It was moved by Commissioner Tury, second by Commissioner
Lowrey and carried to approve the Minutes of June 6, 1977 as
printed.

5. ZONE CHANGE 77-91. Consideration of a request by Rafael Sanchez
or a change 6-E -zone from C-1. to R-3 for property located at
4521, 4527 Muscatel, and 8757 Mission Drive, Rosemead.
Mr. Sullivan presented the staff report.
Public hearing was opened at 7:35 p.m.

Addressing the Commission:
Mike Selby, 4631. Muscatel, owner of property at
. 4532 - 34 Muscatel, Rosemead
Mr. Selby queried the Commission as to what _restr,.icti_on are
being imposed along with the Zone 'Change - and as to why the
City permitted the construction of a carport in lieu of a
garage.
Planning Director Sullivan assured Mr. Selby that the
subject carport was permitted in accordance with the
Rosemead Municipal Code.

Discussion ensued in regards to the driveway materials being
used and whether they were substandard. (gravel)

Tt was moved by Commissioner Tury, second by Commissioner
Ritchie that until such time that a paved driveway is
installed that this matter be deferred.

Commissioner Lowrey requested the record show that his no vote
was due to his opinion that the driveway standards were
already established in Section 9122.13 of the Parking
Ordinance.
6. CONDTTTONAL USE PERMIT 98 (MoctiLiati.an o`f. ) Consideration of
approval and modification aE cal :i.tions ]or Sliakey Jake's Bar
located at 9736 Valley Boulevard, Rosemead.
Mr. Sullivan presented the staff report,.

Public hearing was opened 8:OS p.m.
Proponents:
Marion Curtis , 10704 Elliot, South E1 Monte
Mr. Curtis explained his efforts in having a sign company remove
the blinking lights and the difficulties in getting someone to
do the job. Mr. Curtis also recommended that the Planning
Commission somehow improve notification of pending buyers of
establishments that there are Conditional Use Permits for
such businesses.
Commissioner Ritchie considered CUP's running with the land vs.
being assigned to individual owner as possibility of
notification of new owner automatically upon sale.
Forrest K. Weaver, 1923 Pepperdale, prospective buyer
Mr. Weaver stated he intended to upgrade the property.

it was moved by Commissioner Ritchie, second by Commissioner
DeTora to reopen the public hearing for .futher comment by
Mr. Curt:is...... Motion carried .
Marion Curtis, 10704 Elliot, South El. Monte
Mr. Curtis was concerned over the parking shortage and why
it is being brought up at this time, since the bar has been
operating for many years.

It was moved by Commi.ssi.oner Cleveland, second by Commissioner
Ritchie to approve the Conditional Use Permit 98, with
modifications subject to the following conditions:
1. Section 9158 (3) of the Rosemead Zoning
ordinance prohibits blinking and :flashing signs.
Remove or modify existing sign so that it conforms
to Part XXIII of the Rosemead Municipal Code,
Sign and Outdoor Advertising.
2. Comply with Sections 5401 - 5415 of the Rosemead
Municipal Code which deal with the storage,
accumulation, collection, and disposal of garbage,
rubbish, trash and debris.
3. Doors to remain, closed at all times during hours
of operation.
4. Apply for appropriate City of Rosemead Bus=iness
License and comply with any conditions set forth
by the Health, Fire, and Building f, Safety Depts.
pertinent to approval of said license.
5. This Conditional Use Permit is approved for a
period of one (1) year at which time the Commission
can review and may consider an extension without
benefit of a public hearing.
6. An affidavit of agreement to be filed with the
Planning Department within 10 clays after
approval by the Planning Commission.
7. This permit shall be issued to the person of Forrest
K. Weaver , shall be his personal property, and shall
not be assigned, sold or otherwise transferred to
any other person.
8. Repair missing section of sidewalk on Brookline
approximately 30' south of Valley Boulevard. All.
work to be done to the satisfaction of the Planning
department and in no event to exceed 8' linear feet
of sidewalk.

7. PARCEL MAP 8112 - Addendum staff report re: mitigation measures
to reduce noise levels - This map was originally considered at
the May 1.6, 1977 meeting of the Commission.
Mr. Sullivan presented the addendum report.
Discussion ensued regarding the advantages of an 8' block wall
vs. a berm and wall.
Addressing the Commission:
Forrest Lundstrom - Mr. Lunclstrom preferred
construction of an 8' wall for a buffer as
opposed to a berm and 6' block wall.

