CALL TO ORDER- The regular meeting of the Planning
Commission was called to order by Chairman Lowrey
'
at 7:30 p.m., in the Council Chambers of the Rosemead
City Hall, 8838 Valley Boulevard, Rosemead, California.
Pledge of Allegiance was led by Commissioner Cleveland
Invocation was delivered by Commissioner Handy

APPROVAL OF MINUTES: Regular meeting May. 1978
It was moved by Commissioner DeTora; second by Com-
missioner Ritchie, to approve the Minutes of May 1,
1978, as printed.

CONDITIONAL USE PERMIT 78-126- A request by Alfredo

Chairman Lowrey opened the Public Hearing at 7:40
p.m., the Oath was administered accordingly.

Discussion by the Commission
It was moved by Commissioner Cleveland, second by
Commissioner DeTora, to approve Conditional Use
Permit 78-126, and the Negative Declaration, subject
to-..the. following conditions listed below, and the
findings as listed in the Staff Report.
CONDITIONS:
1. Secure appropriate Occupancy Permit and City
License.
2. Comply with the requirements of the Building/
Fire Departments.

3. Supply City approved trash containers and maintain
the property in a clean, litter-free state.
4. This Conditional Use Permit is approved for a
three year period, at which time it may be reviewed
for renewal by the Planning Commission without a
Public Hearing. This permit is not transferable
to future purchasers or occupants. The applicant
assumes responsibility for all conduct on the premises.
5. The bottle'storage area in the rear shall be com-
pletely removed and cleaned up, or an enclosed
storage bin be provided for all returned soda bottles.
6. Within ten (10) days after approval, the applicant
shall submit a notarized affidavit of agreement to
these conditions with the Planning Department.

reconvened at 8:40 p.m.
It was moved by Commissioner Cleveland, second by
Commissioner Handy to approve Design Review 78-1,
subject to the Conditions as listed in the Staff
Report.

4. This Conditional Use Permit is approved for
a two-year period, at.which time it may be
- reviewed for renewal by the Planning Commission
without a Public Hearing. This permit is not

5. It is hereby declared to be the intent of this
permit, that if the applicant fails to continue
operation of a bona fide restaurant, this permit
shall be void, and all of the privileges shall
lapse.
6. Applicant has adequate parking space available
on site, however, three (3) spaces are required
to be striped.
7. This permit is for the sale of alcoholic beverages
ancillary to the sale and service of food.
Accordingly, this permit shall lapse and be of
no further effect, if the receipts for the sale
of food shall be less than 50% of the gross receipts
for all sales at the location.
8. Within ten (10) days after approval, the applicant
shall submit a notarized affadavit of agreement:

Chairman Lowrey opened the Public Hearing at 7:55 p.m.,
the Oath was administered accordingly.

Discusson by the Commission
It was moved by Commissioner DeTora, second by Commissioner
Cleveland to approve Conditional Use Permit 78-127, and
the Negative Declaration, subject to the following Con-
ditions listed below, and the Findings as listed in the
Staff Report.
CONDITIONS:
1. Secure appropriate City license and permits.
2. Comply with requirements of the Building, Fire and
Health Departments. Compressor to be covered with
shield to satisfaction of Building Inspector.

Mrs. Huitron expressed her feelings that the installation
of.sidewalks would be impractical and not enhance the
beauty of the street.
Discussion by the Commission
It was moved by Commissioner DeTora, second by Commissioner
Cleveland, to defer this matter until the second meeting
in June.

10. WAIVER OF SECTION 8110 OF THE ROSEMEAD MUNICIPAL CODE-

Mr. Sullivan presented the Memorandum

Mr. Cruiz expressed his feelings regarding the expense
of installing the sidewalks.
Discussion by the Commission
it was moved by Commissioner Ritchie, second by
Commissioner Handy to defer this matter until the
first meeting in June.

12. MATTERS FROM CITY OFFICIALS AND STAFF
a) The Planning Director recommended that the Staff
do a study on Section 8110 of the Rosemead Municipal
Code regarding street improvements.
13. ADJOURNMENT- There being no further business to come
before the Commission, Chairman Lowrey adjourned the
meeting at 9:30 p.m. .
