CALL TO ORDER The regular meeting of the Planning Commission was called to order by Chairman Lowrey at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. Pledge of Allegiance was led by Commissioner Ritchie Invocation was delivered by Commissioner-Handy 2. ROLL CALL: Commissioners Handy, Ritchie, Lowrey, Cleveland, DeTora Ex officio: Wallin, Dickey, Christianson, Burns 3. APPROVAL OF MINUTES Regular meeting August 21, 1978 It was moved by Commissioner Ritchie, second by Com- missioner Cleveland to approve the minutes of August 21, 1978 as,printed. ROLL CALL VOTE: AYES: Handy, Ritchie, Lowrey, Cleveland, DeTora . 4. ORAL COMMUNICATIONS FROM THE AUDIENCE On any matter- None. PUBLIC HEARINGS 5. CONDITIONAL USE PERMIT 78-132- A request by Salvador cn Maria Sanc ez for t e o f-site sale of alcoholic beverages in conjunction with a market located:.at 7735 east Garvey Avenue. Ms. Christianson presented the Staff Report Chairman Lowrey opened the public hearing at 7:4S p.m. The Oath was administered accordingly. Proponent: Deloris Salcido. 809 N. Garfield Avenue Alhambra, California Mrs. Salcido is the daughter of Mr. and Mrs. Jones, the owners of the property where the market is to be located. Mrs. Salcido stated that at this time, the applicants were not financially able to refurbish the entire three rooms of the structure, but that the first room would be brought up to Health, Fire and Safety codes. (This would be the room where the actual market would be). Mr. Joe Sanchez, Son of the applicants 3409', Roseview, Los Angeles, California Mr. Sanchez stated that after business picked up, the other rooms would be brought up to code, but in any event, they would be painted now. Meeting • 4' September S, 100 Page 2 Chairman Lowrey closed the public hearing at 8:00 p.m. Discussion by the Commission Discussion ensued by the Commission regarding the assurance that the other rooms would be brought up to code.in conjunction with 7735 Garvey Avenue. Chairman DeTora requested copies of permits for all existing structures at the above mentioned address. Recess was called at 8:35 p.m.- Reconvened at 8:50 p.m. It was moved by Commissioner Ritchie, second by Com- missioner Cleveland to approve Conditional Use Permit 78-132 as follows: Conditional Use Permit 78-132 shall only be granted, and not become effective, until the nine (9) conditions are met, as.outlined in the Staff Report, and approve the Negative Declaration and its findings. Condition # S amended to read as follows: Condition #S. All existing trash,.:.debri and illegal structures on the property shall be removed within 30 days of this permit. ROLL CALL VOTE: AYES: Commissioners Handy, Ritchie, Lowrey, Cleveland, DeTora 6. CONDITIONAL-USE PERMIT 78-133 -A request.by Mary Flores for the off-site sale of alcoholic beverages in conjunction with an existing market, (Angie's), located at 3200 Del Mar Avenue. Ms. Christianson presented the Staff Report Chairman Lowrey opened the public hearing at 9:00 p.m., The Oath was administered accordingly. Mr. Leon Nardoni (neither for nor against) 7831 E. Emerson Rosemead, California Mr. Nardoni stated that if this permit should be granted, that Garvey Park and the school on Dorothy Avenue should be taken into consideration. Fie stated that there is consumption of alcoholic beverages in the park and that signs should be posted in more places than are present now, and perhaps . even larger signs. Recess was called at 9:10 p.m. (problem with the tape recorder), reconvened at 9:15 p.m. Mary Flores, Applicant 3354 Ivar,,Rosemead Mrs. Flores stated that she could understand Mr. Nardoni's concern for the consumption of alcohol in the parks, but that she had.no control over that. The public hearing was closed at 9:20 p.m, Discussion by the Commission ensued regarding the fact that there had been some complaints on the said property. Commissioner Cleveland suggested that Staff obtain police reports on any incidents that have occured. P.C. Meeting September S, 10 Page 3 Ms. Christianson explained Incident Report obtained, had been reported. that there had been an and that no incidents Mr. Dickey asked Mrs. Flores if she was using any- thing on the outside of the structure, whereby any, graffiti would be repelled. Mrs. Flores stated that she didn't know of any such treatment for this problem,,but that she would look into it. It was moved by Commissioner Cleveland, second by Commissioner DeTora, to approve Conditional Use Permit 78-133, subject to the conditions as listed. in the Staff Report, and approve the Negative Declaration. Condition #2 