1. CALL TO ORDER -.The regular meeting of the Planning
Commission was called to order by Chairman Lowrey at
7:30 p.m. in the Council Chambers of the Rosemead
City Hall, 8838 Valley Boulevard, Rosemead, California.
Pledge of Allegiance was led by.Commissioner DeTora
Invocation was delivered by Commissioner Cleveland
2. ROLL CALL - Commissioners Handy, Ritchie, Lowrey,
Cleveland, DeTora.
Ex officio: Dilkes, Dickey, Sullivan, Burns
3. APPROVAL OF MINUTES: Regular meeting October 2, 1978
Study Session - October 2, 1978
It was moved by Commissioner DeTora, second by Commissioner
Cleveland to approve the minutes of October 2, 1978, as
printed.

4. ORAL COMMUNICATIONS FROM THE.AUDIENCE - On any matter:
Mr. Terragas

Los Angeles, California
Mr. Terragas, representative for the California Campaign
for Economic Democracy, addressed the Commission and re-
quested permission to hold a fund raising party for 600
guests, with on-site sale and consumption of alcoholic
beverages on Saturday, October 14, 1978 at 3922 Delta.
Avenue, in the City of Rosemead.
Mr. Dickey referred to Planning Commission Resolution 77-34,
relating to requirements for a Conditional Use Permit in
order to sell alcoholic beverages.
Mr. Terragas was informed by the Commission that in order
to sell alcoholic beverages, he would have to,apply
for a Conditional Use Permit.
PUBLIC HEARINGS
5. CONDITIONAL USE PERMIT 78-135 - A request by Victor Fotia
or sale o a co o lc everages for on-site consumption in
conjunction with an existing bar, "Victor's", located at
9422 E. Valley Boulevard.
Mr. Sullivan presented the Staff Report
Chairman Lowrey opened the public hearing, the Oath. was
administered accordingly.
Mr. James White, Accountant for Mr. Fotia, was present and
representing Mr. Fotia.
Mr. White was asked by Commissioner Ritchie if the applicant
had read and understood the Staff- Report and all the Conditions
listed. Mr. White answered "yes".

5. CONDITIONAL USE PERMIT 78-135 (cont'd)
Commissioner DeTora asked the Staff if a "Cafe Incident
Report" had been made on "Victor's Mr. Sullivan re-
plied "no".
Mr. White explained that if there had been any complaints
regarding this establishment, that they were in reference
to the previous owners, that Mr. Fotia had only been opera-
ting this bar for a period of three weeks.
Chairman Lowrey closed;the public hearing
Discussion by the Commission ensued regarding the merits
of this request by Mr. Fotia.
It was moved by Commissioner Cleveland, second by Com-
missioner Ritchie to approve Conditional Use Permit 78-135
with the conditions and findings as listed in the Staff
Report, and the four additional conditions:
ADDITIONAL CONDITIONS:
7) Automatic'door closing devices be installed to
the satisfaction of Fire Marshall. Doors to be
closed during all hours of operation.- _
8) Safety shield to be constructed to surround
compressors.
9) .,All waiters, waitresses, entertainers and other
employees shall be fully clothed.
10) Property to the east shall be-secured by lease
or covenant.to provide five (5) parking spaces
for the patrons of "Victor's Bar".

6. ZONE CHANGE 78-99 - Request by John Lovato for a Change
o 'Lone from R- to R-3, located at 4445 Walnut Grove
Avenue. (cont'd from August 21, 1978 meeting).
Mr. Sullivan reviewed the Zone Change
Chairman Lowrey opened the public hearing, it was closed .
accordingly.
Discussion by the Commission
It was moved by Commissioner DeTora, second by Commissioner
Cleveland to defer this matter until November 20, 1978.

DeTora.
7. ZONE CHANGE 78-102 - Request by Edward Mueller for a Change
o Zone From R- to R-3; located at 4213-4221 Walnut Grove
Avenue. (cont'd from August 21, 1978 meeting).
Mr. Sullivan reviewed the Zone Change.
Chairman Lowrey opened the public hearing,it was closed
accordingly.
Discussion by the Commission
It was moved by Commissioner DeTora, second by Commissioner
Cleveland to defer this matter until November 20,.1978.
The Staff requested continuations on both of these Zone
Changes until the.Condominium Ordinance could be completed.

OTHER BUSINESS
8. PARCEL MAP 11354 - Request by George Susan Kotchnik
or a minor su ivision of two lots into three separate
parcels, located at 3182, 3186 & 3188 Rosemead Place.
Mr. Sullivan presented the Staff Report
Discussion by the Commission ensued regarding the fact
that this subdivision did not meet the zoning require-
ments regarding area and parking area. The Commission
felt that this lot split should be brought up to standards.
It was moved uy Commissioner DeTora, second by Commissioner
Cleveland to deny Parcel Map 11354.
'Commissioner Cleveland withdrew his second and made a
Substitute motion to table Parcel Map 11354. This motion
was seconded by Commissioner Ritchie.
Commissioner Cleveland then withdrew his substitute motion.
It was moved by Commissioner DeTora, second by Commissioner
Cleveland to deny Parcel Map 11354.
ROLL CALL VOTE:: AYES: Handy, Ritchie, Lowrey, Cleveland,
DeTora.
9. RESOLUTION 78-25 - A RESOLUTION OF THE PLANNING COMMISSION
RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ROSEMEAD
ADOPTION OF AN AMENDMENT TO SECTION 330.4 OF THE SUBDIVISION
ORDINANCE.
It was moved by Commissioner Ritchie, second by Commissioner
Handy to waive further reading and adopt Resolution 78-25.

ON THE NORTH AND SAN GABRIEL BOULEVARD ON
It was moved by Commissioner Handy, second by Commissioner
Cleveland to waive further reading and adopt Resolution 78-26.

11. ORAL COMMUNICATIONS FROM THE AUDIENCE - On items not on the
Agenda:
Mr. Terracini, Building Contractor addressed the Commission
and requested information on the moratorium on condominiums.
He suggested that the amount of sq, ft. required for each
unit be lowered.
The Commission invited Mr. Terracini to the Study Session
meeting to be held on the Condominium and Sign Ordinances
on October 19, 1978. They also informed Mr. Terracini that
no'definite , decisions have been rendered pertaining to the
Condominium Ordinance.

Rosemead, California
Mrs. Hill addressed the Commission and requested to
know the City's philosophy in reference to the mora-
torium on both reconversion and new construction of
condominiums.
Mr. Sullivan explained that it would not be a piece-
meal type Ordinance, that the reason the two were
tied together, was to set up standards for both the
conversions and new construction of condominiums in
the City of Rosemead.
Mrs. Hill was also invited by the Commission to attend
the Study Session regarding this matter, on October 19,
1978.
12. MATTERS FROM CITY OFFICIALS AND STAFF
1) The Commission was polled for a luncheon meeting
to be held on Friday, October 20, 1978,
2) Attorney Edward Dilkes informed the Commission of
the results of the Doerkin vs. City of Rosemead
case. He also stated that a memorandum would be
sent to the City Council and, also to the Planning
Commission, relating to both, the outcome of the
case.
3) Chairman Lowrey suggested that the Staff obtain
a "Cafe Incident Report" for each Conditional
Use Permit requested for the sale of alcoholic
beverages.
13. ADJOURNMENT - There being no further business to come
before the Commission, Chairman Lowrey adjourned the
meeting at 9:05 p.m., to the Study Session to be held
on October 19, 1978 at 7:30 p.m. in the Conference Room
of Rosemead City Hall. This Study Session will be held
to study and review the Sign and Condominium Ordinances.
