchie to deny Zone Change 77-95, as it was inconsistent with the General Plan. ROLL CALL VOTE: AYES: Tury, Ritchie, DeTora, Cleveland, Lowrey RECESS called at 9:50 p.m.- Reconvened at 10:00,p.m. 9. ORAL COMMUNICATIONS FROM THE AUDIENCE Mr. Theodore Bentley, Manager/Partner and applicant for CUP 77-121, stated that he did not think it was fair that he could not appeal the action of the Planning Commission, and asked the Planning Commission to reconsider their earlier vote. Discussion by the Commission It was moved by Commissioner Cleveland, second by Commissioner Lowrey to reconsider.
