ROLL CALL Present: Commissioners Cianciola, DeTora, Lowrey, Tury Absent: Ritchie Ex Officio: Dickey, Dilkes, Sullivan, O'Connor, Young 3. STUDY SESSION Commission set Wednesday, January 12, 1977, 7 p.m.; and Wednesday, January 19, 1977, 7 p.m., as dates for study of Relocation Ordinance. Commissionheld a policy review on several subjects, including sale of beer in service stations and plans for discussion on a new Subdivision Ordinance. 4. ADJOURNMENT - 7:25 p.m. REGULAR MEETING 1. APPROVAL OF MINUTES Ritchie, Tury It was moved by Commissioner Tury, seconded by Commissioner Cianciola and carried to approve the minutes of the Special Meeting of December 16, 1976, and the regular meeting of December 20, 1976. ROLL CALL VOTE: AYES: Ritchie, Lowrey, DeTora, Cianciola, Tury NOES: None ABSENT: None 4. ORAL COMMUNICATIONS FROM THE AUDIENCE Addressing Dale Denton Commission: 2508 Medwickhill Dr., Alhambra 91803 Mr. Denton wished to know Commiss_on's views regarding building a trailer park in an area of Rosemead now zoned M-1. Commission advised Mr. Denton to contact Planning Staff regarding details of zone change request and conditional use permit. 5. ZONE CHANGE 76-82 - Applicant requested change of zone on property located at 3953 N. Muscatel from P-d Parking with design overlay to R-1 Single Family Residential (Rosemead Mortgage Corp.) Commission: 2760 Hacienda Blvd., Hacienda Heights Mr.Peterson submitted to the Commission ,a statement from the prospective buyer of the lot in question stating they would comply with the block wall requirement within one year. Discussion by Commission. Addressing James Rector Commission: 128-0 S. Curtis, Alhambra 91801 Mr. Rector questioned the requirement of a block wall on the property in question. Attorney Dikes stated legal interpretation requiring the Rosemead Mortgage Corp. to be responsible for construction of a wall whether or not it is built by the prospective buyer. Addressing 11el:ritt H. Peterson . Commission: 2760 Hacienda Blvd., Hacienda Heights Mr. Peterson stated that he felt the Planning Commission was penal- izing him by requiring him to build a block wall because Rosemead Mortgage Corp. happens to own the adjacent commercial lots. It was moved by Commissioner Lowrey, seconded by Commissioner Tury and carried to approve Zone Change 76-82 subject to the construction of a 6-foot block wall along the north property line within one year; and approve the Negative Declaration; and direct Staff to prepare a Resolution. ROLL CALL VOTE: AYES: Lowrey, DeTora, Cianciola, Tury NOES: None ABSTAIN: Ritchie ABSENT: None 6. PARCEL MAP 7612 - A request to subdivide two lots from one existing parcel. Mr. Sullivan presented the Memorandum. Addressing Thomas DeFilippis, representing applicant Commission: 3248 N. Stevens, Mr. DeFilippis questioned the requirement to install new street improvements when county-standard improvements are already installed. Discussion by Commission. Recess called at 8:38 p.m.; Commission reconvened at 8:47 p.m.':*** Discussion by Commission. It was moved by Commissioner Ritchie, seconded by Commissioner Tury, and carried to approve Parcel Map 7612 subject to the dedication of 4 feet from Lot 2,.and approve the Negative Declaration. CONDITIONAL USE PERMIT 71 - Consideration of a request for extension of CUP 71 for sale of alcoholic beverages within 200 feet of a residential zone (Wagon Wheel). Mr.Sullivan presented the Staff Report. Planning Commission Minutes January 3, 1976 Page 3 It was moved by Commissioner Tury, seconded by Commissioner Lowrey, and carried to add "with benefit of public hearing" to Condition 2 of the conditions listed on PC Resolution 75-5. ROLL CALL VOTE: AYES: