CALL TO ORDER - The regular meeting of the Planning Commission was called to order by Chairman Lowrey at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. Pledge.of Allegiance was'led by Commissioner Ritchie 2 Invocation was delivered by Chairman Lowrey ROLL CALL: Commissioners Ritchie, Lowrey, Cleveland, DeTora Absent: Handy (vacation) Ex officio: Attorney Wallin, Dickey, Sullivan, Burns. 3 APPROVAL OF MINUTES - Regular Meeting August 7, 1978. It was moved by Commissioner DeTora, second by Com- missioner Ritchie to approve the Minutes of July 17, 1978 as printed. ROLL CALL VOTE: AYES: Ritchie, Lowrey, Cleveland, DeTora ABSENT: Handy 4 5 6 ORAL COMMUNICATIONS FROM THE AUDIENCE - On any matter - None. PUBLIC HEARINGS Consideration of adoption of a new Noise Ordinance, (Resolution 78-18). Mr. Dickey presented the Resolution by Title only- Chairman Lowrey opened the Public Hearing at 7:40 p.m., it was closed accordingly. It was moved by Commissioner Cleveland to waive further reading and adopt Resolution 78-18; motion died for lack of a second. Discussion ensued by the Commission regarding a. Study Session to further review this Ordinance. It was unanimously agreed upon by the Commission to continue this matter until the next Planning- Com-mission meeting to be held-on August 21, 1978. Consideration of an Amendment to the Subdivision Ordi- nance regarding Park and Recreation fees. ZONE CHANGE 78-101 - Request from a c ange o zone -rom R-2 to R-3, 18 unit apartment complex at 2730 Avenue. (Resolution No. 78-17). Mr. Sullvivan presented the Staff Chairman Lowrey opened the. Walnut Grove Avenue Rosemead, California Mr. Bohanna submitted a petition signed by residents in the nearby vicinity, to the Planning Commission for their review. Mr. Bohanna was concerned with the noise, traffic, parking and other problems that would arise with the development of this project. He stated that he was not opposed to property being developed according to R-2 guidelines, but is definitely op- posed to R-3 zoning.for this area. Mr. Roger Hicks 7818 E. Hellman Avenue Rosemead, California Mr. Hicks was very concerned about the drainage of water onto his property if this project were approved. Mrs. Lillian Sacko 3220 Walnut Grove Avenue Rosemead, California Mrs. Sacko submitted pictures of traffic on Walnut Grove Avenue during peak hours. She also stated that there was already traffic problems there due to SCE Company, and that more development would only increase the problem. Mr. Pete Sacko 3220 Walnut Grove Avenue Rosemead, California Mr. Sacko complained about the parking problem on Walnut Grove Avenue. Mr. Juan Nunoz 2704 Del Mar Avenue Rosemead, California He stated that absentee landlords compound the prob- lems of unconcerning tenants causing disturbances. PROPONENTS Mr. Leon Payne 724 E. Valley Boulevard Rosemead, California P.C. Meeting August 7, 1978 Page 3 PROPONENTS (cont'd) 7. Mr. Payne, of Shannon Homes spoke about the good reputation of Shannon Homes, and felt that this project was in conformance with the General Plan of the City of Rosemead. OPPONENTS: Mr. Hicks spoke again ragarding the flow of water during rainy seasons onto his property. PROPONENT: Mr. Payne stated that a drainage plan to pump the water out, would be submitted to solve this problem. OPPONENTS: Mr. Bohanna asked if this a larger sewer capacity, dents be billed for this. project would necessitate and would the nearby resi- Mr. Sullivan responded that the sewer capacity was adequate. PROPONENT: Mr. Trant 2700 Walnut Grove Avenue Rosemead, California Mr. Trant stated that he was in favor of this Zone Change, and that the traffic problem was already there due to SCE Company and Title Insurance Company. Mr. Roy Morales, developer of said property, stated that this would be a first-class development, and that this project would keep the money in Rosemead. Also that the additional traffic that this project would create, would not be noticeable. He also stated that it is likely that one of the owners would live there at the project. Chairman Lowrey closed the Public Hearing at 9:05 p.m. Discussion by the Commission: Discussion ensued by the Commission regarding the drainage problem, trash pick-up and type of wall to be constructed. Also, consideration of a Design Overlay for the R-3 zone was discussed. Recess was called at 9:30 p.m.- Reconvened at 9:40 p.m. It was moved by Commissioner DeTora, second by Com- missioner Cleveland to approve Zone Change 78-101, and to adopt Resolution 78-17 as amended with the D-Overlay. CONDITIONAL USE PERMIT 78-131 - Request by Jesus Carrera or continuation o alcoholic beverages for on-site consumption, at 9736 Valley Boulevard, formerly known as "Shakey Jakes". Mr. Sullivan presented the Staff Report Chairman Lowrey opened the Public Hearing at 9:45 p.m., the Oath was administered accordingly. Mr. Weaver, the previous owner of above mentioned bar stated that he would be available for any help Mr. Carrera might need in the under-taking of this establishment. Mr. Carrera's daughter stated that her father was apprised of the conditions of this Conditional Use Permit. Public Hearing was closed at 9:45 p.m. Discussion by the Commission It was moved by Commissioner Ritchie, second by. Commissioner Cleveland, to approve Conditional Use Permit 78-131 for a period of two years. It was moved by Commissioner Cleveland, second by Commissioner Ritchie to approve Parcel Map 11038 with the following Conditions: 1. Applicant shall comply with the conditions as set forth in the report of the City Engineer. 2. Street dedication prior to the issuance of a building permit. Gary A. Kovacic, Attorney for Western Neon Sign Com- pany addressed the Commission and stated that in terms of the Ordinance, the owner has the right to erect the sign. Discussion by the Commission It was moved by Commissioner Cleveland, second by Commissioner Ritchie to waive further reading and adopt Resolution 78-16, denying Variance 78-85. RESOLUTION 78-20 - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD, A CHANGE OF ZONE IN ZONE CHANGE NO. 78-100. It was moved by Commissioner Ritchie, second by Com- missioner Cleveland to waive further reading and adopt Resolution 78-20 and the Negative Declaration.
