PC - Minutes 07-05-77CITY OF ROSEMEAD 8838 VALLEY BOULEVARD ROSEMEAD, CALIFORNIA PLANNING COMMISSION REGULAR MEETING JULY 5, 1977 MINUTES 1. CALL TO ORDER - 7:30 P.M. Pledge of Allegiance was led by Commissioner Lowery. Invocation was delivered by Commissioner fury. 2. ROLL CALL Present: Tury, Detora, Cleveland, Lowery. Absent: Ritchie Lx Officio: Dickey, Dilkes, Sullivan, Koury 3. APPROVAL OF MINUTES - Regular Meeting - June 20, 19,77 Commissioner Tury stated that Item 97 of the June 20, 1977 Minutes be in full compliance with all applicable ordinances. It was moved by Commissioner Lowery, second by Commissioner Cleveland, and carried to approve the Minutes of the regular meeting of June 20, 1977, as corrected. ROLL CALL VOTE AYES: Tury, Detora, Cleveland, Lowery NOES: None ABSENT: Ritchie 4. ORAL COMMUNICATIONS FROM AUDIENCE Addressing Commission: Mr. Mike Selby 4631 N. Muscatel Mr. Selby addressed the Commission regarding the status of Zone Change 77-91. Mr. Selby pointed out that the site under construction was in a cluttered, unkempt condition and a nuisance to surrounding property owners. Mr. Selby offered his suggestion of changing the present R-1 zone to an R-3 zone. Commissioner, Tury moved to defer the matter, second by Chairman Detora, pending further investigation into the construction of the driveway and rezoning proposal. Conditional Use Permit 73 - Consideration of extension of CUP-73, Valley Inn, located at 9322 Valley Boulevard Chairman Detora asked if there was anyone present representing the above requested Conditional Use Permit application,.there was no one present. A motion was made by Commissioner Lowery, and second by Commissioner Cleveland to continue consideration of extension, pending the personal appearance of Mr. Herbert Finley. Notice to be given to Mr. Finley of next meeting date via Registered Mail, Return Receipt. POLL CALL VOCE AYES: Tury, DeTora, Cleveland, Lowery NOES: None ABSENT: Ritchie 6. Conditional Use Permit 77-116 - Continuation of consideration for CUP-77-116, property located at 9238 Lower Azusa Road Mr. Robert Classon appeared before the Commission commenting on the letter submitted by him from John Sens, City Engineer. Mr. Classon stated the letter clarified any questions regarding drainage of the property. Chairman Detora questioned the validity of a 400 less surface water resulting from the filling of the adjacent property on the Nest. Commissioner Tury cited that a 6 foot block wall is part of the Municipal. Code not,;, and is a requirement for the above property. Further discussion ensued relative to proper drainage on the site. Recess 8:10 P.M., Commission reconvened at 8:20 P.M., After discussion, a motion was made by Commissioner Lowery to deny Conditional Use Permit 77-11.6, as lie felt the site was not suited for this type of use, motion second by Chairman Detora. ROLL CALL VOTE: AYES: Detora, Lowery ABSENT: Ritchie NOES: Tury ABSTAIN: Cleveland Commissioner Cleveland stated he :felt that there had been no better improvement offered for flood control. PC Minutes Page 3 REGULAR BUSINESS 7. Parcel Map 8345 Staff report regarding subdivision of two parcels into four parcels located at 3122 and 31.28 North Muscatel. Commissioner Tury stated that Commissioner Ritchie had requested deferment of Parcel Map 8345 to the next meeting. Motion was made by Commissioner Tury, second by Commissioner Lowery, to continue this matter to the Jul), 18 meeting. ROLL CALL VOTE AYES: Tury, Detora, Cleveland, Lowery NOES: None ABSENT: Ritchie 8. Parcel Map 8395 - Staff.Report -regarding subdivision of parce into two parcels located at 3845 Earle Street Mr. Vincent Petralia appeared before the Commission and was given a copy of the Engineering Report. The matter was then deferred to later on the Agenda. 9. Re's'blution'77-19 (Amended) - Adoption of Amended Resolution 9, is ey a-e's Bar, located at 9736 Valley Boulevard. A motion was made by Chairman Detora, second by Commissioner Cleveland, to adopt.Amended Resolution 77-19. ROLL CALL VOTE AYES: Tury, Detora, Cleveland, Lowery NOES: None ABSENT: Ritchie OTHER BUSTNESS 10. Chairman Detora announced a meeting of the Southern California Planning Congress, to be held on July 14, 1977, in Buena Park. ROLL CALL VOTE AYES: Cleveland NOES: Detora, Lowery, Tury ABSENT: Ritchie (Announcement sent'via mail) 11. Continuation of relocation at 2632 Muscatel Addressing Commission: Dr. b4cCall Dr. McCall appeared, by request of the Planning Commission, showing the requested documents pertaining to property located at 2632 Muscatel.. lie offered them [or review to Commissioners. Commissioner Tury suggested that City Attorney, Mr. Di.lkes, review all the legal documents. PC Minutes Page 4 REGULAR BUSINESS 11.. (Continued) 12. Dr. McCall stated that lie had turned the foreclosure over to his attorney, Mr. Simpson, located at 129 Avenida Coda, San Clemente, California 92672. A motion was made matter pending Mr Commissioner Tury 90 days, with the the property in a during the 90-day by Commissioner Tury to continue this Dilkes,' review of the legal documents. motioned to extend the foreclosure stipulation that Dr. McCall maintain reasonably clean and orderly condition extension. It was noted that Dr. McCall would have a representative attend, since he would be on vacation at that time. ROLL CALL VOTE AYES: Tury, Detora, Cleveland, Lowery NOES: None ABSENT: Ritchie Parcel Map 839S (Continued) Addressing Commission: Mr. Vincent Petralia Mr. Petralia spoke to the Commission explaining that he intended to build two new houses on his property and demolish the present house. FIe stated the curbings were already in and that lie would install a sidewalk. It was moved by Commissioner Tury, second by Commissioner Cleveland to approve Parcel Map 8395, located at 3845 Earle Street. ROLL CALL VOTE AYES: Tury, Detora, Cleveland, Lowery NOES: None ABSENT: Ritchie 13. ORAL COMMUNICATIONS FROM THE AUDIENCE - None 14. MATTERS FROM CITY OFFICIALS AND STAFF A. Commissioner Tury stated, as a matter of note, that the Valley Boulevard overl.ay would be on the next Agenda, July 18, 1977. B. Commissioners discussed Conditional Use Permits being made public at the time of sale. 1). Commissioner bowery will be on vacation during the next Planning Commission Meeting (July 18, 1977) and asked to be excused. E. Chairman Detora stated applicants should be notified prior to their respective meeting, and the resultant decision should be mailed to them. Motion made by Commissioner Tury, second.by Commissioner Cleveland, to comply with above. F. Commissioner Detora questioned Planning Director Sullivan as to the Ordinance covering the size ol: signs on the outside of buildings. G. Commissioner Tury inquired to Asst. City Manager Dickey, if we had a Code Enforcement Officer. Asst. City Manager Dickey stated we would be getting a Code Enforcement Officer within a month. is .