Ritchie, Lowrey, DeTora, Cianciola, Tury NOES: None ABSENT: None Discussion by Commission. It was moved by Commissioner Tury, seconded by Commissioner Lowrey, and carried to approve the extension of CUP 71 for a period of two years subject to findings and conditions as listed on PC Resolution 75 -5 . ROLL CALL VOTE: AYES: Ritchie, Lowrey, DeTora, Cianciola, Tury NOES: None ABSENT: None 8. CONDITIONAL USE PERMIT 80 - Consideration of a request for extension of CUP 80 for sale of alcoholic beverages within 200 feet of a: residential zone (Paul's Steak House). Mr. Sullivan presented the Staff Report. Discussion by Commission. It was moved by Commissioner Tury to change Condition 3 of conditions listed on PC Resolution 75-8 to read , for renewal by the Planning Commission with benefit of a public hearing." Motion died for lack of a second. It was moved by Commissioner Cianciola, seconded by Commissioner Lowrey and carried to approve the extension of CUP 80 for a period of 5 years subject to findings,and conditions as set forth in PC Resolution 75-8. RESOLUTION 77-1 - A RESOLUTION OF THE PLANNING COMMISSION RECOM- MENDING TO THE CITY COUNCIL APPROVAL OF AMENDMENT TO SECTION 9183.1 OF THE ROSEMEAD MUNICIPAL CODE. It was moved by Commissioner Ritchie, seconded by Commissioner Tury, and carried to adopt PC Resolution 77-1 subject to changing "10 days" to "30 days" in Paragraph B of the proposed amendment as written in Section 2. ROLL CALL VOTE: AYES: Ritchie, Lowrey, DeTora, Cianciola, Tury NOES: None ABSENT: None lp. AMENDMENT TO ZONING ORDINANCE - Consideration of Amendment to the Zoning Ordinance regarding block walls. Discussion by Commission. Commission agreed to continue the matter to a later date, pending further investigation by the Planning Staff. Commissioner Ritchie recommended a study session. Planning Commission Minutes Page 4 January 3, 1977 11. MATTERS FROM CITY OFFICIALS AND STAFF a. Commission and Officials were polled regarding attendance at the Southern California Planning Congress Meeting on Jan. 13. .b. A reminder was given regarding the Planning Commissioners' Institute to be held February 2 - 4 in Los Angeles. c. It was moved by Commissioner Lowrey and seconded by Commissioner Cianciola to recommend to City Council adoption of an Emergency Ordinance regarding a Moratorium on sale of beer and wine in gas stations. Discussion by Commission. ROLL CALL VOTE: AYES: Ritchie, Lowrey, DeTora, Cianciola NOES: Tury ABSENT: None Commissioner Tury wished to state that his "NO" vote was a result of his belief that the City could not legally outlaw this practice. d. Mr. Dickey questioned Commissioner Tury if he wished to pursue the matter of a Rosemead Beautification Committee. Commissioner Tury replied affirmatively. e. Commissioner Tury questioned when the Outdoor Display and Storage Amendment went before the City Council. Mr. Sullivan replied that it was scheduled to go before Council on January 25. f. Reorganization of the Planning Commission was scheduled for the end of the meeting to be held on January 17. 12. ORAL COMMUNICATIONS FROM THE AUDIENCE Addressing Luis Pingarron Commission: 2743 Denton Mr. Pingarron wished to comment on certain "eyesore" businesses in his neighborhood and general deteriorated conditions which he felt breed juvenile delinquents and crime. He also felt the Block Wall Ordinance would be beneficial. Planning Staff will investigate the matter. Commissioner Ritchie requested Planning Staff's intentions regarding the Block Wall Amendment. Mr. Sullivan expounded on Staff's plans and problems involved. 13. ADJOURNMENT At 9:45 p.m., Chairman DeTora adjourned the meeting to January 12, 1977, 7 p.m., for purpose of a study session.
