CALL TO ORDER -The regular meeting of the Rosemead Planning Commission was called to order by Chairman DeTora at 7:30 p.m, in the Council Chambers of Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California. Pledge of Allegiance was led by Commissioner Ritchie' Invocation was delivered by Commissioner Cleveland 2. ROLL CALL Present: Cleveland, DeTora, Lowrey, Ritchie, Tury Ex officio: Dickey, Dilkes, Sullivan, Burns 3. APPROVAL OF MINUTES It was moved by Commissioner Tury, second by Commissioner Lowrey to approve the minutes of August 15, 1977 as printed. 4. ORAL COMMUNICATIONS FROM THE AUDIENCE - On matters not on the Agenda - None 5. PUBLIC HEARING ZONE CHANGE 77794 -Request -from the Redevelopment Agency for a change of Zone from R-2 and P, to C-3 (Medium Commercial), for property located in the general area at the Southwest corner of Garvey and San Gabriel Boulevard. Mr. Sullivan presented the Staff Report Chairman DeTora opened the Public Hearing at 7:30 p.m. It was closed accordingly. After discussion by the Commission, it was moved by Commi.ss:ioner, Tury, second by Commissioner Cleveland to approve Zone Change 77-94, and the Negative Declaration, and to adopt the Resolution 77-29, subject to an inactment clause added. ROLL CALL VOTE AYES: Tury, DeTora, Cleveland, Lowrey NOES: None ABSTAIN: Ritchie * 6. CONDITIONAL USE PERMIT 77-118 Consideration of a request by Mollie Padilla to operate a Board and Care Facility for four to six ambulatory Seniors, located at 7435 Garvey Avenue. Mr. Sullivan presented the Staff Report Chairman DeTora opened the public hearing at 7:40 p.m. Oath was administered Proponent: Ms. Mollie Padilla -Applicant 3340 N. Evelyn Ms. Padilla stated that before she would be able to operate the facility, she would have to pass inspections by the . Fire and Health Department, and assured the Commission that everything would be brought up to Code prior to moving in. =Planning Commission Wng • September 6, 1977 Page 2 Opponent: Mr. Leroy Spregue- Businessman in neighborhood 7444 Garvey Avenue Mr. Spregue was opposed to this use as he felt it was not suitable due to inadequate electrical and plumbing conditions. Chairman DeTora closed the public hearing at 7:50 p.m. Discussion by Commission - Discussion ensued regarding safety eatures involving the electrical and plumbing conditions, and all around safety for the eldery people who would be residing there. Recess was called at 8:07 p.m. so that Mr. Sullivan could review Ms. Padilla's file for any previous complaints at the other Board and Care Facility she operates at 3340 N. Evelyn. Commission reconviened at 8:18 p.m. Mr. Sullivan stated that as far as he could see, her records showed that she had passed every inspection since 1975, in accordance with the Health and Fire Departments, and could see no record of any other complaints or actions against.her. "Chairman DeTora stated, "We accept what Mr. Sullivan has read, but there are still more to it." DeTora closed the public hearing at 8:30 p.m. It was moved by Tury, second by Ritchie to approve CUP 77-118 subject to the following Conditions and Findings and the Negative Declaration: 1. Fill in or remove existing pool in rear yard. 2. Apply for appropriate licenses for Board and Care Facility. 3. Comply with any conditons set forth by County Building and Safety, Fire and Health Departments. 4. Slip proof coverings on floors of bathrooms, showers and bathtubs, and handrails in same areas in conformity with State and County regulations. 5. All floor areas to be fully covered in conformity with State and County regulations. 6. This permit shall be granted for a period of two years, at which time another public hearing to be set. 7.. Comply with Section 5100-51057 of Rosemead Municipal Code in regards to storage of trash. 8. Property and landscaped areas to be well maintained. % 9. Applicant to sign an affidavit of agreement within ten days of approval of CUP. 10. Install Fire detectors per Fire Department recommendations. 