MEDIUM MULTIPLE RESIDENTIAL" TO PO-D; PROFESSIONAL
OFFICE-DESIGN OVERLAY" FOR PROPERTY LOCATED AT 3859 N.
ROSEMEAD BOULEVARD (APN: 5390-013-033).
WHEREAS, Ms. Shyh-Mine Lii, 3660 N. Rosemead Boulevard, Rosemead, California,
91770, filed an application requesting a zone change from the R-3 to PO-D zone for property
located at 3859 N. Rosemead Boulevard on July 2, 1996; and
WHEREAS, the City of Rosemead has an adopted general plan, zoning ordinance, and
map, including specific development standards to control development; and
WHEREAS, Rosemead's General Plan designates the subject property for "Mixed Use;
Commercial/Residential" allowing up to fourteen units per acre and a maximum commercial floor
area ratio of 1:1; and
WHEREAS, Rosemead's official Zoning Map designates the site for R-3; Medium
Multiple Residential development allowing up to one unit per 1,500 square feet of land (29 units
• per acre); and
WHEREAS, Sections 9185 and 9186 of the Rosemead Municipal Code authorize the
Planning Commission to consider and recommend proposed zone changes to the City Council; and
WHEREAS, Section 65860 of the California Government Code requires that zoning
ordinances and the zoning map be consistent with the adopted general plan; and
WHEREAS, on August 8, 1996, an initial study for the proposed zone change was
completed finding that all potential environmental impacts can be mitigated to a level of
insignificance; and
WHEREAS, on August 8, 1996, notices were posted in 10 public locations and 81 notices
were sent to property owners within a 300-foot radius from the subject property specifying the
public comment period and the time and place for a public hearing pursuant to California
Government Code Section 65091(a)(3); and
WHEREAS, on September 3, 1996, the Planning Commission held public hearings and
adopted PC Resolution 96-54, recommending City Council approval of Zone Change 96-202; and
WHEREAS, on September 26, 1996, notices were posted in 10 public locations and 81
notices were sent to property owners within a 300-foot radius from the subject property specifying
the availability of the environmental analysis, plus the date, time and location of the public hearing
for Zone Change 96-202; and
WHEREAS, on October 8, 1996, the Rosemead City Council held duly noticed public
hearings and sufficiently considered all testimony presented to them in order to make the following
determination.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Rosemead
as follows:
S flon 1. The City Council HEREBY DETERMINES that a Negative Declaration shall
be adopted. An initial study was completed to analyze potential environmental impacts pursuant
to the California Environmental Quality Act (CEQA). This study analyzes the potential
environmental impacts that could be created from the proposed project. The study was sent to all
responsible agencies, and noticed in 10 public locations, soliciting comments for more than a 21-

day period prior to the City Council hearing. This study found that all potential environmental
impacts can, and has, been mitigated to a level of insignificance.
Section 2. The City Council HEREBY FINDS AND DETERMINES that placing the
property in the Professional Office/Design Overlay (PO-D) zone is in the best interest of the
public necessity and general welfare, and good city planning practice dictates and supports the
proposed zone change. The change to the PO-D zone will provide a superior level of planning
and protection to the quality and character of residential neighborhood where the development is
proposed.
Section 3. The City Council FURTHER FINDS AND DETERMINES that Zone Change
96-202 is consistent with the Rosemead General Plan as follows:
A. Land IT se; The current medium density residential designation allows a density of
1 unit/1,500 square feet. The designation provided by Zone Change 96-202
(Professional Office) allows the same residential density plus allows for
development of office type uses. The General Plan designates the site for Mixed
use; Residential/Commercial. This designation is compatible with the present and
• proposed zoning land use designations. A concept plan has been submitted to
develop the site with a 5,000 square foot medical office building. The property to
the north has been designated and developed in a similar manner.
B. Circulation; The site is located on a corner lot along Rosemead Boulevard.
Rosemead Boulevard is a major arterial, State Highway. There is a break in the
raised median to create a turn pocket at this intersection. Adequate access is
provided on the side street (Guess Street). The concept plan proposes a circulation
design that uses Guess Street for vehicle access. The parking area would be
located behind the building which also creates a buffer for the neighboring
residential uses.
C. Housing; The Housing Element identifies potential residential development sites.
This site, which is zoned for residential use, is noted in this survey. The proposed
• zone change would not alter the potential residential development of the site.
However, if it is developed for offices as proposed, then there would be a decrease
in the current housing supply of one unit. There would also be a decrease in the
potential housing supply of 11 units (net). However, these units would be rental
units, and the Housing Element notes a need for more ownership units.
D. Resource Management; The developer will pay the City in-lieu fees for parks and
open space under the Quimby Act. These fees will be used to expand and/or
upgrade recreation facilities where the new residents will visit.
E. Noise; The office building is designed to front Rosemead Boulevard. There is a
parking area in the rear that is surrounded with landscaping. These improvements
would reduce the amount of vehicle traffic noise for the neighboring residences.
The structure would serve as a buffer and the setback would further reduce noise
levels from the use and street.
Section 4. The City Council HEREBY APPROVES Zone Change 96-202, amending
Rosemead Zoning map land use designation from "R-3; Medium Multiple Residential" to "PO-D;
Professional Office/Design Overlay" for property located at 3859 N. Rosemead Boulevard (APN:
5390-013-033).

Section. The City Clerk shall certify to the adoption of this Resolution and shall cause
same to be published as required by law.