It was moved by Commissioner Tury, second by Commissioner Lowrey
to approve parcel Map 8112 subject to the construction of an
8' decorative block wall as a mitigation measure to the
freeway noise as shown on Exhibit A.

Addressing the Commission Mr. Glenn Clanton, Leyburn Drive
Mr. Clanton suggested a meandering block wall such as there
is on the Pomona freeway, which is much more attractive.
o. DESIGN REV:[Ii1V - Thira Construction Company - Consideration
of design iew for the construction of 20 apartment units
at 8927, and 8921 Glendon Way, Rosemead. P-O-D Zone.
Mr. Sullivan presented the staff report.
Addressing the Commission: Mr. Thira, Thira Construction
Discussion ensued between Mr. Thira and the Commission
regarding undergrounding of the utilities and submission of
more precise renderings, to.include green belt areas and
materials and color of exterior facades.
It was the concensus of the Commission that this Design
Review be brought back before the Commission when more
precise plans are ready. Initial approval was given to the
preliminary plot plan.
9I DESIGN REVIEW - Hari Alipuria - Consideration of design
review or a "I unit motel complex, tea shop, managers
quarters, office at the n/w corner of Valley Boulevard
and Bartlett.Avenue, Rosemead. C-3-D Zone, Tentative.
Mr. Sullivan presented the staff report.
Addressing the Commission: Hari Alipuria, 1554 S. Prospect,
San Gabriel, CA
Discussion followed regarding the amount of dedication
would be required in conjunction with the development;
and the appropriate number of kitchenettes that would
be approved it was the concensus of the Commission
to approve the amount of 16 kitchenetts in the new
construction.
It was moved by Commissioner Lowrey, second by Commissioner
Tury to approve the design overlay subject to the conditions
of the staff report and the recommendations of the County
Engineer; and the relevant survey and dedication of Bartlett.

10. RESOLUTION 77-22 - Recommending to the City Council of the

It was moved by Commissioner Ritchie, second by Commissioner
Lowrey and carried to waive further reading and adopt
Resolution 77-22.

12. RESOLUTION 77-24. Recommending to the City Council adoption
o amended Article IX, Chapter 2, of the Rosemead Municipal
Code, regarding Subdivision Regulations. (Adoption of new
Subdivision Ordinance)
It was moved by Commissioner Lowrey, second by Commissioner
TurV Lo Waive further reading and adopt Resolution 77-24,

13. ORAL COMMUNICATIONS FROM THE AUDIENCE - None
14. MATTERS FROM CITY OFFICIALS AND STAFF
A. Correspondence re: Relocation at 2632 Muscatel, Dan Grey
Mr. Sullivan made reference to correspondence received
from Dr. McCall, 1120 W. La Palma, Anaheim in regards
to forclosure proceedings regarding the above property.
Addressing the Commission: Doug Crittendon, representing
Dr. McCall
Dan Grey, 1685 E. 53rd St.
Long Beach
Commission discussed the lack of cooperation on Mr. Grey's
part in completing the relocation within the alloted time
and the Commissions repeated extensions granted in good
faith.
It was moved by Commissioner Tury and unanimously carri.ed
to instruct Dr. McCall or a representative to appear
before the Commission at the next meeting to inform the
Commission the status of the forclosure proceeding
if any and to supply necessary documents pertinent to
this matter, i.e. Trust Deeds, notes, Notice of Default.
B. City Attorney Dilkes informed the Commission of the City
Councils' request to prepare a clarifying ordinance
in regards to outdoor storage.
C. Commissioner Tury queried as to whether the moratorium
on Valley Boulevard -.D- Overlay was being sent to the
City Council. He was informed it is scheduled for
the next regular Council meeting.
Commissioner Tury discussed that clarification be made
as to-standards for residential driveways and if such.
provisions are set forth in the Building Code.
Cormmissioner.Tury reviewed pending project list
submitted from the Planning Department: and suggested
consideration be given to arranging a study session
with the City Council to determine where priorities
are in reference to the projects.

D.. Commissioner Ritchie commented that he would be on
vacation at the next meeting.
15. ADJOURNMENT
There being no further business to come before the Commission,
it was moved to adjourn.
