A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROSEMEAD RECOMMENDING TO THE CITY
COUNCIL OF THE CITY OF ROSEMEAD APPROVAL OF
THE AMENDMENT TO SECTION 9183.1 OF THE ROSEMEAD
MUNICIPAL CODE
THE PLANNING COMMISSION OF.THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The Planning Commission binds and detenminez
that a pub tic ean.ng was duty conducted on Decembers 20, 1976, in
the CounciQ Chambers ob the Rosemead City Hall, 8838 Vattey Bivd.,
Rosemead, CatiboKnia, and that notice ob .time, date, place and
puhpose o~j a6onezaid heaving was given according to Law.
Section 2. The Planning Commission recommends that the
Rosemead :;Muni Code be amended to ;'icead as bottows
9183.1 Expiration of Cond'itiona'l Use Permit
A. If the use authorized by any conditional use
permit is, or has been, unused, abandoned or
discontinued for a period of six (6) months
or the conditions have not been complied with,
said conditional use permit shall become null
and void'and of no effect.
B. If any condition attached to'a Conditional Use
Permit is violated or if any law, statute or
City ordinance is violated; the. conditional
use permit shall be suspended and the privileges
granted thereunder shall lapse;.provided.that
the applicant has been given written notice to
cease such violation and has failed to do so for
a period of 3Q, days. Repeated violations of any
of the conditions attached to a conditional use
permit, may be grounds for revocation of the
conditional use permit after.a public hearing
by the Planning Commission.
C. In the event that the operation of any part of
a facility granted by conditional use permit
should result in substantial complaints to the
Department of Planning, the conditions may be
modified if, after a public hearing by the Planning
Commission, such modification is deemed appropriate
in order to eliminate or reduce said complaints.
Section 3. The Planning Commission {utthen {rinds the
amendment .to e Rosemead Municipal Code will not have a zignisiean.t
adverse e46ee.t on the envinonmen.t as it vailf give the Planning
Commission the elective to insure the compatibility oA the conditional
uses with the suiuounding neighborhood.
Section 4. The Planning Commission buitthen binds that
a Negative Demon was phepaned in compliance with the
Calibmnia Environmental Quality Act (CEQA),,=the Guidelines {ion
the Implementation ob CEQA, and Rosemead Resolution 75-28.
