1. CALL TO ORDER - 7:33 p.m.
Pledge of Allegiance was led by Commissioner Lowrey.
Invocation was delivered by Commissioner Tury.

3. APPROVAL OF MINUTES
It was moved by Commissioner Tury, seconded by Commissioner Lowrey,
and carried to approve the minutes of January 17, 1977.

4. ORAL COMMUNICATIONS FROM THE AUDIENCE - None
PUBLIC HEARINGS
5. AMENDMENT TO ZONING ORDINANCE - Consideration of amendment to Zoning
Ordinance, Section 9108 (Professional Office Zone) to add Lodge
Halls as a permitted use:
Mr. Sullivan presented the Memorandum.
Chairman DeTora opened the Public Hearing at 7:38 p.m., and there
being no proponents or opponents, the public hearing was closed.
Discussion by Commission regarding the on-site consumption of
alcohol at lodge halls and the possible controls to insure compat-
ability with surrounding areas.
It was moved by Commissioner Tury, seconded by Commissioner Cianciola,
and carried to add the following to Section 9181.1 of the Rosemead
Municipal Code (pertaining to Conditional Use Permits):
28. Lodge Halls in the P-0 Zone.

AMENDMENT TO ZONING ORDINANCE - Consideration of amendments to
Sections 9109.5 (C-1), 9111.5 (C-3), 9112.15 (CBD), and 9114.8 (M-1)
regarding Outside Display and/or Storage of Merchandise.
Mr. Sullivan presented the Memorandum.
Chairman DeTora opened the Public Hearing at 7:50 p.m., and there
being no proponents or opponents, the public hearing was closed..
Discussion by Commission.
It was moved by Commissioner Ritchie, seconded by Commissioner Tury
and carried to continue discussion on this matter until later in the
meeting.

7. DESIGN REVIEW 77-1 - PARK ROSEMEAD - Applicant - Joseph Giampaolo,
Ms. Christianson presented the Staff Report.
Addressing Joseph Giampaolo, Applicant

Mr. Giampaolo answered questions regarding the project.
Discussion by Commission.
It was moved by Commissioner Tury, seconded by Commissioner Lowrey,
and carried to approve Design Review 77-1 as recommended, adding
"and subject to Planning Department Approval" to Condition No, S.
and the Negative Declaration.

8. PARCEL MAP 7688 - a request to subdivide three lots from one existing
parcel of land.
Mr. Sullivan presented the Staff Report.
Discussion by Commission.
Attorney Dilkes stated he wished to make further study of the matter
regarding title of the parcel.

Applicant stated he would be agreeable to having Commission approve
the Parcel Map subject to Attorney's findings regarding legality.
It was moved by Commissioner Ritchie and seconded by Commissioner Tury
to approve Parcel Map 7688 (design alternate 3), allowing for one
driveway and subject to legality as deemed by City Attorney, and the
Negative Declaration.

Commissioner Lowrey suggested that right of way for Lot 3 for ingress
and egress on driveways of Lots 1 and 2 be added to the motion. Maker
and second agreed to amend the motion to include this stipulation.

9. PARCEL MAP 7729 - a request to subdivide two lots from one existing
parcel of land.

Discussion by Commission.
It was moved by Commissioner Tury, seconded by Commissioner Ritchie,
and carried to approve Parcel Map 7729 as written, adding Finding
No. 7 as follows, and approving the Negative Declaration:
7. The grant of a variance is necessary because the
size and shape of the parcel make the strict
application of Section 9105.6 and 9105.7 work an
unnecessary hardship upon the use of the property
and deny the owner of the property the same use
of the land as is enjoyed by similar properties in
the same neighborhood.

Attorney Dilkes commented on actions available to take because
Parcel Map 6202 conditions were not met.

These property owners were concerned with the fact that curbs and
gutters were not installed as per conditions of Parcel Map 6202.
It was moved by Commissioner Tury, seconded by Commissioner Lowrey,
and carried to approve Parcel Map 7792, subject to posting by
Applicant of a $1,000 performance bond for installation of curbs
and gutters for Lot 2, and the Negative Declaration.