was amended to read as follows: Condition #2: Comply with the requirements of the Building, Health and Fire Departments. ROLL CALL VOTE: AYES: Commissioners Handy,_Ritchie, Lowrey,.Cleveland, DeTora 7. CONDITIONAL USE PERMIT 78-134 - A request by the Committee of Baha'i Faith to hold religious meetings in a CBD zone, located at 4022 Rosemead Boulevard. Ms. Christianson presented the Staff Report Chairman Lowrey opened the public hearing at 9:4S p.m., The Oath was administered:-.accordingly. Mr. James F. Nelson, Judge of the Municipal Court of Los Angeles addressed the Commission. Judge Nelson stated that he had read the Staff Report and was,in agreement with the conditions listed. Attorney Fred W. Bruning, also a member of the Com- mittee of Baha'i Faith, stated that he would submit a copy of the lease verifying the availability of parking. Discussion by the Commission ensued regarding seating capacity. It was determined that the occupancy load' would be determined by the Fire Department. Chairman Lowrey closed the public hearing at 10:10 p.m It was moved by Commissioner Ritchie, second by Com- missioner Handy to approve Conditional Use Permit 78-134, and the Negative Declaration, subject to the conditions as listed in the Staff Report. Condition # 9 was added to read as follows: Condition #9: The applicant shall document availa- bility of and maintain parking meeting or exceeding the requirements of Sections 91.22.7 and. 9122.12 of the Rosemead Municipal Code. ROLL CALL VOTE: AYES: Handy, Ritchie, Lowrey NOES: Cleveland, DeTora ABSENT: None ABSTAIN: None Commissioner Cleveland requested that the record show the reason he voted no was due to the difference of P.C. Meeting September 5, 1910 Page 4 opinion between the City Attorney and himself, in the interpretation of the parking ordinance. Commissioner DeTora requested the record to show that the reason lie voted no, was that he did not feel that there was ample availability of parking for this use at this location. OTHER BUSINESS 8. CONDITIONAL USE PERMIT 58 - Request by Mrs. Chandler or an extension of "Little People Pre-School", located at 4715 Rosemead Boulevard. Ms. Christianson presented the Staff Report Marlene MacRae, operator of said Pre-School 133 California, #5, Arcadia, California. 9 10 Ms. MacRae requsted that Condition #2 of this Con- ditional Use Permit be modified, due to the fact that the State and County have such stringent'in- spections before approval of new ownership. Discussion by the Commission It was moved by Commissioner Handy, second by Com- missioner Cleveland to approve Conditional Use Permit 58 subject to the conditions as listed in the Staff Report. Condition #2.modified to read as follows: Condition #2: This permit is not transferable to future purchasers or occupants without the approval of the Planning Commission; which approval may be granted without a public hearing. ROLL CALL VOTE: AYES: Handy, Ritchie, Lowrey, Cleveland, DeTora PARCEL MAP 11188 - Request by Ron Panich for a minor subdivision to create three parcels located at 3148 Burton Avenue. Ms. Christianson presented the Staff Report Mr. Matthew Messier, Real.Estate agent representing 4177 E. Live-Oak the owner. Arcadia, California Mr. Messier discussed the location of the garage. Staff assured the Commission that relocation of the garage would have to be approved by the Planning Department prior to issuance of building permits. It was moved by Commissioner Ritchie, second by Com- missioner Handy to approve Parcel Map 11188 subject to the Conditions as listed in the Staff Report.an. f/ also the recommendations of the County Engineer. J Added Condition # 3 to:.-read as follows: Condition #3: The driveway Maintenance Agreement be recorded on the final Parcel Map. ROLL CALL VOTE: AYES:. MATTERS FROM CITY OFFICIALS AND STAFF a) Date for Study Session was set to review the first draft of the Condominium Ordinance, and Sign Ordinance. b) Commissioner DeTora suggested that Staff have a police report for all Conditional Use Permits requesting the sale of alcoholic beverages. Ms. Christianson informed the Commission- that we do obtain "Cafe Incident Reports" on such matters. c) Chairman Lowrey stated that he would be on vacation starting the 1Sth of September and requested Vice Chairman Ritchie to act as Chairman for the next meeting to be held on September 18, 1978. 12. ADJOURNMENT - There being no:-further business to come before the Commission, Chairman Lowrey adjourned the meeting to a Study Session meeting to be held at the Community Center on September 11, 1978 at 7:00 p.m.
