DECEMBER 6, 1976,
1. CALL TO ORDER - 7:34 p.m.
Pledge of Allegiance was led by Commissioner DeTora.
Invocation was delivered by Commissioner Cianciola.

3. APPROVAL OF MINUTES - Regular Meeting - November 15, 1976
It was moved by Commissioner Tury, seconded by Commissioner
Lowrey and carried to approve the minutes of November 15, 1976.

ABSTAIN: Ritchie.(by reason of absence at November 15 meeting)
4. ORAL COMMUNICATIONS FROM THE AUDIENCE - None
PUBLIC HEARING
5. ZONE CHANGE 76-81 - T>pplicant requested a change of zone on
property located at the southeast corner of Rush and Delta
Streets from R-3 Medium Multiple Residential to C-3 "tedium
Commercial (Southern California Edison).
Mr. Sullivan presented the Staff Report.
Chairman DeTora opened the public hearing at 7:40 p.m.
Oath was administered.
Proponent: Don Bailey, Area Manager - So. Calif. Edison

Mr. Bailey reiterated the Staff's recommendations and asked for the
Commission's approval of this zone change.
Opponent: Jack Devine
1638 N. Delta, S. San Gabriel (county area)
Mr. Devine stated his concern over the types of business that could
occupy the C-3 Zone if changed and the ensuing traffic problems
and lack of "buffer zcne" for residents in the area.
Opponent: John D. Gandara
1616 N. Delta, S. San Gabriel (county area)
Mr. Gandara was also concerned over effects of a C-3 Zone on resi-
dents and the ensuing traffic.
Addressing Mrs. Jensen
Commission: 8420 E. Yarrow, S. San Gabriel (county area)
Mrs. Jensen wanted to know how high a structure could be built in
the C-3 Zone.

Mr. Saucedo stated his concern over the proposed zone change.

Mr. Treu wanted to know if residents would get notification if
Edison decided to build on the property.
Commission answered him affirmatively.

Mr. Devine requested minutes of the Planning Commission meeting
wherein Edison requested the change to their present zone, and
a copy of the Negative Declaration prepared for the current
request for zone change.
Attorney Dilkes explained environmental assessments.
Chairman DeTora closed the Public Hearing at 8:18 p.m.
Discussion by Commission
Commissioner Ritchie suggested a change of zone to P-O Professional
Office rather than C-3.
It was moved by Commissioner Lowrey, seconded by Commissiofter
Cianciola and carried to re-open the Public Hearing.

Mr. Saucedo stated his concern over possible effects of a C-3 Zone.
Attorney Dilkes clarified what could transpire if area were zoned
C-3.

Commission: Royce Company
Mr..Chong stated that his company represented Title Insurance,
who were investigating the feasibility of locating a facility
in Rosemead. He emphasized that this was tentative, and only the
first stage of their studies.
Addressing Rolf Treu
Commission: 1827 N. Delta, Rosemead
Mr. Treu stated that in a property owners meeting (condominiums)
with So. Calif. Edison, the company affirmed that any development
of an establishment in the proposed C-3 area would be a use that
is consistent with the use that has been put to the adjacent
property. Mr. Treu felt these comments should be kept in mind when
and further discussion regarding Edison is made.

It was moved by Commission Ritchie to continue the matter until
December 20. Commissioner Cianciola seconded the motion for
reason of discussion.

6. RESOLUTION 76-22 - A resolution of the Planning Commission recom-
mending to the City Council approval of the amendment to Section
9121.18 of the Rosemead Municipal Code (Display and Storage).
It was moved by Commissioner Tury, seconded by Commissioner
Cianciola and carried to approve Resolution 76-22 with the follow-
ing changes:
Delete second paragraph in part A.
Add "Outdoor Recreational Equipment" as an exception under
Part A and Part B.

7. RESOLUTION 76-23 - A Resolution of the Planning Commission recom-
mending to the City Council approval of the change of zone from
R-1 to C-3 for property located south of Valley, east of walnut
Grove (Reliable Lumber).
It was moved by Commissioner Tury, seconded by Commissioner DeTora
and carried to approve the Resolution 76-23 as written.

8. CONDITIONAL USE PERMIT 72 - Consideration of a request for exten-
sion of CUP 72 for sale of alcoholic beverages within 200 feet of
a residential zone (Rose Room).
Mr. Sullivan presented the Staff Report.

Mr. Cirillo asked the Commission to approve extension of CUP 72.
Attorney Dilkes expounded on difference of opinion whether a
CUP could be "personal" or "going with the land".
It was moved by Commissioner Lowrey, seconded by Commissioner
Cianciola and carried to approve the extension of Conditional Use
Permit 72 for a period of 5 years, at which time the Commission
shall consider extension with benefit of public hearing; subject
to the conditions and.findings.set forth in PC Resolution 75-1
with the following change:
Section 4. (1) Dancing, if permitted, shall not be permitted
between the hours of 2 a.m. and 5 p.m. Monday
through Friday.

9. PARCEL MAP 7459 - A request to subdivide two lots from one
existing parcel located on the.south side of Valley Blvd.,

Cianciola and carried to approve Parcel Map 7459, and approve
the Negative Declaration.

10. TRACT MAP 33036 - A request for the subdivision of nine lots

Discussion by Commission
It was moved by Commissioner Ritchie, seconded by Commissioner
Tury and carried to approve Tract Map 33036 subject to the
recommendations of the County Engineer and Condition and Findings
of Staff, with the following modifications:
- Width of right of way_to be increased to 46 feet.
- Strike condition 13 from County Engineer's recommendations.
- Condition 11 of Ccunty Engineer's recommendations to read
"Provide 36 foot wide paving on the cul-de-sac with full width
sidewalks and a 5 foot utility easement."

- On existing house, bring garage up to code and leave access
from Muscatel.
- A 6 foot grapestake fence is to be built on back lines of
Lots 1 and 2.

11. AMENDMENT TO ZONING ORDINANCE - Consideration of amendment to
ordinance regarding block walls.
It was agreed by the Commission to continue discussion of the
amendment to January 3 meeting.

a. Attendance at the Southern California Planning Congress
Meeting on December 9 was discussed.
