CALL TO ORDER - 7:33 p.m. Pledge of Allegiance was'led by Commissioner Cianciola Invocation was delivered by Commissioner Ritchie 2. ROLL CALL Present: Commissioners Cianciola, DeTora, Lowrey, Ritchie, Tury Ex officio - Dickey, Dilkes, Sullivan, Christianson, Herman, S. Young 3. APPROVAL OF MINUTES It was moved by Commissioner Lowrey, seconded by.COmmissioner Cianciola, and carried to approve the minutes of the Regular Ad- journed Meeting of March 28, 1977. ROLL CALL VOTE: AYES: Lowrey, Cianciola, DeTora, Ritchie, Tury NOES: None 4. ORAL CO111.1UNICATIC7dS FROM THE AUDIENCE - None Public Hearings 5. AMENDMENT TO ZONING ORDINA?1CE - Consideration.of Amendment to Zoning Ordinance regarding Storage in Yards. As this was a continuation from the previous meeting, Chairman DeTora reopened the Public Hearing at 7:40 p.m. Oath was administered. Addressing Ed i4ilane Commission: 2609 Bartlett Mr. Milane commented that the matter should be tabled for further study. Addressing Howard Andrews Commission: 2439 La Presa Mr. Andrews had some questions to ask regarding the proposed ordinance. Attorney Di7.'ces was able to respond to the questions. Chairman DeTora closed the Public Hearing at 7:56 p.m. It was moved by Commissioner Tury, seconded by Commissioner Cianciola, and carried to table the ordinance as written, remand it back to Staff for further study, and have them prepare.a new ordinance which shall contain two sections: one referring to trash in yards, and one referring to the storage of vehicles, with a subsection regarding recreational vehicles. It shall also contain a paragraph giving the Commission authority to modify the regulations in some necessary cases. Staff shall also publish and post for a new public hearing when the new ordinance is prepared. Commissioner Lowrey commented that a Study Session by the Commission might be a more expedient way to handle preparation of the new ordinance, but such was not the consensus of the Commission. ZONE CHANGE 77-85 - Consideration of a request for a change of zone from C-3 Medium Commercial and P Parking to R-3 Medium lultiple Residential for property located on the east side of Del Mar, north of Garvey. Mr. Sullivan presented the Staff Report. Chairman DeTora opened the Public Hearing at 8:03 p.m. Proponent: Louis Salazar, Applicant 2191 S. Garfield, 71onterey Park. Mr. Salazar expressed his hope that the Zone Change would be approved. He also made a minor correction of some information in the Staff Report. Addressing John Babakitis Commission: 3046 Del Mar Mr. Babakitis is a neighbor, and wondered what effect the zone change would have on his property. Opponent: Millie Babakitis 3046 Del Mar Mrs. Babakitis was under the false impression that her property's zone was being changed also. Commission provided'her with correct information. Chairman DeTora closed the public hearing at 8:09 p.m. Discussion by Commission. It was moved by Commissioner Ritchie, seconded by Commissioner Lowrey, and carried to approve Zone Change 77-85 and the Negative Declaration. ROLL CALL VOTE: AYES: Lowrey, Cianciola, DeTora, Ritchie, Tury NOES: None 7. CONDITIONAL USE PERMIT 113 - Consideration of a request to allow the sale of antiques in.CBD Zone (8940 Valley Boulevard). Mr. Sullivan presented the Staff Report. Chairman DeTora opened the public hearing at 8:18 p.m, Proponent: Eldon Beezley, Applicant 8527 Marshall St. 41r. Beezley commented on his experience and expertise in the antique business, and expressed his desire that the Commission approve the Conditional Use Permit. Chairman DeTora presented, and Attorney Dillces read, an article re;.arding "fake antiques." Chairman DeTora closed the public hearing at 8:33 p.m. Discussion by Commission. Commissioner Ritchie felt a condition should be added to the CUP making it non-assignable. Chairman DeTora felt that Applicant should be required to post a bond to repair the parking lot. It was moved by Commissioner Lowrey, seconded by Commissioner Ritchie, and carried to approve Conditional Use Permit 113, subject to the following conditions: Planning Commission Meeting Page 3 April.4, 1977 1. Subject property shall be operated.as a bona fide antique store. 2. Signs shall meet the requirements of the CBD Ordinance. 3. This Conditional Use Permit shall expire one year from issuance except that the owner shall be entitled to a two year extension, if the Director of Planning finds the Applicant's operation to be in conformity with the goals and purposes of Rosemead Municipal Code Section 9181 (last paragraph). Such extension shall be granted in accordance with Rosemead Municipal Code Section 9183.2 4. Within five days after approval of this Conditional Use Permit, Applicant shall submit a signed, notarized "Affidavit of Acceptance of Conditions" to the Planning Department. 5. This Conditional Use Permit shall be a personal permit issued to Eldon D. Beezley and Barbara D. Beezley (hereinafter the "Beezleys") and shall not be assignable voluntarily or involuntarily and shall terminate upon asssignment or upon the of business by the Beezleys at the location described herein. 6. All display of merchandise for sale on the premises shall be wholly enclosed within the building. ROLL CALL VOTE: AYES: Lowrey, Cianciola, Ritchie, Tury NOES: DeTora Chairman DeTora stated his reasons for voting "No" were (1) that he was not in favor of antique stores in the City as they led to used furniture stores; and (2) that he felt that the Applicant should be required to re-surface and/or repair the parking area. Recess was called at 8:50 p.m.; Commission reconvened at 9:05 p.m. 8. AMENDTIENT TO ZONING OP.DIUNTCE - Consideration of Amendment to Zoning Ordinance regarding Relocations. Addressing Eileen Walsh Commission: 15236 Burbank Blvd., Van Nuys Robert Simpson, President House Movers Assn. Pls. Walsh, an attorney, and ^Ir. Simpson had questions about various aspects of the proposed Ordinance. Through discussion with Commission and the City Attorney, these matters were resolved to satisfaction. Chairman DeTora closed the Public Hearing at 10:44 p.m. Attorney Dilkes read through the corrections as approved by the Commission, including Resolution 77-12, Declaring a Policy with Regard to Illegal Building Relocations. It was moved by Commissioner-Ritchie, seconded by Commissioner Cianciola, and carried to approve the Amendment to the Zoning Ordinance Section 9192, as modified, and the Negative Declaration. PARCEL MAP 8001 - Consideration of a request to subdivide' three lots from one parcel of land (Northwest corner of Mission and r:iuscatel) . Mr. Sullivan presented the Staff Report. Discussion by Commission. It was moved by Commissioner Ritchie, seconded by Commissioner Lowrey, and carried to approve Parcel Map 8001, subject to the conditions and findings, and the Negative Declaration. ROLL CALL VOTE: AYES: Lowrey, Cianciola, DeTora, Ritchie NOES: Tury 10. NIATTERS FROM CITY OFFICIALS AND STAFF a. Commission and Staff were polled regarding attendance at a symposium sponsored by UC Irvine - "Neighborhood Preservation and Rehabilitation in California Communities." b. Commission and Staff were polled regarding their attendance at the Southern California Planninq Congress meeting on April 14. c. A Study Session regarding the proposed Subdivision ordinance was set for Tuesday, April 19, 1977, at 7:30 p.m. Commission and Staff discussed the ordinance. d. Commissioner Ritchie commented on progress of the McHOSe relocation. e. Commissioner Cianciola commented that the Uniform Building Code (in regard to installation of fire warning devices) was not being adhered to. 11. ORAL C XIMUNICATIONS FROM THE AUDIENCE - None 12.