11. Replace cellar door with lock in rear yard. CONDITIONAL USE PERMIT 77-117 -Consideration of arequest by Frederick anziger, MT-., for the establishment of a Learning Center for approximately twelve educationally handi- capped children,, located at 4509 Rosemead Boulevard, on the Nest side o[ the street. Mr. Sullivan presented the Staff Report Planning Commission 4ng • September 6, 1977 Page 3 Public Hearing opened at 8:35 p.m. Oath was administered Proponents: Ms. Virginia Fuller, 4519 Rosemead Boulevard She state that the school had a written agreement with the Bahooka Restaurant for the use of their parking lot. Also, that there would be safe loading and unloading of the children in the parking lot-located at 4519 Rosemead Boulevard. Opponents: None Public Hearing closed at 8:40 p.m. Discussion by the Commission: Discussion followed regarding close proximity o the sc ool to an establishment selling alcoholic beverages. Recess was called at 8:45 by Mr. Sullivan to look up Code Meeting was reconviened at 8:55 P.M. It was moved by Lowrey,. second by Tury to grant CUP 77-117 with the added stupulations to Conditions 1-5: 1. All conditions imposed by the Los Angeles County Fire Department and Building and Safety Department, be met. 2. The proposed use be maintained and operated as described by the applicant. 3. The applicant obtain all necessary permits from appropriate Government agencies regarding school facilities. 4. All loading and unloading of the children for this school to be at 4519 Rosemead Boulevard. 5. The applicant sign an affidavit agreeing to the preceding conditions within 10 days. 6. Use not be otherwise prohibited by law as a result of its proximity to a business selling alcoholic beverages. ROLL CALL VOTE: AYES: Tury, Ritchie, Cleveland, Lowrey NOES: DeTora ABSENT: None 8. 'DESIGN REVIEW J.H. Hendrick and Company, 900 S. San Gabriel Boulevard, San Gabriel. Construction of an 11 unit apartment complex at 9225 Glendon Way. Mr. Sullivan presented the Staff Report i.nEorming the Commission that it would be a 22 unit building instead of the 11 unit complex originally planned for. Addressing Commission: Mr. Euye, Real Estate Agent Discussion by Commission It was moved by Ritchie, second by Lowrey to approve Design Review as amended to include the New Plan and Conditions 1-6: 1. Install street improvements to County standards with a pave- out to the existing edge of pavement. 2. Install a 6" AC concrete drive apron. 3. Driveway shall be constructed of 2" of AC over 3" base, and contain a concrete feather drain. 4. Concrete wheel stops for parking spaces. 5. Install permanent sprinkler system in landscaping areas. 6. All electrical utilities to be underground within the project area. 7. Leave decision of 6 ft. woodeih'fence, (cedar or redwood); to the discretion.of the Planning Director. ROLL CALL VOTE: AYES: Tury, Ritchie, DeTora, Cleveland, Lowrey NOES: None ABSENT: None 9. MODIFICATION OF PARCEL MAP 6718 - Applicant requesting that Planning Commissio- Aing September '6,'T977 Page 4 Conditions 2 and 3 of said Parcel Map be delayed, at property located at 9200 Valley Boulevard. Mr. Sullivan presented the Staff Report Addressing Mr. Dale L. Ingram, Consultant Commission: idr. Ingram stated he wished to defer, not waive, the conditions till such time that the property was sold. Discussion by the Commission It was moved by 'Lowrey to delay until written agreement from Mr. Griegorian was received. Motion died for lack of a second It was moved by Cleveland to approve Modification of.Parcel Map 6718. DeTora second for discussion, DeTora dropped second. It was moved by Lowrey, second by Ritchie that the Modification for Parcel Map 6718 be delayed until written agreement from Mr. Griegorian had been received by the City Attorney. Poll taken on attendance for Southern California Planning Congress Meeting. B. Date set for Study Session meeting on September 20, 1977 at 7:30 p.m. C. Chairman DeTora asked that the Commission have copies of all public notices being sent out for Public Hearings. Staff stated that this would be complied with. D. Tury questioned a Pizza place on Valley Boulevard selling beer in a C.B.D. Zone. Staff to check into. 12. ADJOURNMENT - There being no further business to come before the Commission, it was adjourned.