12. APPEAL OF MODIFICATION COMMITTEE DECISION - Applicant - Mrs. Reba
Emerick, 9153 Bentel Avenue.
Mr. Sullivan presented the Staff Report.
Addressing Joe Venanzi, representing Applicant
Commission: 9123 Las Tunas, Temple City
Mr. Venanzi commented that Applicant believed original modification
request had been approved for a playroom on stilts.
Discussion by Commission.
It was moved by Commissioner.Ritchie, seconded by Commissioner
Tury and carried to deny the Modification appeal.

13. RESOLUTION 77-2 - Recommending a change of zone from P-d Parking
with Design overlay to R-1 Single Family Residential for property
located at 3953 Muscatel Street (Rosemead Mortgage Corp.)
It was moved by Commissioner Tury, seconded by Commissioner Lowrey,
and carried to adopt Resolution 77-2 as written.

6. AMENDMENT TO ZONING ORDINANCE - Display and Storage (Further
discussion)
City Attorney presented to Commission his modification of
Paragraph B for proposed amendments to Sections 9109.5, 9111.5,
and 9112.15:
B. Outside storage (not for display purposes) is
permitted on the rear area of a lot or parcel
of land. On corner lots or where site coverage
or topography make rear yard storage impossible
or impose a severe hardship upon the owner or
occupant of the parcel, storage may be permitted,
subject to the approval of the Director of Planning,
in a side yard or open yard adjacent to a corner.
Any outdoor area used for storage shall be completely
enclosed by a solid masonry wall and solid gate not
less than 6 feet in height. The Director of Planning
may approve the substitution of a fence or decorative
wall where such fence or wall provides adequate
visual clearance, is structurally adequate, and
equivalent in decorative appearance. In no event
shall the height of such storage exceed the height of
the wall or fence enclosing the storage area.
It was moved by Commissioner Cianciola to strike 'Tiotorcycle Sales"
from the.list of exceptions in Sections 9111.5, 9112.15, and 9114.8.
Motion died for lack of a second.

It was moved by Commissioner Tury, seconded by Commissioner Lowrey
and carried to approve the amendment, modifying Paragraph B as
per City Attorney, adding "and pool displays" to clarify the
exception "Play Yard Equipment" as listed in proposed Sections
9111.5, 9112.15, and 9114.8, and approve the Negative Declaration.

14. MATTERS FROM CITY CFFICIALS AND STAFF
a. Commissioners were polled regarding attendance at Southern
California Planning Congress meeting on February 10, 1977.

It was moved by Commissioner Lowrey, seconded by Commissioner
Tury and carried to adopt Policy Statements as written.

Mr. Kennedy commented on methods of public notification.
Commissioner Cianciola stated that he felt Method "A" (publica-
tion in i._wspaper) was best method of notification.

It was moved by Commissioner Tury, seconded by Commissioner
Lowrey ar_d carried to direct Staff to employ Methods "B" and/or
"C" (using large. signs) in noticing Negative Declarations.

It was moved by Commissioner Lowrey, seconded by Commissioner
Cianciola and carried to approve organization of Committees

e. Commi-scin-P; -:V:ry requested Staff to obtain a copy of
West Covina's r" 4"n -nance" ordinance.
f. Commissioner Tury requested Staff to investigate trucking
business in residential area at 9248 Pitkin.
g. Commissioner Ritchie inquired about disclosure of zoning and
other details to prospective buyers of property by brokers.
Attorney-Dilkes explained current methods.
Commissioner Cianciola commented that buyer could only know what
seller wished to tell him.

h. Commissioner Lowrey reminded Commission of Conflict of
Interest meeting to be held on February 8, 1977.
1S. It was moved by Commissioner Ritchie and seconded by Commissioner
Lowrey and carried unanimously to adjourn to February 15, 1977,
for study session purposes.
Chairman DeTora adjourned the meeting at 11:15 p.m.
