PC - 1976-15 - Denying a conditional use permit in conditional use permit case 76-5• 0 PC RESOLUTION 76-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DENYING A CONDITIONAL USE PERMIT IN CONDITIONAL USE PERMIT CASE 76-5. THE PLANNING COMMISSION OF THE CITY OF ROSEMEAD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Planning Commission does hereby find and determine that an application was duly filed by Westbuilt Enterprises, Inc., 15111 Whittier Boulevard, Whittier, CA with respect to real property located on the north side of valley Boulevard between Rio Hondo Avenue and Mission Drive, at 9373 E. Valley Boulevard in the City of Rosemead, California; to permit the establishment, operation,7and;maintenance of a neighborhood convenience store, including the off-sale of beer and wine. Section 2. A public hearing was held by the Planning Commission on August 16, 1976 at 7:30 p.m. in the Council Chambers of the Rosemead City Hall, 8838 Valley Boulevard, Rosemead, California, and a notice of the time, date, place, and purpose of aforesaid hearing was duly given. Section 3. The,Planning Commission Further finds ahd determines that facts do not exist as required by Section 9180 et seq. of the Ordinances of the City of Rosemead justifying a granting of the Conditional Use Permit in Conditional.USe Permit Case 76-5. Section 4. The Planning Commission Further finds:. 1. The proposed use is neither essential nor desirable to the public convenience or welfare of the City because at least twenty-two such convenience store uses currently exist in Rosemead and are already present in such overconcentration as to adversely effect the quality of life in the City, and; 2. Convenience stores are the source and focal point for crimes including burglary, armed robery and other crimes of violence; 3. The proposed use would encroach upon the right of an earlier Conditional Use Permit applicant to conduct his business in accordance with the Permit as issued on Conditional Use Permit No. 76-2, thus the proposed use would be detrimental to surrounding property owners. Section 5. The Planning Commission further finds that the project is one for which there will not be any adverse environmental . - consequences and that a Negative Declaration was thereby considered and approved. Section 6. Based on the aforementioned findings, the Commission hereby denies a Conditional Use Permit with respect to that property described in Section 1 of this Resolution. Section 7. This action shall become final and effective 10 days after this decision by the Planning Commission unless within such time a written appeal is filed with the City Clerk, for consideration by the Rosemead City Council as provided in the Zoning Ordinance. Section 8. The Secretary shall certify to the adoption of this Resolution and shall transmit copies of same to the applicant and the Rosemead City Clerk. ADOPTED this ay of 1976. DON DETORA, CHAIRMAN
