1. CALL TO ORDER - 7:33 p.m.
Pledge of Allegiance was led by Commissioner Lowrey.
Invocation was delivered by Commissioner Tury.

3. APPROVAL OF MINUTES - Regular Meeting, November 1, 1976
It was moved by Commissioner Tury, seconded by Commissioner
Cianciola and carried to approve the minutes of November 1, 1976,
with the following addition to 11. Matters from City Officials
and Staff:
J. Commissioner Tury requested information on parking of cars,
boats and trailers in front yards, what ordinances are
available and what the apparent weaknesses are.

4. ORAL COMMUNICATIONS FROM THE AUDIENCE - None

5. CONDITIONAL USE PERMIT 76-7 - Request sale of beer and wine within
200 feet of residential zone at 8752 Valley Boulevard.

Chairman DeTora opened the public hearing at 7:40 p.m.

It was moved by Commissioner Lowrey, seconded by Commissioner
Tury and carried to require construction of a 6-foot block
wall separating the commercial use from the residential property
as a condition for approval of this Conditional Use Permit.

It was moved by Commissioner Lowrey, seconded by Commissioner
Cianciola and carried to approve Conditional Use Permit 76-7
with the following conditions:
1. The subject property shall be operated as a bona fide
restaurant. The right to serve alcoholic beverages shall
be.dependent upon the service of food on the premises.
2. All landscaped areas shall be equipped with a sprinkler system
and landscaping shall be continuously maintained and installed
as per approved Plot Plan
3. Install concrete bumper stops.
4. Pave and stripe the driveway to the satisfaction of the
City Engineer.
5. The parking area and rear of the restaurant shall be kept
lighted after dart: and during operating hours.
6. There shall be no flashing or blinking lights.
7. All trash shall be stored'in an enclosed container located
within a totally enclosed structure.
8. The subject property, parking area and sidewalks are to be
maintained in a clean and litter-free state.
9. Storage in the rear shall terminate within one year of
occupancy. A'6-foot block wall is to be constructed
separating the commercial use from the residential property.
10. This permit shall expire three years from the date of
issuance, except that the owner may apply for an extension
of time, and the Commission may consider and grant this
extension of time as they then consider appropriate without
benefit of a public hearing.
11. This Conditional Use Permit shall not become effective until
the owner/applicant of the property involved has filed with
the Planning Department a signed, notarized affidavit of
acceptance of conditions.
12. This Conditional Use Permit is approved contingent to the
approval of Parcel Flap 7459.
13. There shall be no live entertainment on the premises and no
music, in any form when doors are open.

6. AMENDMENT TO ZONING ORDINANCE - Consideration of amendment to
Zoning Ordinance regarding block walls.
Mr. Sullivan present-Memorandum.
Chairman DeTora opened public hearing at 0:26 p.m.

Mr. Wrightmeyer said he had not seen the ordinance and queried
the Commission on methods of notifying the public.
Mr. Sullivan responded that hearing had been duly advertised.
City Attorney confirmed that advertising as such is legally
sufficient.
Public hearing closed at 8:30 p.m.
Discussion by Commission.
It was moved by Commissioner Lowrey, seconded by Commissioner
Cianciola and carried to postpone action on Amendment to
Zoning ordinance to December 6 meeting.

7. ZONE CHANGE 76-80 - Change of zone on property located at
8614 Valley Boulevard from R-1 Single Family Residential to
C-3 Commercial.
Public,hearing continued from November 1, 1976. There being no
opponents or proponents, the public hearing closed at 8:,42 p.m.
Discussion by Commission.
It was moved by Commissioner Lowrey, seconded by Commissioner
Tury and carried to direct Staff to prepare a resolution
recommending to the City Council approval of Zone Change 76-80
and approval of the Negative Declaration.

OTHER BUSINESS
8. CONDITIONAL USE PERMIT 62 (AMENDED) - Consideration of a request
to amend Conditional Use Permit 62 to permit a lumber yard in a
C-3 Zone.
Mr. Sullivan presented the Staff Report.
Discussion by Commission.
It was moved by Commissioner Tury to strike the word "wooden"
from the second condition. Motion died for lack of a second.
It was moved by Commissioner Lowrey, seconded by Commissioner
Cianciola and carried to approve Conditional Use Permit 62 as
amended, subject to conditions as listed below:

1. That the demolition of any existing structures and the
erection of any new structures comply with the requirements
of the Building and Safety Department of the City.
2. That the wooden fence on the east property line be maintained
in a state to adequately protect the adjacent residents.
3. That within ten days of the approval of the Conditional Use
Permit the applicant will file with the Planning Department a
notarized affidavit agreeing to the conditions as set forth.
4. That this Conditional Use Permit only becomes effective upon
the adoption of Zone Change 80 by the City Council.

9. CONDITIONAL USE PERMIT 47 - Consideration of a request for
extension of Conditional Use Permit 47 for operation of a
pre-school within an R-2 Zone.
Mr. Sullivan presented the Staff Report.
Discussion by Commission.
It was moved by Commissioner Cianciola, seconded by Commissioner
Tury and carried to approve extension of Conditional Use Permit
47 for a period of 5 years.

10. CONSENT CALENDAR
CC-A RESOLUTION 76-20 - A resolution of the Planning Commission
recommending to the City Council amendment of the Land Use
Element of the General Plan.
It was moved by Commissioner Tury, seconded by Commissioner
Cianciola and carried to approve Resolution 76-20 as printed.

11. MATTERS FROM CITY OFFICIALS AND STAFF
a. Commissioner Tury recommended that Commission propose a
Rosemead Beautification Committee to City Council.
Mr. Dickey stated that the City Manager's office was
studying the matter and would submit a report to the
commission.
b. Commissioner Cianciola questioned what had been heard
regarding George McHose and his bond.

Mr. Dickey stated'that- he had seen the McHose building
and that it was developing substantially, but had not
made contact with Mr. McHose.
Chairman DeTora questioned if McHose's $1,000'had been
refunded.
Mr. Dickey stated it had not been refunded.
Commission discussed the amount of bond assessments
legally permissible.
City Attorney commented on performance bonds.
Commission concurred that further study of the matter would
be in order.
c. Chairman DeTora questioned status of relocated home at
3249 Muscatel.
Mr. Dickey stated that the City had filed action with the
County Engineer to demolish structure if no response was
heard from the owner by December 4 (30 days after notification).
He stated further that four other houses on Muscatel were
under similar consideration.
d. Chairman DeTora questioned all who-wished to attend the
Southern California Planning Congress dinner on November 18.
e. Commissioner Cianciola commented on a late notice for a
meeting he had received from the office.
It was agreed that when notices for meetings were received
in the office at a late date, telephone inquiries would be
made to the Commission.
12. ORAL COMMUNICATIONS FROM THE AUDIENCE - None
13. ADJOURNMENT - There being no further business to come before
the Commission, it was moved to adjourn. Chairman DeTora adjourned
the meeting at 9:15 p.m.
